HomeMy WebLinkAbout1959 Ordinance No. 001BY AUTHORITY ORDINANCE NO. l SERIES OF 1959 AN ORDINANCE AMENDING ORDINANCE NO. 33, SERIES OF 1957, ENTITLED THE "MISCELLANEOUS OFFENSES ORDINANCE" OF THE CITY OF ENGLEWOOD, COLORADO, BY RENUlilBERING ARTICLE 17 THEREOF AS ARTICLE 18 AND ADDING THERETO A NEW ARTICLE 17 DEFINING CERTAIN NUISANCES WITHIN THE CITY OF ENGLEWOOD, COLORADO, AND PROVIDING FOR THE ABATEMENT, REMOVAL OR SUPPRESSION OF THE SAME AND MAKING THE SAME SUBJECT TO ALL aI'HER PENALTIES AND REMEDIES OF SAID ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: Section 1. Article 17 of Ordinance No. 33, Series of 1957, en- titled l.he "Miscellaneous Offenses Ordinance" of the City of Englewood, Colorado, is hereby renumbered as Article 18 of said ordinance, and the number 11 17 .1 (a)" in the last line of Section 17.l (b) is hereby amended to read "18.l (a)." Section 2. Ordinance No. 33, Series of 1957, entitled the "Miscel- laneous Offenses Ordinance" of the City of Englewood, Colorado, is hereby amended by adding thereto a new Article 17, entitled "Article 17. Nuisances," hich shall read as follows: "Article 17. Nuisances. 11 17.l The keeping of animals or fowl of any kind within the City of Englewood which shall be or become obnoxious by reason of odor, uncleanliness, disease, or emitting loud and unusual noises sufficient to disturb the peace and quiet of any neighborhood or family shall be and here- by is declared to be a nuisance. "17.2 Any abandoned, or unusued ice box or other compart- ment capable of being air tight when the doors thereto are closed is hereby declared to be a nuisance when ex- posed to access of children or the general public. 11 17.3 Any person who shall dump, throw or place upon the streets, alleys or other public places, any garbage, waste, debris, or any object or substance which is, or tends to become noisome, foul, offensive, or putrid shall be guilty of creating a public nuisance. !'17.4 It shall be the duty of the Chief of Police and such other officers as he may direct, from time to time, to ascertain and cause all nuisnaces herein declared to be abated. Each and all of said officers shall, under the supervision of the Chief of Police, have authority in the daytime to enter any storehouse, stable or any building, in order to make a thorough examination of the cellar, vaults, sinks, or drains; to enter upon all lots or grounds; and to cause all stagnant waters to be drained off, and pools, sinks, vaults, drains, holes, or low ground to be cleaned, filled up or otherwise purified; and so cause all noisome substances or un- healthy conditions to be abated or removed as provided by this ordinance, or other ordinance of this City. "17.5 In all cases where a nuisance shall be found in any building, or upon any ground or other premises, within the City of Englewood, twenty-four (24) hours notice may be given in writing, signed by the Chief of Police or such other officer as he may designate, to the owner or occupant or person in possession, charge or control of such building or other premises where he is known and can be found, to remove such nuisance. In case of the neglect or refusal of such person to abate the same in accordance with such notice, he shall be chargeable with the expenses which may be incurred in the removal thereof, to be collected by suit or otherwise, in addition to penalty for violation hereof. "17.6 In all cases where no provision is herein made defining what are nuisances and how the same may be removed, abated, or prevented, in addition to what may be declared such herein, those offenses which are known to the Common Law of the land and the Statutes of Colorado as nuisances may, in case the same exist 1.61 within the city limits of the City of Englewood or within one mile thereof, be treated as such and pro- deeded against as in this ordinance provided, or in accordance with any other provision of law." "17.7 Any act declared in this ordinance to be a nuisance shall be subject to all of the other pen- al ties and remedies of Ordinance No. 33, Series of 1957, as amended." Passed on First Reading by the City Council of the City of Englewood, Colorado, this 5th day of January, A.D. 1959, and ordered published in full in the Englewood Herald and Enterprise. Passed on Final Reading by the City Council of the City of Englewood, Colorado, this 19th day of January, A.D. 1959, and ordered published in full in the Englewood Herald and Enterprise.
