HomeMy WebLinkAbout1958 Ordinance No. 031• BY AUTHORITY ORDINANCE NO. 31 SERIES OF 1958 AN ORDINANCE AMENDING ORDINANCE NO. 33, SERIES OF 1957, OF THE ORDINANCES OF THE CITY OF ENGLEWOOO, COLORADO, KNOWN AS THE "OFFENSES ORDINANCE," BY ADDING THERETO SD;TION 14.3 ENTITLED "ROCKETS," REGULATING THE SALE, MANUFACTURE AND USE OF MODEL ROCKETS OR MISSILE TYPE PROJECTILES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: Section 1. Ordinance No. 33, Series of 1957, of the ordinances of the City of Englewood, Colorado, known as the "Offenses Ordinance," is hereby amended by adding thereto a new Section 14.3 which shall read as follows: "14.3 Rockets. (a) It shall be permissible to manufacture and sell to the public, either at wholesale or retail, model rockets or missile type projectiles which meet the following requirements: (1) Said model rockets or missile type pro- jectiles shall be designed to be fired electrically with a spring loaded positive 'off-on' switch. (2) All such model rockets or missile type pro- jectiles shall have a positive parachute recovery system. (3) All such model rockets or missile type pro- jectiles must be constructed with non-metallic materials and shall not contain metal bodies, nose cones or fins. (4) All such model rockets or missile type pro- jectiles must be propelled only by a com- mercial motor which shall have been pre- viously tested by the Bureau of Explosives of the Association of American Railroads and thereby determined to be I.C.C. Class C toy propellant device. (5) All such model rockets or missile type projectiles shall not contain any type of explosive warhead. "(b) It shall be unlawful to manufacture or sell any such model rockets or missile type proaectiles for pyrotechnic ·purposes. "(c) It shall be unlawful to fire, ignite, explode or launch any model rockets or missile type projec- tiles within the city limits of the City of Englewood, Colorado, which do ~ot comply with the provisions of subsection (a) above, and in addi- tion to the requirements contained in said sub- section (a) above, it is further declared to be unlawful to fire any such model rocket or missile type projectile within 100 feet from any struc- ture; to fire any such model rocket or missile type projectile in any manner except by an elec- trical device with a spring loaded positive 'off-on' switch; and to launch any such model rocket or missile type projectile in any direc- tion more than 10 degrees from the vertical. "(d) It shall be unlawful and a violation of this ordinance for any person or persons to destroy or damage the property of another or to injure the person of another by the launching, fird:ng ,. igniting, discharging or exploding of any model rocket or missile type projectile, whether or not such launching, firing, igniting, discharg- ing or exploding thereof is in compliance with the p1,ovisions of this ordinance." x.. 137 Se ction 2. The City Council hereby finds, determines and d eclares that th e public health, safety, morals and welfare will be promoted by the r egulation of the manufacture, sale, use and firing of mo de l rockets or missile type projectiles.
