AN ORD I NA NCE CREAT ING AN IMPROVE>1ENT DISTRICT IN THE CITY OF ENGLEWOOD, COLO-
RADO, TO BE KNO WN AS PA VING DISTRICT NO. 1 1; ORDERING THE CONSTRUCTION THEREIN OF
STREET IM PR OVF>\EN TS; PRO VIDING FOR THE ISSUANCE OF BONDS OF THE DISTRICT IN PAYMENT
FOR SAID I MP ROVF.MENTS; PROVIDING FOR NOTICE TO CONTRACTORS AND TO BIDDERS FOR SPECIAL
IMPROVl'>IENT DISTRICT BONDS OF SAID CITY: AND DECLARING AN F>tERGENCY.
WHEREAS, the City Co unc i l of Eng l ewood, Colorado, pursuant to the Charter
nd Ordinance No. 8, Serie s 1959 , as amended, of said City and the laws of the State
of Colorado, h e reby finds and determines that there exists a necessity for the
creation of Paving Distric t No. 1 1 , in said City, and the construction therein of
certain street improvement s, as described herein; and
WHEREAS, the City Coun c il has heretofore directed the Ctty Engineer to pre-
pare plans, specifications , map s and schedu l es in accordance with said laws; and
WHEREAS, the City Engineer ha s made his report in the premises, and has
filed with the Clerk of said City all t h e maps and certificates of his survey, as
11 as schedules, plans, spe c ifications, approximations of cost, and all other
tters and things in comp l ete form and sub s tance as by law required; and
WHEREAS, the s a i d report so made and filed, together with details, specifi-
cations, estimates, maps a n d schedules, are hereby approved and adopted by said City
Council; and
WHEREAS, the City Cou n cil direc t ed the City Clerk to publish1 in the
Englewood Herald and Enterpri se, a newspaper of general circulation in s aid City,
Notice of a proposition to c rea t e said District, and that on March 27, 1 961, at
8:00 o'clock P.M., all compl a i n t s and ob j e ct ions that might be made in writing con-
cerning the proposed improvements by the owner or owners of any real estate to be
assessed, or any person or persons interested generally, would be heard and determined
by the City Council of s a id City of Eng l ewood, before final action of said Council
thereon, and that after the dete rmina t i on of all complaints and objections was made,
said City Council would ta ke up and con side r an ordinance creating said District and
ordering the proposed improvemen t s; and
WHEREAS, the City Cl erk, by adverti sement for a period of more than fifteen
(15) days prior to the said 27th day o f March, 1961 , gave notice in form and substance
of the matters and things above -men t ioned a s ordered to be given, in all respects in
accordance with law and s aid order; and
WHEREAS, the City Clerk has mailed to each known owner of real property to
be assessed with the cost of said improvements, a Notice of Intention to create said
District, as provided by t h e Reso l u t ion adopted by the City Council of March 6, 1961;
and
WHEREAS, at the t i me and place s pecified in said Notice, the City Council
met in open session for the purpose of hearing any objections or protests that might
be made against said improvements; and
WHEREAS, certain wr it ten obje ctions were filed and certain oral i nquiries
and objections were made a t s a i d meeting ; and
WHEREAS , all ob j e ct ions were du l y considered and were by the Council over-
ruled and denied; and
WHEREAS, the City Counc il hereby finds and determines that a general public
benefit will accrue to t he City from the proposed improvements;
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD,
COLORADO I THAT:
Section 1. Said Paving District No. 11 is hereby created and said improve-
ments hereinafter describ e d , c onsisting of street improvements, were duly ordered after
Notice duly given and he ari ng duly he l d, all as required by law.
Section 2. Said i mprovements shall consist of:
Necessary gra d i ng and excavation, paving with six-inch compacted
gra vel base course, with two-inc h asphaltic concrete surface, and con-
crete walks, curbs and gutters, where not already installed; together
with appurte nanc es and incidentals on the following str.eets and avenues:

Section 3 . Said Dis t rict shall be known as and the same is hereby designated
"Paving District No. 11", Englewood, Colorado.
Se ction 4. The c onstruction of the street improvements in and for said
District, a s shown by the plans, specifications ,and maps thereof, prepared by the City
Engineer and a pproved by t he City Counci l of said Ci ty, and now on file in the office of
the Clerk of said City, be a nd t h e same i s hereby authorized and ordered, the material
to be used in the construct ion o f sa i d s t reet impro vements to be in accordance with such
maps, plans and specificati on s.
Section 5. By vi r tue o f and i n p u rsuance of the aforesaid laws and the Charter
and Ordinance No . 8, Series 1959 , as amen d ed, of sa i d City, local improvement bonds of
the City shall be issued fo r the purpose o f paying for the local improvements in this
Ordinance d e scribed and pro v i ded t o be c onstructed i n said Paving District, in an amount
not to exceed the cost of s a id imp r oveme nts , includ i ng engineering and all incidental
expenses, as in said laws, Ch a rter a n d Ordinance provided.
Section 6. Said bond s s ha l l b e authorized by an Ordinance later to be passed
in accordance with the laws o f the State of Colorado, the Charter and said Ordinance
No. 8, Series 1959, as ame nded, of s Lid Ci ty.
Section 7. The Ma y or a nd City Cl erk are hereby authorized to advertise for
bids to construct such imp rovemen t s and f or bids for bonds to be issued, in three (3)
consecutive weekly issues o f t h ~ Englewood Herald and Enterprise, a newspaper of general
circulation p ublished in s a i d City, whi ch ad vertisements may run concurrently with the
publication of this Ordinanc e.
Section 8. By rea s on of the fa ct that the completion at the earliest possible
date of the improvements described in this Ordinance is necessary to the immediate
preservation of the public propert y, hea l th, peace and safety, it is hereby declared
that an emergency exists and t hat this Ord i nance shall take effect upon its final
passage.
Section 9 . All o rd i nanc es, or parts thereof in conflict herewith are hereby
repealed. This Ordinance , after its fina l passage, shall be recorded in a book kept
for that purpose, shall b e au t henticated by the signatures of the Mayor and City
Clerk, shall b e published in said City, and after becoming effective, shall be
1rrepealable until the bonds of said Distri ct shall be paid in full.
