ORDINANCE NO. 35 SERIES OF 1959
AN ORDINANCE REORGANIZING THE GOVERNMENT OF THE CITY OF ENGLEWOOD,
COLORADO, PURSU ANT TO THE HOME RULE CHARTER OF SAID CITY; ADOPTING AN AD -
INISTRATIVE PLAN PURSUANT TO THE PROVISIONS OF SAID CHARTER; PRESCRIBING
DUTIES , SALARIES AN D WAGES FOR OFFICERS AND EMPLOYEES; REPEALING ALL ORDI-
NANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN
EMERGENCY.
WHER~S, the dul y qualified electors of the City of Englewood,
Colorado, by a majority vote, heretofore adopted a Home Rule Charter which
ill be in full force and effect beginning January 1, 1960; and,
WHEREAS, the City Manager, pursuant to the provisions of said
Charter, has now submitted to the City Council a revised administrative
plan and revised salary and wage scale, and the City Council dee~ shch
revised plan and salary and wage scale to be practical and realistic, and
or the b~st interests of the City:

ARTICLE I
GENERAL ORGANIZATION
The City Council recognizes and adopts as the organizational plan:
Section (a) BOARDS AND COMMISSIONS
(1) The "Board of Examiners for Electricians" established
by Section 6 of o~dinance No. 2, Series of 1953.
(2) The "Public Library Board" established by Ordinance
No. 28, Series of 1958.
(3) The ~'Water and Sewer Board" established by Ordinance
No. 34, Series of 1958.
(4) The "City Planning and Zoning Commission" established
by Ordinance No. 35, Ser:ie s of 1958.
(5) The "Board of Adjustment and Appeals" established by
Ordinance No. 22, Series of 1959.
(6) The "Board of Career Service Commissioners" established
by Ordinance No. 13, Series of 1959.
(7) The "Election Commission" established by Ordinance
No. 25, Series of 1959.
Section (b) LEGAL DEPARTMENT
A City Attor ne y and Assistants as provided for in the Home Rule
Section (c) MUNICIPAL COURT
A Municipal Judg e and Court Clerk as provided for in the Home
Rule Charter. The term of the Municipal Judge shall begin the first Monday
in January after his election and shall continue for a term of four (4)
years therefrom. In the event of a vacancy in the office of Municipal
Judge, a successor shall be appointed by the City Council, who shall serve
until the first Mon da y in January after the next election. At the next
election after such vacancy occurs a Municipal Judge shall be elected for
a term of four (4) years beginning the first Monday in January after such
election.

As provided f or b y Federal a nd State statutes, consisting of
volunteer personnel a nd c oo p erating with the City under a Civil Defense
Director appointed by t h e C ity Mana g e r , but without City departmental
status.
ARTICLE II
DUTIES
Section (a) The duti es o f the exi s t i n g and recognized Boards and Commissions
shall be as p rescribed wi thin the ordinances creating the res-
pective bodies.
Section (b) The duti e s of the Le gal Department and of the Municipal Court
shall be as · p r e s cr ibed wit hin the Ho me Rule Charter .
Section (c) The duti e s o f t he Operat i ng Departments shall be as prescribed
by statu te s , Home Rul e Charter, ordinances, and/or directives
of the City Manager a s each may be applicable to the respective
depar t me n t s.
Section (d) The duties o f the Civ il Defense Agency shall be as prescribed
by Fe d era l a nd State l egi s l ation. The City Council recognizes
the possible f unction i n g of the Agency outside of the terri-
torial l i mi ts of the Cit y of Englewood. In case of a declared
emergency wi t hin the Ci ty of Englewood, all operating depart-
ments of the Cit y government shall cooperate with the Civil
Defense Direc tor, and shall coordinate their activities and
contribu t e eff ort , f ac i lities, materials and equipment for
the duratio n of th e e me rgency.

Section (b) SALARIES OF CITY COUNCIL APPOINTEES

The City Manager shall receive annually the sum of $10,500.00,
payable in ~qual monthly installments, plus $300.00 annually for expenses.
The Municipal Judge shall receive annually the sum of $2,600.00, payable
in equal monthly installments. The Municipal Court Clerk shall receive
a monthly salary within Grade 6, to be determined by the City Council.
The City Attorney shall receive an annual retainer of $2,400.00, payable
in equal monthly installments; and the Assistant City Attorney shall
receive an annual retainer of $2,100.00, payable in equal monthly instal-
lments; in each case until changed by ordinance of the City of Englewood.
The City Attorney, Assistant City Attorney, and Special Water Consultant,
shall receive such other and further compensation from time to time for
special services as the Clty Council may determine and allow.

ARTICLE IV
REPEALING PROVISIONS
Ordinance No. 47, Series of 1955
Ordinance No. 31, Series of 1956
Ordinance No. 37, Series of 1957
Ordinance No. 39, Series of 1958
and all other ordinances or parts of ordinances in conflict herewith are
hereby repealed.
ARTICLE V
If any section, subsection, sentence, clause or phrase of this
ordinance is for any reason held to be unconstitutional, void, or invalid,
the validit y of the remaining portions of this ordinance shall not be
affected thereby.
ARTICLE VI
This ordinance shall take effect and be in force from and after
January 1, 1960.
ARTICLE VII
The C J ty Council hereby finds, determines and declares that it is
necessary that the provisions of the above and foregoing ordinance be in
effect to coincide with the beginning of the fiscal year of the City,
January 1, 1960; that this ordinance could not be in effect under regular
procedures of passage; that an emergency exists, and that this ordinance
is necessary for the preservation of public property, health, peace or
safety and shall take effect upon passage.
Passed on First Reading by the City Council of the City of
Englewood, Colorado, this 16th day of November, A.D. 1959, and ordered
published in full in the Englewood Herald and Enterprise.
Passed on Final Reading by the City Council of the City of
Englewood, Colorado, this 7th day of December, A.D. 1959, and ordered
published in full in the Englewood Herald and Enterprise.
