ORDINANCE NO. 20, SERIES OF 1961
AN ORDINANCE AUTHORIZING THE MUNICIPAL JUDGE OF THE CITY OF ENGLEWOOD,
COLORADO, TO ESTABLISH A VIOLATIONS BUREAU FOR MISCELEANEOUS MINOR OFFENSES
AGAINST THE ORDINANCE OF SAID CITY; TO DESIGNATE THE ORDINANCES AND SECTIONS
OF ORDINANCES FOR VIOLATIONS OF WHICH PAYMENT OF FINBS MAY BE ACCEPTED BY
SAID VIOLATIONS BUREAU; TO ESTABLISH SCHEDULES OF FINES FOR SUCH VIOLATIONS;
TO Rr>IIT OR SUSPEND FINBS; AND PROVIDING FOR THE DUTIES THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO:
Section 1. CREATION OF VIOLATIONS BUREAU
(a) The Municipal Judge may establish a violations bureau to assist
the court with the clerical work of ordinance violations. The bureau shall
be in charge of such person or persons and shall be open on such days and
during such hours as the Municipal Judge may designate. Said bureau shall
be operated in conjunction with the Traffic Violations Bureau established
pursuant to Ordinance No. 39, Series of 1957, as amended, of the ordinances
of the City of Englewood, Colorado.
(b) The Municipal Judge, or judges, who hear ordinance violation cases
shall designate the ordinances and sections of ordinances of this municipality
for violation of which payment of fines may be accepted by the bureau, and
shall specify, by suitable schedules, the amount of such fines for first,
second or subsequent offenses, provided such fines are within the limits
provided by law, and shall further specify what number of such offenses shall
require an appearance before the Municipal Judge.
(c) The Municipal Judge, or judges, are hereby authorized to suspend
the payment of any costs, or fine, or penalty assessed for any violation of
any provision of an ordinance or section of an ordinance which has been desig-
nated as one for v i olation of which the violations bureau may accept a fine.
Section 2. WHEN PERSONS CHARGED MAY ELECT TO APPEAR AT BUREAU OR BEFORE
JUDGE
(a) Any person charged with an offense for which payment may be made to
the violations bureau shall have the option of:
(1) Paying such fine within the time specified in
the citation or notice of arrest at the violations
bureau, upon entering a plea of guilty and upon
waiving an appearance in court; or,
(2) Depositing any required lawful bail, and upon
a plea of not guilty shall be entitled to
trial as authorized by law.
(b) The payment of a fine to said bureau shall be deemed an acknowledgment
of violation of the designated ordinance, and the bureau, upon accepting the
prescribed fine, shall issue a receipt to the violator acknowledging payment
thereof.
Section 3. DUTIES OF VIOLATIONS BUREAU. The follwing duties are hereby
imposed upon the violations bureau in reference to offenses for violations of
which the violations bureau is authorized to accept fines:
(a) It shall accept fines, issue receipts, and represent in court such
v iolators as are permitted and desire to plead guilty, waive court appearance,
and give power of attorney.
(b) It shall receive and issue receipts for bail from the person who
must, or wishes to be heard in court; enter the time of their appearance on
the court docket; and notify the arresting officer and witnesses, if any, to
be present.
(c) It shall keep an easily accessible record of all violations of which
each person has been guilty within the preceding twelve (12) months, whether
such guilt was establ i shed in court or in the v'olations bureau.
Section 4. VIOLATIONS BUREAU TO KEEP RECORDS. The violations bureau
shall keep records and submit summarized monthly reports to the City Council
of all notices and citations issued and arrests made for violations of the
ordinances of this municipality, and of all the fines collected by the vio-
lations bureau, and of the final disposition or present status of every case
of violation of the provisions of said ordinance. Such records shall be so
maintained as to show all types of violations and the totals of each. Said
records shall be public records.

Section 5. ADDITIONAL DUTIES OF THE VIOLATIONS BUREAU. The violations
bureau shall follow such procedures as may be prescribed by the ordinances of
this municipality, or as may be required by any laws of the State of Colorado.
