territorial liait• and other juriadiction of th• City, any general law of the
Stat• of COlorado, baa enacted thi• Ordinance to encourage th• moat appropriate u., of land throughout the City and to inaure a logical growth of the various
phuaical 11 ... nt• of the Cityt to deaignate, regulate and reatrict the location
and uat of building•, atructur•• and land for reaidence, commerce, trade,
indaatry or other purpo•••: to regulate and limit th• height, number of stories,
and aia• of building• and other atructurea hereafter erected or altered: to
••tabliah atandarda for private off-atreet parking: to regulate and determine
th• •i•• of yard• and other open apace• and to regulate and limit the density

the valur of property: to provide adequate open apace• for light and air, and to

122.1-3 Territorial Limit• j!f, Regulationa. All of the regulations, require-
ment•, liaitationa and proviaiona of thia Ordinance ahall extend and apply only
to land within the corporate limit• of the City of Bnglewood.

Ordinance that all land within th• boundariea of the City of Bnglewood shall
be located within one of th• aforeaaid Diatricta.

It i• th• further intent that no land within th• boundariea of the City of
Sngl9WOOCI ahall be without a zone Diatrict deaignation. If, for any reaaon, any
land within the boundari•• of th• City of Bnglwood ahall be determined not to be
within one of th• aforeaaid Diatrict, whether auch determination reaulta from
annexation, from judicial declaration, or from any other reaaon or cause, then,
and in that event, no permit• ahall be iaaued for th• erection or alteration of
any atructur• or atructurea in th• area found wanting in claaaif ication until
the area ha• been examined by the COnaiaaion and th• council and a zone classi-
fication enacted and eatabliahed therefor.

a. Jiii!. '1'be aforeaaid zone symbol• and the boundaries of such zone District•
are abown upon a Map attached hereto and mad• a part hereof, bein9 deaiqnated as
the •zoning Map•. &aid Map and all the notationa, reference• and other informa-
tion ahown thereon are •• much a part of thia Ordinance •• if the matters and in-
fonmation .. t .forth by aaid May were fully deacribed herein. For clarification to
and convenience of th• public, a copy of aaid May and amendment• thereto shall be
on diaplay in the council Chamber• and the Planning Off ice of the City of Englewood
at a acale of not l••• than two hundred (200) feet to one (1) inch.
b. IOundari•• J!! son• diatricta. In determining th• boundaries of zones
abown on the Map, the following rule• •hall apply1
(1) Unl••• otherwi•• indicated, the zone boundari•• are the centerlines
of atr .. ta, alleya, parkways, or channelized waterways ox such lines
extended. Where a Diatrict boundary line 1• anuwn as adjoining a
railroad right-of-way, aaid line •hall be deemed to coincide with
th• boundary line of auch railroad right-of-way.
(2) Where th• zone Diatrict boundari•• are not otherwise indicated and
where the property baa been or may hereafter be divided into blocks
l••• than two hundred fifty (250) feet wide, the boundaries are
median line• betw .. n their •idea, Boundari•• within blocks two hun-
dred fifty (250) feet or more wide are one hundred twenty-five (125)

(3) Where a Diatrict boundary line ia ahown •• approximately following

(4) In unaubdivided property, boundaries on the accompanying Map shall

being located at any given distance from a street right-of-way line,
auch apecific dimenaion •hall control.
(6) In the event a dedicated atr .. t or alley ahown on the Map i• vacated
by ordinance, the property formerly in aaid atreet or alley shall
be included within the zone of th• adjoining property on either •ide of
aaid vacated atr .. t or alley. In th• event said •treat or alley was
a zone boundary between two (2) or more different zones, the new zone
boundary ahall be th• former center line of aaid vacated street or alley.

in writing avved on any peraon, firm or corporation en9aged in doing or cau•ing such
"°rk to be done, or by poating auch notice in conapicuoua place on the property
apan vbich the "°rk ia being done with no auch per80n firm or corporation can be

122.2-2 Bpilding P!rait•.

for or th• conatructoft of any 1iilding or other atructure, including accessory

b. ARPlication .l2[ permit. Application for a Building Permit shall be made
to the Building Inapector on form• provided therefor.
c. Blqpirlllll!tt for permit•. Th• Building Inapector •hall require that every
application for a Building Permit be accompanied by two (2) copiea of a plan or
plat drawn to acale. Adequate information to demonatrate uae and structure charac-
teriatic• for ready determination of compliance with thi• Ordinance shall be in-
cluded in any application for a Building Permit, in addition to any of the require-
-nt• -t forth in th• Building Cod• of the City of Bngl9WOOC!.
d. I••uance Rf permit. If the propoaed excavation, contruction, moving or
alteration •• .. t forth in the application i• in conformity with the provisions of
thi• Ordinance and other ordinance• of the City, th• Building Inspector shall issue
a Building Permit.
•· Diaapproval .2f permit. If any application for a Building Permit is not
approved, the Building Inapector ahall preaent in writing to the applicant a written
atatellent detailing th• reaaona for auch diaapproval.
f. Ryll .ADSt void permit•. Any permit i••ued in conflict with the provisions ·
of thi• Ordinance ahall be null and void and may not be construed as waiving any
proviaion of thia Ordinance.
122.2-3 ~rtificate .2f Occupaney.
a. Ctrtif cate ~ _Q£cupancv ~ire. After the effective date of this Ordinance,
or any .....w.t.ent hereto, no change in the u .. of th• land, nor any change of use in
an mciatlng building, nor any uae of occupancy of new building ahall be made until
a Certificate of Occupancy haa been iaaued by the Building Inapector.
b. R!C:Ord kept J!x Building Inaeector. A record of all Certificates of
Occupancy ahall be kept on file in the office of th• Building Inspector and copies
•hall be furniahed on requeat to any peraon having a proprietary or tenancy interest
in land or building affected by auch Certificate of Occupancy.
c. nn-conforai:x VHa myat apply 12[ C!rtificatta. A Certificate of Occu-
pancy aha be requlr for all Ron-conforming U••• of land or buildings legally
mciating or created at ·th• time of paasage of thia Ordinance or any amendment
hereto. Application for auch Certificate of Occupancy for Ron-conforming Uses
•hall be filed with the Building Inapector by th• owner or leaaee or agent there-
of of th• land or building occupied by auch Ron-oenforming Pae within one (1) year
from tht tffectivt date of thi• Ordinance or amtndment hereto rendering the use
non-conforaing. It ahall be the duty of the Building Inapector to issue a Certi-
ficate of Occupancy for Ron-conforming Uaea, provided that aatiafactory evidence is
ahown by the owner or leaaee or agent thereof that the Mon-conforming Use has been
legally ••tabliahed in accordance with thia or prior zoning Ordinancea. Thia pro-
viaion aball not apply to peraona who have obtained a Ctrtif icate of Occupancy under
tht requirtmtnt• of a previou• Ordinance.
122.2-4 Rul•• .2f Procedure. Bach Board or CO-iaaion ahall adopt rules con-
cerning all procttding• before it. Such rult• •hall provide, among other thing• that:

To bear and decide appeal• from and to review any order or decision of
th• Building Inapector and to hear and decide all matters referred to
it, or upon which it it required to pa11 under thit Ordinance or any
amendment hereto. Appeal• to the Board may be made by any person
aCJC)rieved by interpretation• or decition• of the Building Inspector
in aoning requir-.itt or by any Adminittrativ• Officer, Department,
Board of Comni11ion of the City affected by any deciaion of the
Building Inapector.
(2) To review, upon it• own motion, any order or deciaion of the Building
Inspector.
(3) To reverH or affirm, wholly or partly, or ~o modify any order, re-
quir .. entt, deciaion or determination of the Building Inspector and to
make tuch order, requir ... nt, deciaion or determination aa in its
opinion ought to be made and, to that end ahall have all the powers
of the Inapector.

to grant variance• or modify in apecific ca••• the atrict application
of the proviaiona of thi• Ordinance provided the following condition•

(a) llo variation or modification of any proviaion of this Ordinance shall
be authorised except after Public Bearing thereon. Public Notice of
time and place and purpo-of auch Bearing shall be given by one pub-
lication in th• official newapaper of the City at leaat fifteem (15)
day• before auch Bearing, and by potting of the property affected for
not l••• than fift .. n (15) conaecutiv• day• prior to said Bearing.

(b) There thall be unneceaaary and •ub•tantial hardahip in applying the
atrict letter of auch proviaiona, provided that no such variation or
modification heretofore or aubaequently authorized or existing shall
conatitute or be conatrued a• a precedent, ground or cause for any
other variation or modification by the Board, and that such power to
vary or modify •hall be •trictly conatrued aa apecif ically enumerated
within the jurisdiction of the Board.
(c) In the .. tter of granting variance•, the Board •hall first find that
all of the following condition• are pretent:
(1) 'lhat the variance will do aubatantial juatice to all and not
to juat the particular applicant for the variance.
(2) 'lhat the plight of the owner of the property for which the
variance i• sought i• due to unique circumatancea existing on the
property, not created by the owner or owner• and not due to general
condition• in the Diatrict in which th• property ia located.
(3) 'lhat the development or UH of the property ia held strictly to
the zoning atandard• of the Diatrict in which it is located can-
not yield a reasonable return in Hrvice, uae or income compared
to adjacent conforming property in the aame Diatrict.
(4) !'hat the variance, if authorised, will neither weaken the general
purpoae of thit Ordinance nor th• regulation• prescribed for the
Diatrict in which the property i• located.
(5) '!'bat the variance. if authoria .. , will not alter the essential
character of the Diatrict in which the property is located.
(6) 'l'bat the variance, if authorized, will not aubatantially or per-
11&nently inquire th• appropriate u•• of adjacent conforming property.
d. lpyPrltltion• The Board i• authorized to interpret the provisions of this
C>Edinance, and when deemed nece11ary by the Board, aubmit report• to the City Plannin9
and Boning CD l••ion and the City Council auggeating amendment• to the Ordinance to
clarify the intent and purpo-of any article, aection, or paragraph on which it has
occaaion to rule. Th• Board may requeat information from the Planning and zoning
ca i11ion concerning any article, aection, or paragraph on which the Board baa
occaaion to rule.
•· Ag1fhority ~ require reasonable atipulati~. The Board ahall have the
authority to require any reaaonable stipulation which might be necessary to pro-
perly protect the general welfare when granting a variance.

and atrictly conatrutd ao that thia Ordinance and Map ahall ~ atrictly enforced.

any dtcia OIFo tht Board, or any r11ident, taxpayer, or any officer, department, Board
or can iaaion of tht municipality may appeal auch dtciaion by appropriate legal action
to a Court of Record having juriadiction thereof.

on the propoatd change.
122.3-2 Initiation 2f chaDft• A propoaed change of sont may bt aubmitted by the
City CDancil, tht CO-iaaion, or tht Board without ftt, or by an application with proper
f-by one or .ort of tht own1r1 of property within tht area propoaed to be changed.
Any pzopoaed wndwlt or change, initiated othtrwilf than by tht City Planning and
Boning COmmiaaion, ahall bt aublaitted to 11id CO..iaaion for it• examination and recom-
•andation btfort conaideration by tht City council.

coaaeation created on neighborhood streets by the high-density residential areas.

The atructurea within this District are customarily designed
and constructed aa a complex of connected or related commercial
buildings, planned and developed as a unit. The regulations for
tbia Diatrict ar-. intended to permit development of the enumerated
functiona, limited by atandarda designed to protect the abutting
and surrounding reaidential diatricta. To theae enda, the regu-
lation• eatabli•h atandarda caaparable to thoae for low density
1'9aidential diatricta, and provide forthe compatibility of the
8-3 Buaineaa Diatrict with the aurrounding and abutting reaidential

an obnoxious or dangerous degree of heat, glare,
radiation or fumes beyond any boundary line of the
Shopping Center on vhicti the use is located.
(5) No highly fla!Wlable or explosive liquids, solids or
gaaea shall be stored in bulk above ground. Tanks
or drUID8 of fuel directly ~onnected with heating
devices or appliances are excluded from this pro-
vision. All outdoor storage facilities for fuel,
raw material•. and product• ahall be enclosed bi a
fence or wall adequate to conceal such facilities
from adjacent property. No materials or wastes
shall be deposited .upon the S~opping Center in such
form or manner that they may be transferred off the
premiaea by natural cauaea. All materials or wastes
shall be stored outdoor• in fireproof, rodent-proof
and waterproof cloaed containers.
i. Limitation• on oeei apacea. All areas of the Shopping
Center not covered or0ccup ed by permitted enclosures may only
be uaed for vehicular parking and mane~vering, pedestrian walkways,
aeatiiw facilities, landscaping (including ornamental pools aid
fountaina), directional aigna, control devices and the Shopping
Center free-standing aign. No open area in any B-3 Diatrict,
re1ardleaa of aize, shall be uaed and occupied by the property
owner ar anyone claiming under aaid property owner (except during
conatruction under an appropriate Building Permit) unless and
until a Certificate or Occupancy for the use of an open area or
areaa baa been obtained from the Building Inapector to indicate
that compliance with the atandarda and requirements of this Section
baa been accompliabed. ,
(1) Parking areaa. In any Sb~ppiPI Center, regardless
of aiael lot• f crthe parking of the private, non-
comaerc al motor vehicles of cuatomera or employees
and uae by comnercial delivery vehicles shall be
subject to the following proviaionaa
(a) The lot aball be smoothly graded, adequately
drained, and bard aurfaced with asphalt or
concrete paving. Such pavement aball be kept
in good repair and ahall be kept free from the
accumulation of refuae, debris, or litter.
(b) The lot aball be marked so as to designate
the parking of vehicles thereon. All parking

(d) No advertising sign is to be located on the
lot, other than signa stating that it is a
parking lot of the Center and giving parking
or traffic inatructiona in letters m more
than six (6) inches high.
(e) By meana of a barrier or barriers, all parking
shall be kept back of the screening strips in
the Shopping Center in which the parking lot
is established.
(f) The entrances to and exita from and onto the
streets of the City shall be designed and mn-
atructed to achieve maximUD traffic safety.
They shall be planned to achieve minimum
inter~erence with on-street traffic, particular-
ly calculated by the reatriction and control
aystem of the site plan to direct, to the moat
practicable extent, flow of vehicular traffic
to and from the nearest maJor streets.
(g) The lot mall not be used after me-balf (l/2)
hour after sunset unless the lot shall be
properly and adequately lighted. Any lighting
provided within thirty-five (35) feet of any
residential street or any residentially zoned
property abutting upon, adjoining or adjacent
to the B-3 District ahall be maintained on
standards not exceeding ten (10) feet in height;
any other lighting standards shall not exceed
seventeen (17) feet in height. The direct rays
of any lighting shall be confined within the
boundary lines of the Center.
(2) Truck loading and maneuvering facilities. All
truck loading and unloading facilities shall be
deaifned ao as to avoid, to the greatest estent
poaa ble, conflict with private automobile parking
and -neuvering. All on-site truck loading, un-
loading, and maneuvering facilities shall be
adequately deaigned so aa to direct and require
truck movement to be to and from the nearest
major street.
j. Screening strips. All Shopping Centers shall be surrounded
with a screening atrlp. The purpose of such screening is to protect
the general welfare of the residents of the abutting and adjacent
residential property, and to preven~ litter from blowing into
street• and nearby areas. Screening shall consist of · landscaping
and atructurea such aa fences and walls, subject to variation in

(2) In Shoppiftg Center• having a total land area of
twenty (20) acres or mere, any exterior boundary
line which abuts, adjoins or is adjacent to resi-
dentially scned property, or is separated from same

the one exception to all above requirements shall
be when there is provided a closed-face fence or
maaonry wall at least ten (10) feet high and set
back twenty (20) feet from the property line. In
thia caae, the area between the fence or wall and
the property line muat be landscaped with a twenty
(20) foot planting strip. At exterior boundaries
not inclLded in the above instance, there shall be
a landscape screening of a ten (10) foot planting
atrip plus a chain-link or closed-face fence not
leaatban four (4) feet in height, and set back
ten (10) feet from the exterior boundary line of
the Shopping Center.
In Shopping Center• having a total land area of
leas than twenty (20) acres, any exterior boundary
line which abuts, adjoins or is adjacent to resi-
dentially zoned property or is separated from same
by a reaidential street or alley shall be provided
with a landscaped twenty (20) foot planting strip
plus a chain-link or closed-face fence at least
four '4) feet high set back twenty (20) feet from
the et:terior boundary line of the center. At
exterior boundaries not included in the above
instance, there shall be a landscaped ten (10)
foot planting strip plua a chain-link or closed-
face fence not leas than four (4) feet in height
and aet back ten (10) feet from the exterior
boundary line of the Shopping Center.
No fence, wall, or other structure is required or
shall be erected, and no hedge, shrub, tree~.or
other growth shall be maintalned in such location
upon any lot or property in a manner constituting
a Pi!de•trian or vehicular traffic hazard because of
obatruction to view or traffic movement.
All plantings ref erred to in this Section shall be
maintained in a healthy, grow:lnf condition, and alll
atructures •hall be maintained n good repair and
sightly condition.
All Shopping Center exist which enter reaidential
streets and are not .opposite any street shall be
provided with opaque screening strip baffles and
•hall be subject to subsection (5) above.

(3) Financial report. An auditors statement of financial
responsibility of the applicant •hal l be submitted
by said applicant.
(4) Poating of bonds. The applicant •hall post bonds
in an amount approved by City council, to insure
the inatallation of improvements required by this
section as a condition to development in the B-3
District.
