The Chief of the Fire Department, or hi• a •• 1gn-, ihall have power to llOdify any of th• provi•ion• of the Pire Prevention COd• adopted by 112.12 in any particul.ar in•tance, upon application in writing by the owner or l•••••, or any duly authorized agent thereof, when there are practical difficulti•• in the way of earring out the •trict letter of the code, provided that the •pirit of the COd• •hall be ob••rved, public •afety ..cured, and •ub•tantial ju•tic• done. ft• particular• of 8UCh llOdif ication when granted or allowed and the deci•ion of th• Chief of the Pire Department, or hi• d••ignee, •hall thereupon be entered upon the record• of the Pire Department and a •igned copy whall be furni•hed to th• applicant. 112.17 Appeal•. 1ftlenever the Chief of the Fire Departllellt ahall dl•approve an application or refu•e to grant a penait applied for, or di•approve• an application for llOdification, or when it i• claimed that th• provi•ion• of the Fire Prevention Code do not apply in th• .. nner in which the Chief of the Pire Department detezminea, or when it .i.a claiaed t:lla• -.ep6"eato•doll--'n9i ol ...., .. ...., ... edJteeD -~.. or wrongly interpreted by the Chief of the Fire Departileftt, andy permon aggrieved thereby .. y appeal fran the deci•ion of the Chief of the Pire Departaent to the Bnglewood Board of Adju•taent and Appeal• within 30 days from the date of the deci•ion appealed, which Board •hall revi.w th• declaJ.on of the Chief of the Pir• Department and render a final and binding deci•lon thereupon. In con•iderinq 811Ch appeal•, the Bnglewood Board of Adjuataent and Appeals 8hall have the powere granted to the Chief of the Pire Department by 112.16 hereof. 112.18 Bew Material•. A li•t •hall be made of any •uch new material•, proce•••• or occupanci•• which •hall be poaed in a coupicou• place inthe office of the Chief of the Pire Department, and copie• of •uch li•t ahall be made avail- able by hia to all interested per•on• • • •12.19 Penalties. Any permon who •hall violate any of the provi•ion• of the Fire Prevention Code adopted by 112.12 or who fail• to caaaply with the provi•ion• of said Pir• Preventl•·code, or who 8hall violate or who •hall fail to eo11ply with any order .. de thereunder, or who ahall build any atructure of any nature in violation of any detailed state- 11ent of •pacification• or plan• •ubmitted and approved thereunder, or any certificate or permit i••ued thereunder, and fran which no appeal ha• been taken, or who •hall fail to canply with mch an order a• affirmed or IDOdif ied by th• Bn9lewood Board of Adju•tment and Appeals, or by a Court of caapetent juris- diction, within the time fixed, herein, •hall be considered to have violated a municipal ordinance and ahall be subject. to tho•• penaltie• pre•cribed therefore by Chapter 27 of the Municipal Code of the City of Bn9lewood. Section 3. Section 23.10, Section 23.11, Section 17.7 and Section 17.18 of the Municipal Cod• of the City of Bnglewood, t09ether with all •ub•ection• thereof, are hereby repealed and all otherordinance•, or part• tshereof, conflict- ing with, or incon•i•tent with, the provi•ion• of thi• Ordinance or of the COde hereby adopted are hereby repealed. City Council of .the City of Bnglewood hereby decarea that, 8hould any •ection, para9raph, •entence, or word of thi• ordinance or of the COde hereby adopted be de~ clared for any rea•on to be invalid, it i• the intent of the said City council that it would have pa••ed all other portions of thi• ordinance independent of the elillination here from of any auch portion a• may be declared invalid. Sectiin 5. 'l'he Director of Finance and Records of the City of Bn~ewood, •hall at all time• after the introduc- tion of thi• orainance maintain on file in hi• office not le•• than thr-(3) copie• of thi• ordinance and (3) a>pies of the Pir• ~evention Code adoptled by Section 2 of this Ordinance. At all tilDe• after the effective date of this Ordinance, the •aid Director of Finance and Record• ahll llaintain a reaaonable •upply of copi•• of thi• Ordinance and of the rir• Prevention Code, which copi•• •hall be avail- able for purcha•• by the public at a price not to exceed one cent (10) per pa9e of text, plu• a handling charge of ten cent• (100) per copy.
