ORDINANCE NO. ~ SERIES OF 1958
AN ORDINANCE AM.ENDIN G ORDINANCE NO. 4 5, SERIES OF 1955, ENTITLED THE "ZONING
ORDINANCE OF THE CITY OF ENGLEWOOD" BY PROVIDING THEREIN FOR SWIMMING POOLS
ITBIN THE SAID CITY OF ENGLEWOOD, COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO:
Section 1. Section 5 of Article I of Ordinance No. 45, Series of
1955, of the ordinances of the City of Englewood, Colorado, is hereby amended
by adding thereto the following paragraphs between Sections 71 and 72
thereof:
"7la. Swimming Pools, Private: Any artificially constructed
pool designed, used and maintained for swimming purposes by
an individual for use by his household and guests and located
on a lot as an accessory use to a residence. (See Supple-
mentary Regulations)."
"7lb. Swimming Pools, Semi-Private: Any body of water
suff i ciently deep for complete immersion of the body and
used collectivel y by a number of persons for swimming or
recreative bathing, together with the shores, buildings,
equipment and appurtenances pertaining to such bathing
places. All users of such pools must be guests of or bona
fide members of a club, association or other such organiza-
tion whose purpose is in whole or in part the ownership and
operation of such swimming pool. (See Supplementary
Regulations)."
"7lc. Swimming Pools, Semi-Public: Any body of water
sufficiently deep for complete immersion of the body and
used collectively by a number of persons for swimming or
recreative bathing, together with shores, buildings,
equipment and appurtenances pertaining to such bathing
places. Use of such pools by any person must be contin-
gent upon their partaking of the primary service of the
concern owning and operating such pool. (See Supplementary
Regulations)."
"7ld. Swimm ing Pools, Public: Any body of water sufficiently
deep for complete immersion of the body and used collectively
by a number of persons for swimming or recreative bathing,
together with the shores, buildings, equipment and appurten-
ances pertaining to such bathing places. Such pools must be
open to the general public and operated as a business venture
with admissi on to be granted upon payment of a specified fee."
Section 2. Paragraph 2 of Section 9 of Article IV of Ordinance
No. 45, Series of 1955, of the ordinances of the City of Englewood, Colorado,
is hereby amended by adding thereto a new Subsection (3), which shall read
as follows:
"(3) Swimming Pools, Semi-Private, Semi-Public and Public.
(See Supplement ary Regulations)."
Section 3. Paragr aph 1 of Section 10 of Article IV of Ordinance
No. 45, Series of 1955, of the ordinances of the City of Englewood, Colorado,
is hereby amended by adding thereto a new Subsection (11), which shall read
as follows:
"(11) Swimmin g Pools, Semi-Private, Semi-Public and Public.
(See Supplementary Regulations)."
Section 4. Article VI of Ordinance No. 45, Series of 1955, of the
ordinances of the City of Englewood, Colorado, is hereby amended by adding there-
to a new Section 18, which shall read as follows:
"18. Swimming Pools. (See definitions).
t.
a. Building permits for specific types of swimming
pools shall be issued in the various zone districts
as f ollows:
(1) Private pools shall be allowed in all Residential
districts only.
(2) Semi-private pools shall be allowed in all
Residential and Commercial districts only.
(<3) Semi-Public pools shall be allowed in the R-3
Residential district and both Commercial
districts only.

(4) Public pools, privately owned, shall be allowed
in both Commercial districts only.
b. Publicly owned and operated swimming pools shall be
allowed in all districts except industrial and
parking districts.
c. Indoor pools of a Semi-private or Semi-Public
classification may be allowed in an industrial
zone subject to specific permission from the
Zoning Board of Adjustment.
d. All swimming pools must comply in every respect
with all existing City ordinances, regulations and
policies governing swimming pools.''
Section 5. The City Council hereby finds, determines and declares
this Ordinance is necessary for the immediate preservation of the public
peace, health, safety and convenience.
Section 6. In the opinion of the City Council an emergency exists;
therefore, this Ordinance shall take effect and be in force from and after
its final passage and publication.
Passed on First Reading by the City Council of the City of Englewood,
Colorado, this 16th day of December, A.D. 1957, and ordered published in the
Englewood Herald and Enterprise.
Passed on Final Reading by the City Council of the City of Englewood,
Colorado, this 20th day of January, A.D. 1958, and ordered published in the
Englewood Herald apd Enterprise.
