HomeMy WebLinkAbout1961 Ordinance No. 021• Introduced as a Bill by Councilman Brownewell BY AUTHORITY ORDINANCE NO. 21, SERIES OF 1961 AN ORDINANCE APPROVING THE ANNEXATION OF THE PROPERTY HEREINAFTER DESCRIBED TO THE CITY OF ENGLEWOOD, COLORADO, AND ANNEXING SAID DESCRIBED PROPERTY TO THE CITY OF ENGLEWOOD, COLORADO, AND ZONING SAID PARCEL OR PARCELS AS C-3 (BUSINESS DIS- TRICT), PURSUANT TO THE PROVISIONS OF ORDINANCE NO. 45, SERIES OF 1955, AS AMENDED, OF THE ORDINANCES OF THE CITY OF ENGLEWOOD, COLORADO, KNOWN AS THE "ZONING ORDINANCE OF THE CITY OF ENGLEWOOD," TO-WIT: A TRACT OF LAND LYING IN SECTION 35, TOWNSHIP 4 SOUTH, RANGE 68 WEST, IN ARAPAHOE COUNTY, DESCRIBED AS FOLLOWS: BEGINNING AT A POINT WHERE THE EAST LINE OF BLOCK 50, EVANSTON BROADWAY ADDITION, EXTENDED SOUTHERLY INTERSECTS THE SOUTH LINE OF SECTION 35, TOWNSHIP 4 SOUTH, RANGE 68 WEST, SAID SOUTH LINE BEING THE APPROXIMATE CENTER LINE OF EAST HAMPDEN AVENUE; THENCE NORTHERLY ALONG THE EAST LINE OF SAID BLOCK 50, TO THE NORTH LINE OF SAID BLOCK 50; THENCE EASTERLY TO THE EAST LINE OF SOUTH LAFAYETTE STREET; THENCE NORTHERLY ALONG SAID EAST LINE OF SOUTH LAFAYETTE STREET TO THE CENTER LINE OF EAST FLOYD AVENUE; THENCE EASTERLY ALONG SAID CENTER LINE OF EAST FLOYD AVENUE TO THE EAST LINE OF THE swt, SEctrION 35, TOWNSHIP 4 .SOUTH, RANGE 68 WEST; THENCE SOUTHERLY ALONG SAID LINE TO THE NORTHEAST CORNER OF THE SEt swt OF SECTION 35, TOWNSHIP 4 SOUTH, RANGE 68 WEST; THENCE EASTERLY ALONG THE NORTH LINE OF THE swt SEt, SECTION 35, TOWNSHIP 4 SOUTH, RANGE 68 WEST, TO THE NORTHEAST CORNER OF THE swt SEt, SECTION 35, TOWN- SHIP 4 SOUTH, RANGE 68 WEST; THENCE SOUTHERLY ALONG THE EAST LINE OF THE swt SEt, SECTION 35, TOWNSHIP 4 SOUTH, RANGE 68 WEST, TO A POINT WHERE SAID LINE INTERSECTS THE NORTH RIGHT-OF-WAY OF S.H. That written p statute with the City Council ot th annexation to said City of Engle• 1n the County of Arapahoe, Stat t1t1on waa properly filed in accordance with City or Englewood, Colorado, proposing the Of the hereinafter described land, Situtate olorado, to-wit: A tract of land lying 1n Section 35, Township 4 South, Range 68 West, in Arapahoe County, described ~s follows: Beginning at a point where the East line of Block 50, Evanston Broadway Addition, extended Southerly intersects the South line of Section 35, Township 4 South, Range 68 West, said South line being the approximate center line of East Hampden Avenue; thence Northerly along the East line of said Block 50, to the North line of said Block 50; thence :Easterly to the East line of South Lafayette Street; thence Northerly along said East line of South Lafayette Street to the center line of East Floyd Avenue; thence Easterly along said center line of East Floyd Avenue to the East line of the swt,.Section 35, Township 4 South, Range 68 West; thence Southerly along said line to the Northeast corner of the SEt swt of Section 35, Township 4 Southi Range 68 West; thence Easterly along the North line of the SW4 SEt, Section 35, Township 4 South, Range 68 West, to the Northeast corner of the swt SEt, Section 35, Township 4 South, Range 68 West; thence Southerly along the East line of the SWt SEt, Section 35, Township 4 South, Range 68 West, to a point where said line intersects the North right-of-way of S.H. No. 70 (.East Hampden Avenue), said point being approximately 90 feet Northerly of the Southeast corner of the swt SEt, Section 35, Township 4 South, Range 68 West; thence Westerly along said North right-of- way line to a point where said line intersects the East line of the swt, Section 35, Township 4 South, Range 68 West, said point being approximately 90 feet North of the South Quarter corner of said section; thence Southwesterly along said right-of-way line of East Hampden Avenue on the arc of a curve to the left, the radius of which equals 783 feet, for a distance of 301.4 feet; thence Westerly along the North right-of-way line of East Hampden Avenue parallel to and 30 feet North of the South line of Section 35, Township 4 South, Range 68 West, to a point where the North right-of-way line of East Hampden Avenue intersects the East line of South Lafayette Street; thence Southerly to a point where the East line of South,Lafayette Street intersects the South line of Section 35, Township 4 South, Range 68 West; thence Westerly along said South line of said section to the point of beginning, containing approximately 57.202 ·acres. ·I I II . Th a t said petition was signed by the owners of more than fifty percent (56,i) of the area of such territory, who also comprised a majority of the landowners residing in the said territory at the time the petition was filed. Section 3. Th a t said petition was in all respects in conformity with the provisions of Article 11 , Chapter 139, Colorado .Revised Statutes, 1953, as amended; that said petition was f avorably considered by the City Council of the said City of Englewood, constituting t he legislative body of the municipality to which said territory is proposed to be annexed; that notice of the substance of the petition, the date of signing, the number of persons signing, a description of the territory included in the proposed annexation, and a statement that landowners of the area may express their opposition to t he annexation and secure an election by complying with the provisions of Section 1 3 9 -1 1 -4, Colorado Revised Statutes, 1953, was published pursuant to statute. Section 4. That s aid hereinabove described parcel or parcels of property be, and they hereby are, d e clared annexed to the City of Englewood, Colorado, and are hereby made a part of the s aid City, pursuant to the provisions of Article 11, Chapter 139, Colorado Rev ised Statutes, 1953, as amended. Section 5. That s aid hereinabove described parcel or parcels be, and they hereby are declared to be z oned as C-3 (Business District), pursuant to the provisions of Ordinance No . 45, Series of 1 955, as amended, of the ordinances of the Citr. of Englewood, Colorado, known as t he "Zoning Ordinance of the City of Englewood.'
