or a junk yard licenae ahall make application therefor to the City Clerk
of the City of Sngl8WOOCI. Such application •hall be in writing and •hall

licenae or junk yard licen•• ha• been given, auch notice to be given by
one publication in the official newapaper of th• City at leaat fifteen
(15) day• before bearing on the application and by poating of the pro-
perty, •• deacribed in the application, for fifteen (15) conaecutive day•
prior to the hearin9 on the application. Such notice ahall atate the full
..._ of the applicant, hi• reaidence. th• location of the automobile
wrecking yard or junk yard for which application for licenae i• being
r'ldh and th• date on which the council •hall conaider auch application.
After th• aforeaaid notice ha• been given. th• City council of Bnglewood
•ball bold a bearin9 concerning th• iaauance of aucb license. Before
grantin9 any auch licenae, the council ahall conaid•r the deairea of the
i .. abitanta •• evidenced by petition, r..onatrancea or otherwiae. All
the expen••• of publication of th• notice ahall be paid by the applicant.
(1) 'fhe above ahall not apply to the licenaing of automobile
wreming yard• which are legally ••tabli•hed non-conforming
u••• under th• lion-conforming U•• proviaions of the Zoning
Ordinance of the City of Bnglewood.
(c) An annual lic•n•• ahall be iasued to the licenaeea hereunder
on payment of a f-of $100.00 for the calendar year. Such fee •hall
be payable in ..Svance at the be9innin9 of each calendar year. In the
event the operation •hall not previoualy have been licenaed. an application
therefor •hall be -d• after the firat day of the calendar year. In auch
event th• f.. •hall be pro-rated according to the percentage of the calen-
dar year r-inin9 at the time of the iaauanc• of auch licenae. The pro-
viaion for the expiration of the licen•• at the end of a calendar year
aball not apply in the event auch licenae •hall have been previoualy
revoked.
(d) Any licenae granted hereunder may be suspended immediately for
cauae by the City council of Bnglewood upon written notice to the licensee
and opportunity to be heard. Any violation of any provision of this Part
of the COde or of any applicable ordinance•, atatut•• and/or regulation~,
or any falaif ication of any atat ... nt in the application •hall be ground•
for revocation. llo portion of the licenae fee paid to aaid City ahall
be returned upon the revocation or auapenaion of any licenae.

It ahall be unlawful to comaence the excavation for, or the conatruc-
tion of. any buildin9 or other atructure, including acceaaory atructurea,
in or upon any autallobile wretdling yard or junk yard: or to •tore material•
or to canatruc:t entrance• or parking lot• or aurface any area. cownce
the roving, atructural alteration•, converaiona, extenaiona, enlarg .. enta,
alteration or repair of any atructure. including acceaaory structures,
in• 911ae aay aatmml>il• wrecking yard of junk yard until the Building
Inapector of the City ha• i••ued a Building Permit therefor.
lll.27-5 Application.
(a) An application for a Building Permit •hall be accompanied by
the aforeaaid licenH and by two (2) copi•• of a plan or plat drawn to
acale •bowing th• following in auf f icient detail to enaltle the Building
Inapector to ••certain whether th• propoaed excavation, conatruction,
rec:onatruction or converaion, moving or alteration is in conformance with
th• DrOYiaion• of thi• Part of th• COd•1
(1) The actual ahape, proportion. dimenaiona. public eaaement•
or rigbta-of-way. and topography of the •it• where auch
propoaed change• are to be made: ancl aatiafactory evidence
that actual corner• of the lot are ahown and are establiahed
on the ground by a certified aurvey mad• by a regiatered
land aurveyor or engineer, auch eatabliahed corner• to be
marked by pin• ••t in concrete.
(2) General aanitary and atorm drainage ay•t• which •hall be
aubject to approval by th• City Bngin .. r.

113.27-6 ,ln•pection of Automobile Wrecking Yard• and Junk Yard•.
t'h• Inmpector •hall make regular monthly in•pection• of all automobile
wrecking yard• and junk yard• within the City and •hall enforce compliance
with the provi•ion• of thi• Ordinance and any other Ordinance, law or •tatute
pertaining thereto.
(a) Authoritya t'h• In•pector •hall have the authority to make in-
mpection• of automobile wrecking yard• and junk yard• at rea.onable time•,
for th• purpo•• of deteraing whether thi• Ordinance i• being complied with
and allall have authority to iupect the purchaH regi•t•r a• required
herein.
(b) Acee••• It ahall be unlawful for any per.on to refu•e acceaa
to an automobile wrecking yard or junk yard to the Inspector for the pur-
poHa of ift8pection.
113.27-7 Location, Space and General Lanyt.
Any automobile wrecking yard or junk yard shall be located on a well
drained •it• and •hall be 80 located that it• drainage will not endanger
any water aupply. All auch uHa •hall be in areas frH from 8Wampa or
other potential breeding place• for inaect• or rodent•.
(a) Acee•• l!Oad•a
(1) Acee•• road• a• defined and required by thi• Part of the
Code ahall be kept open at all time• and frH from
obatruction aa fir• lanes. Such roads must be kept
graded and drained at all ti••·
(2) Such acce•• road• shall be provided a• are necessary
throughout every automobile wrecking yard or junk yard
to allow for adequate health and fire protection for
th• district in which auch u•• i• located1 such roads
•hall be subject to regulation• found in Sub••ction (3)
below, and ahall be approved by the Bngl.wood Pire
Department and the City Bngineer.
(3) 'nl• minimum width for two-way ace••• road• •hall be
twenty-five (25) fHtr for one-way ace••• roads, the
mini.awn width •hall be fifteen (15) feet. CUrv•• on

or to conflict with traffic light•.
113.27-9 sanitation and Pire Provision•.
(a) Water Supplya
(1) An acce••ible, adequate and •afe •upply of potable
water •hall be provided to every automobile wrecking
yard and junk yard.
(2) All water aupply faciliti••· i.e. pipe•, valves, outlet•,
•hall be open to in•pection by the Building In•pector
or any other duly authorised per.on.

(3) The development of an independent water aupply to aerve
any automobile wrecking yard or junk yard ahall be made
only after expr••• approval haa been granted by the
Department of Public Health of the State of Colorado.

tin9 aewer connection•. and all plumbing in any automobile wrecking yard
or junk yard aball COllPlY with th• plumbiftCJ law• and health regulation•

Department. and Stat• of Colorado.

on ita perimeter with a solid. non-tranaparent vertical wall or fence
vitb a ainiaua height of aix (6) f•t and a maximwn of twelve (12) fMt
••a•ared from ground level. Bvery gate for any auch yard •hall be of
aolid non-tranaparent conatruction of n.w or uaed material in reasonably
good condition. Bach auch gate •hall be th• aame height aa the wall or
fence or auch wall or fence •hall be extended above any auch gate to

the City Ordinance governing atorage of inflammable liquid• provided that
drainage thereof •hall not be required when th• vehicle in which the in-
f le ebl• liquid i• contained haa an operable motor.
113.27-11 Manag .. ent.
(a) Zn every automobile wrecking yard of junk yard, there shall be
a deaignated office building in which •hall be located the office of the
person in charge of aaid automobile wrecking yard or junk yard. A copy
of all required City and State lic•n••• and permit• and a copy of this
Part of the COde ahall be poated therein and a purch••• register shall
at all tille• be kept in aaid office.

113.27-12 Tille for CO!pliance.
All automobile wrecking yard• and junk yard• which at the effective da~reof conatitut• non-conforming u .. • •• defined and conatituted by th8~ity of B 19lMlfOOd zoning Ordinance, •hall within a reaaonabl• time
and in no event longer than aixty (60) day• fraa the effective date hereof,
comply with the atandarda and requirwnta herein contained except aa to
proviaiona of Section• 13.27-9 (a) and (b) and 13.27-10 (a), which •hall
be eo11plied with on or before one year from th• date thia Part of th•
COde beeo••• effective.
113.27-13 aoard of Ad1uatment and Appeala.
The Board ahall have juriadiction and power in paaaing upon appeal•
to grant variance• or modify in apecific ca••• th• atrict application of
the proviaiona of thia Part of th• COde provided th• following condition•
are -t•
(a) llo variation or modification of th• application of any proviaion
of thia Part of th• Code ahall be authorized except after Public Bearing
thereon, Public llotice of ti• and place and purpoae of auch hearing to
be 9iven by poating of th• property affected for not l••• than fift-n (15)
daya prior to auch Bearing, and notice by one publication in th• official
wapaper of th• City at leaat fift .. n (15) daya before th• hearing. Such
poating ahall conaiat of a aign not l••• than thr-(3) f-t by four (4)
f•t in aiae, located four (4) f-t above ground level in a conapicuoua
place, reading in letter• intelli9ibl• fro• th• adjoining atreet right-
of-way. the coat of auch Public llotice, aa determined by the City Clerk,

of application.
(b) !'here ahall be unneceaaary and aubatantial hardahip in applying
th• atrict letter of auch proviaiona, provided that no auch variation or
modification heretofore or aubaequently authorized or exiating ahall con-
atitute or be conatrued aa a percedent, ground or cau.. for any other
variation or modification by the Board, and that auch power to vary or
modify aball be atrictly conatrued •• apecifically enumerated within the
juraidiction of the Board.

th• variance i• aought i• due to unique circwutancea
exiating on the property not created by th• owner and not
due to general condition• in th• Diatrict in which the
property i• located.
(4) 'l'hat the variance, if authorised, will neither weaken the
general purpo.. of thi• Part of the Code nor the regulations
preacribed for th• Diatrict in which the porperty is
located.
(5) That th• variance, if authorized, will not aubatantially or
per11anently injure the appropriate uae of adjacent conform-
ing property.

113.27-14 l!y!rability.
Jf any aec:tion, aub-.. ction, ••ntence, clauae, phraae, or portion of
tbi• Part of the COde i• for any reaaon held invalid or unconatitutional
by any court of C011petent juriadiction, auch portion •hall be demned a
aeparate, diatinct and independent proviaion and auch holding •hall not
affect the validity of the r ... ining portion thereof. The City Council
hereby declare• that it would have pa••ed thi• Part of the Code and each
portion tbereof, hreapective of the fact that any one portion or portion•
be declared invalid or unconatitutional.
113.27-15 Pio•• and Penalti••·
Any per.on who •hall be convicted of a violation hereof •hall be
fined in a 81a of not l••• than $1.00 nor more than $300.00, or imprisoned
for a term not exceeding · 90 day•, for each of fen••. Where any violation
i• a continuing offen .. , each day that the violation continue• •hall be
conaidered and held to be a .. parat• and diatinct offen••·

parpo .. until auch judgment and coat• are fully •ati•fied: provided that
no auch illlpriao .. ent ahall exceed 90 day• for any one offenae.

of Snglewood, Colorado, to which reference i• hereby made • .
113.27-19 eonflict of Orc:linaocea; Bffect of Partial Invalidity.
Jn any caH where a proviaion of thi• Part of th• COd• i• found to
be in conflict with a proviaion of any soning,building, fire, aafety, or
bealtb ordinance or cod• of th• City of Bnglewood exiating on the effec-
t!,,. date hereof, th• proviaion which ••tabli•h•• th• higher atandard for
the promotion and protection of th• health and Afety of the people,
aball prevail. In any caH where a proviaion of any other ordinance or
eade of the City of Bnglewood exi•ting on th• effective date hereof ••-
tabli•h•• a lower atandard for the promotion and protection of the health
and Hf•ty and welfare of the people, th• proviaion• hereof ahall be
d•••4 to prevail, and auch other ordinance• or cod•• are hereby declared
to be repealed to the extent that they are found in conflict with this
Part of the COde.
