ORD I NANCE NO 16 SERIES OF 1958
AN ORDINANCE CREATING AN I MPR OVEMENT DISTRICT IN THE CITY OF ENGLEWOOD, COLORADO
TO BE KNOWN AS PAVING DISTR IC T NO. 8; ORDE R ING THE CONSTRUCTION THEREIN OF STREET
AND ALLEY IMP ROVEM ENTS; P ROVIDING FO R T HE ISSUANCE OF BONDS OF THE DISTRICT IN
PAYMENT FOR SAID IMP ROVEMENTS; AND DEC LAR ING AN EMERGENCY.
WHEREAS, the City Council of Englewood , Colorado , pursuant to the pro-
visions of "An Act Relating to Local Improvements in Cities and Towns", approved
April 9 , 1923 , and upon the requisite pet it i ons subscribed by the owners of a
majority of the frontage to be asses sed for the local improvements hereinafter
described , hereby finds and determines t hat there exists a necessity for the
creation of Paving District No. 8, in sai d City, and the construction therein
of certain street and alley impro v ements, as described in said petitions; and
WHEREAS, the City Co u ncil has heret o for e directed the City Engineer
to prepare plans, specifications, maps and schedules in accordance with said
ct; and
WHEREAS, the City Engineer has made his report in t he premises , and
has filed with the Clerk of said City all the maps and certificates of his
survey , as well as sche dules , pl ans, specif ications , approximations of cost,
and all other matters and things in complete fo rm and substance as by law
required; and
WHEREAS, the said report so ma de and files, together with details,
specifications , estimates, maps, and sche dule s , a r e hereby approved and adopted
by said City Council; and
WHEREAS, the City Council directe d the City Clerk to publish in the
nglewood Herald and Enterprise, a newspaper of gener al circulation in said
City notice of a proposition to create said Di strict, and that on May 19,
1958 , at ~:00 o'clock P. M., all complaints and objections that mig ht be made
in writing concerning the proposed improve ments by the owner or owners of any
real estate to be assessed or any person or persons interested gen erally ,
would be heard and dete r mined by the City Council of said City of Englewood,
before final action of said Council thereon , a n d that after the determination
of all cowplaints and objections was made, s aid City Counci l wou ld take up
and consider an ordinance creating said Di strict and ordering the proposed
improvements; and
WHEREAS, the City Clerk by advertisement for a period of tn ore
than twenty (20) days prior to the said 19th day of May 1958, gav e notice in
orm and substance of the matters and things above mentioned as ordered to be
given , in all respects in accordance with law an d said order; and
WH£HEAS , at the ti111e and place specified in said no tic e , the City
Council met in open session for the purpose of hearing any o bjections or pro-
tests that might be made against said impro ve ments; and
objections or protests against five particular petitions were heard ,
and such objections or protests were dee1ned invalid and were denied; and
WHEREAS, the City Council hereby finds and determines that a general
public benefit will accrue to the City from the propose d improvements;
HEREFORE, BE I T ORDAINED BY TUE C I TY COUNC I L OF THE CITY OF ENGLEWOOD,
COLORADO, THAT:
Section 1. Said impro vement s hereinbelore d escribe d and ref erred to,
cons is ting of street and alley i111provemen ts, all as in the peti tlons f or said
improvements set forth and described . were duly ordered after notice duly
given a nd hearing duly held , and that the petitions were presented t o said City
Council , and that said petitions were subscribed by the requir~d number of
owners, all a s required by law.
Section 2. Sai d impro ve ments s hall consis t of necessary gr ading and
excavation, p avin g with six-inch compacte d gravel base co ur se, with two-inch
a sph altic concret e surface, and concrete walk s, c urbs and g u tters, where not
already installed , together with appurtenances and incidentals on the following
streets. alleys and avenues in the City of Englewood, Colorado:

Sec tion 3. Said Distr ict s hall be known as and the same is hereby
desi~nated Paving Dist rict No. 8, Englewood, Colorado.
Section 4 . The construction of the stre et and alley improvements i n and
for said Distri ct, as shown by the plans, speci f ications and maps thereof, pre-
pared by the City Engineer and appr oved by the City Council of said C i ty, and now
on file in the office of the Clerk of said City, be and the same is hereby
authorized and ordered, the material to be used in the construction of said
street improve1nents to be in ac c ordance with such maps, plans and specifications.
Section 5 . By virtue of and in pursuance of the aforesaid law and
the Charter or said City, if adopted , loc al improvement bonds of the City shall
be issued for the pu1·pose of paying for the local improvements in this Ordin ance
described and provided to be constructe d in s aid Paving District, in an amount
not to exceed the cost of said improveo~nts, including engineering and all in-
cidental exoenses : as in s aid law pro v ided.
Section 6 . S aid bonds shall be authorized by an Ordinance later to
be passed in accordance with the laws of the S tate of Colorado, and the Charter
of said City, lI adopted .
Section 7. The Mayor a nd City Clerk are hereby authorized to adver-
tise for bids to construct s uch impro v ements in fo ur (4 ) consecutive weekly
issues of the Englewood Herald and Enterprise, a newspaper o f general circula-
tion published in s uch City, wh ich advertisement may run concurrently with the
ublication of this Ordin a nce .
Se c tion 8 . By reason of the f ac t that the completion at the earliest
ossible date of the improv ements described in and contem~lated by this Ordi-
nance is necessary to the immediate preservation of the public safety, it is
declared that an emergenc y exists and that this Ordinance shall t ake effect
five (5) day s after its final p ublica tion .
Section 9 . All ordinances, or parts thereof in con fl ict herewith are
hereby ~epealed. T his Ordinance, a fter i ~s fin a l passage , shall be recorded in
a book kept for th at purpose, sha l l be authenticated by the signature of the
~ayor and City Clerk , s hall be published in said City , and after becoming
e ffective . shall be i rrepealable until the bonds of said Dist rict shall be
aid i n full.
