Ordinance •o. 8, Serie• 1959, aa -nded, of aaid City and the Laws of the State
of Color..So, hereby find• and deterainea that there exiats a necessity for the
cr .. tion of Paving Diatrict •o. 15, in aaid City, and the construction therein of
certain •tr-t and avenue illprov-nta, as deacribed herein: and
11111CRBAS, the City Council ha• heretofore directed the City Engineer to pre-
pare plane, apecificationa, map• and schedules in accordance with said laws: and
1111BRBAS, the City Bngineer haa filed with the Clerk of the said City all the
.. pa and certificate• of hi• aurvey, aa well as schedules, plans, specifications,
approxtwationa of coat, and all other matters and thing• in ccnplete form and
aubatance aa required by lavr and
11111CRBAS, the aaid report ao made and filed, together with details, specifi-
cation•, eatillatea, wapa and achedulea, are hereby approved and adopted by said
City COUncilr and
6DBAS, the City Council directed the City Clerk to publish in the Englewood
Herald and Bnterpriae, a newapaper of general circulation in said City, Notice
of a propoaition to create aaid Diatrictr and
11BBRBAS, the council ha• heretofore set a date for the Bearing on said pro-
poaition to create Paving Diatrict Bo. 15, auch date being February 22, 1965: and
that on aaid date at 8100 o'clock P.M., all ccnplainta and objections that might
be made in writing concerning the proposed improvement• by the owner or owners of
any real eatate to be aaaeaaed, or any peraon or persona interested generally,
would be heard and detenained by the City Council of said City of Englewood, be-
fore final action of aaid Council thereon, and that after the determination of all
ca1plainta and objection• waa made, aaid City Council would take up and consider
an ordinance creating aaid Diatrict and ordering the proposed improvements: and
W&BltBAS, the City Clerk, by adverti•-nt for a period of more than fifteen
(15) daya prior to the aaid 22nd day of February, 1965, gave notice in form and
aubatance of the matter• and thing• above mentioned as ordered to be given, in
all reapecta in accordance with law and aaid orderr and
WBBRBAS, the City Clerk ha• mailed to each known owner of real property to be
aaaeaaed with the coat of aaid improvements a Botice of Intention to create said
Diatrict, aa provided by the Reaolution adopted by the City Council on February 1,
19651 and
1lllBRllMI, at the time and place specified in aaid Notice, to-wit: February 22,
1965, the City Council met in open session for the purpose of hearing any object-
ion• or proteata that aight be wade against said improvements: and
11111CRBAS, certain written objections were filed and certain oral inquiries
and objection• were made at aaid meetingr and
WBBRBAS, the Bearing on aaid objections was continued until the regular
... ting of the City Council on Monday, March 1, 1965, for further consideration
by the Councilr and

'l'he petition• for the paving of the 4300 block South Grant were not returned
to the City by the petition circulator.

A written proteat waa received frcn Juliette Bayes, 1260 West Oxford: and

duly ordered after Rotice duly given and Bearing duly held, all aa required by
law.

Section 3. Said Diatrict ahall be known a• and the same is hereby designated
•paving Di•trict Ro. is•, Bnglewood, Colorado.
Section 4. 'lhe conatruction of aaid atreet and avenue improvements in and
for aaid Diatrict, a• ahown by the plan•, apecificationa and maps thereof, prepared
by th• City Bngineer and approved by the City Council of aaid City and now on file
in the office of the Clerk of •aid City, be and the aame is hereby authorized and
ordered, the .. terial to be uaed in the conatruction of said street improvements
to be in accordance with such map•, plane and apecificationa.
Section 5. By virtue of and in pursuance of the aforesaid laws and the
Charter and Ordinance Ro. 8, Series 1959, aa amended, of said City, local improve-
ment bond• of the City •hall be iaaued for the purpose of paying for the local
illprov ... nta in thi• Ordinance deacribed and provided to be constructed in said
PllYing Diatrict, in an maount not to exceed the coat of said improvements, includ-
ing engineering, legal and all incidental expenaea, as in aaid laws, Charter and
Ordinance provided.
Section 6. Said bond• •hall be authorized by an Ordinance later to be passed
in accordance with the Lava of the State of Colorado, the Charter and said
Ordinance Ro. 8, Seri•• 1959, a• ... nded, of said City.
Section 7. 'lhe Mayor and City Clerk are hereby authorized to advertise for
bid• to conatruct auch illprovanenta and for bids for said bonds to be issued, in
three (3) conaecutive weekly iaauea of The Bnglewood Herald and Bnterprise, a
DMtapaper of general circulation published in said City, which advertisements
.. y run concurrently with the publication of this Ordinance.
Section 8. By reaaon of the fact that the completion at the earliest possible
date of the iJlprov .. ent• deacribed in this Ordinance is necessary to the immediate
preaervation of the public property, health, peace and safety, it is hereby declared
that an ... rgency exi•t• and that thi• Ordinance •hall take effect upon its final
paaaage.
Section 9. All ordinance•, or parts thereof in conflict herewith are hereby
repealed. 'l'hi• Ordiance, after it• final pasaage, shall be recorded in a book
kept for that purpoae, •hall be authenticated by the signatures of the Mayor and
City Clerk, ahall be publiahed in aaid City, and after becoming effective, shall
be irrepealable until the bond• of aaid Diatrict shall be paid in full.
Section 10. A public Bearing on the Ordinance will be held at the City Hall
in Bngl9WOOd, Colorado, on Monday, the 15th day of March, 1965, at the hour of
8100 o'clock P.M., and Rotice of auch Bearing i• hereby authorized to be given
by publication once in the Bnglewood Herald and Bnterpriae, in its issue of
llarch 4, 1965.
