HomeMy WebLinkAbout1959 Ordinance No. 027BY AUTHORITY ORDINANCE NO. 27 , SERIES OF 1959 AN ORDINANCE PROVIDING FOR THE FIXING B¥ THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, BY RESOLUTION, OF RATES AND CHARGES FOR THE TREATMENT AND DISPOSAL OF SANITARY SEWAGE AT THE ENGLEWOOD SEWAGE TREATMENT PLANT; PROVIDING FOR PE ,NALTIES FOR FAILURE TO PAY SEWAGE TREATMENT BILLS; AND a&PBALING SECTION l PF ORDINANCE NO. 3, SERIES OF 1954, AND ALL OTHER ORDI- NANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: Sectio,n 1. Section l of Ordinance No. 3, Series of 1954, is hereby repealed, effective January 1, 1960, and the following new Section 1, effective on the same date, is hereby substitut8d therefor: "Section 1. The rates and charges for the treatment and disposal of sanitary sewage at the Englewood Sewage Treatment Plant shall be determined by reso- lution of the City Council from time to time, such resolution to be published in the official newspaper of the City once each week for two successive weeks prior to the effective date of said rates and charges&" Section 2. When the premises to which such sanitary sewage service is provided are within the limits of the City of Englewood, faiiure to pay the rates and charges for treatment and disposal of sanitary sewage when due shall be cause for discontinuance of water service, such water service to be shut off until the bill for treatment and disposal of sani- tary sewage shall have been paid. Section 3. When the premises to which such service is provided are located without the limits of t h e City of Englewood, failure to pay the rates and charges for treatment and disposal of sanitary sewage when due shall be cause for the City Clerk to certify to the County Commissioners of the county in which said delinquent user's property is located the charges due and unpai5 or, on or before November 1st of each year, and thereupon and until paid tbe same shall be a lien upon the real property so served by said sewerage syste~, and shall be levied, certified, received, or collected by sale annually fro~ year to year by the proper county officials as are county taxes, and the proceeds therefrom remitted to the City of Englewood; provided that, if t~~ premises are supplied with Englewood water services, such service may be s~ut off until the bill for treatment and disposal of sanitary sewage shall have been paid. · Section 4. All ordinances and parts of ordinances in conflict here- i th are hereby repealed. Passed on First Reading by the City Council of the City of En~lewood, Colorado, this 19th day of October, A.D. 1959, and ordered published in full in the Englewood Herald and Enterprise. Passed on Final Reading by the City Council of the City of Englewood, Colorado, this 2nd day of November, A.D. 195Y, and ordered published in full in the Englewood Herald and Enterprise.
