HomeMy WebLinkAbout1961 Ordinance No. 005Introduced as a Bill by Councilman Braun BY AUTHORITY ORDINANCE NO. 5, SERIES OF 1961 AN ORDINANCE AMENDING ORDINANCE NO. 45, SERIES OF 1955, AS AMENDED, OF THE ORDINANCES OF THE CITY OF ENGLEWOOD, COLORADO, KNOWN AS THE "ZONING ORDINANCE OF THE CITY OF ENGLEWOOD," BY ADDING THERETO A NEW SECTION 14 OF ARTICLE IV, ENTITLED "SECTION 14 --M-3 INDUSTRIAL DISTRICT," PROVIDING FOR THE MAINTENANCE AND USE OF AUTO DISIOJJTLING YARDS, AUTO WRECKING YARDS, AUTO STORAGE YARDS AND COMMERCIAL INCINERATORS : AND AMENDING VARIOUS OTHER SECTIONS OF SAID ZONING ORDINANCE TO CONFORM THEREWITH. WHEREAS, pursuant to ordinance, the City Planning and Zoning Commission of the City of Englewood, Colorado, has duly held public bearing on certain proposed amendments to Ordinance No. 45, Series of 1955, as Amended, of the ordinances of the City of Englewood, Colorado, known as the "Zoning Ordinance of the City of Englewood," aad bas made recommendation of the adoption of an ordinance embodying said amendments : and, WHEREAS, public notice has been given of such proposed changes in the Zoning Ordinance by one publication in the Englewood Herald and Enterprise, a newspaper of general circulation within the City and the official news- paper of the City, at least fifteen (15) days before the public hearing on such changes in the Zoning Ordiance, as required by ordinance ; and, WHEREAS, public hearing was held pursuant to the aforesaid notice by the City Council of the City of Englewood in the Council Chambers of the City Hall, 3345 South Bannock Street, Englewood, Colorado, on the 6th day of February, A.D. 1961, at the hour of 8:00 P.M., at which hearing no persons appeared to protest or oppose the proposed chan1es in the Zoning Ordinance; and, WHEREAS, the public necessity, convenience, general welfare and good zoning practices justify the proposed amendments to the Zoning Ordinance as hereinafter set forth: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: iection 1. The existing wording of Subsection l (e) (2) of Section 13 of Article IV of Ordinance No. 45, Series of 1955, as Amended, known as the "Zoning Ordinance of the City of Englewood," is hereby deleted. Section 2. Section 14 of Article IV of Ordinance No. 45, Series of 1955, as Amended, known as the "Zoning Ordinance of the City of Englewood," is hereby redesignated as Section 15 of Article IV of said ordinance. Section 3. Section 15 of Article IV of Ordinance No. 45, Series of 1955, as Amended, known as the "Zoning Ordinance of the City of Englewood," is hereby redesignated as Section 16 of Article IV of said ordinance. Section 4. Subsection l (a) of Section 2 of Article V of Ordinance No. 45, Serles of 1955, as Amended, known as the "Zoning Ordinance of the City of Englewood," is hereby amended by deleting the following existing wording thereof: "Subsection l (e) (2) of Section 13 of Article IV of this Ordinance." Section 5. Subsection l (a) of Section 2 of Article V of Ordinance No. 45, Serles of 1955, as Amended, known as the "Zoning Ordinance of the City of Englewood," is hereby amended by adding thereto the following wording: "Subsection 2 of Section 14 of Article IV of this Ordinance." Section 6. Subsection 1 (b) of Section 13 of Article IV of Ordinance No. 45, Series of 1955, as Amended, known as the "Zoning Ordinance of the City of Englewood," is hereby amended by adding thereto the following wording: "(Except those uses specifically allowed in the M-3 zone)." Section 7. Subsection l (b) of Section 12 of Article IV of Ordinance No. 45, Serles of 1955, as Amended, known as the "Zoning Ordinance of the City of Englewood," is hereby amended by adding thereto the following wording: "(Except those uses specifically allowed in the M-3 zone)." Section 8. Article IV of Ordinance No. 45, Series of 1955, as Amended, known as the "Zoning Ordinance of the City of Englewood," is hereby amended by inserting therein a new Section 14, which shall read as follows: "Section 14 --M-3 --Industrial District. The followi ng regulations shall apply in the M-3 Industrial District: "l. Unless otherwise provided in this Ordinance, no building, structure or land shall be used, altered (structurally), enlarged or maintained except for one or more of the following uses: 345 (1) Auto dismantling yards (2) Auto wrecking yards (3) Auto storage yards (4) Commercial incinerators "2. In addition to the supplemental regulations established in the M-2 zone, the following shall apply to auto dismantling, auto wrecking and auto storage yards: "(a) The premises or yard where such operations are con- ducted shall be enclosed on its perimeter with a solid, non-transparent, vertical wall or fence with a minimum height of six feet, measured from ground level. Two vehicle gates and one normal pedestrian gate or door shall be allowed, providing they also are of solid, non-transparent construction. "(b) The vehicle gates shall not exceed twenty feet in width at the perimeter of the premises. "(c) The aforesaid solid, non-transparent wall or fence and the gates or doors, if any, shall not cont"ain --any advertising sign or poster other than that needed to identify the enclosed business. "(d) The said operations shall not encroach upon or use any area outside of aforesaid fence. "(e) The storage of such junk or autos shall be stored in a sanitary condition and stacking (placing of one auto body on top of another) of autos shall be pro- hibited. "(f) Every dealer shall keep at bis said place of business a substantial and well-bound book in which he must enter inwriting the names and residences of persons from whdllhe shall purchase or receive items. This book, only at reasonable times, shall be open to inspection by authorized representatives of the City of Englewood." Passed on First Reading by the City Council of the City of Englewood, Colorado, this 6th day of February, A.D. 1961, and ordered published in full in the Englewood Herald and Enterprise. .
