ORDINANCE NO, 39 , SERIES OF 1958
AN ORDINANCE AMENDING ORDINANCE NO. 47, SBRIBS OF 1955, AS AMENDED BY ORDINANCE
NO. 31, SERIES OF 1956, AND ORDINANCE NO. 37, SBRIBS OF 1957, ENTITLED "AN
ORDINANCE REORGANIZING THE GOVERNMENT OF THE CITY OF BNGLBWOOD, COLORADO, PUR-
SUANT TO CHAPI'ER 139, ARTICLE 6, COLORADO RBVISBD STATtrrBS 1953, AS AMENDED AND
SUPPLEMENTED; ADOPI'ING AN ADMINISTRATIVE PLAN PURSUANT TO SECTION 15 OF SAID
ARTICLE 6; SETTING FORTH THE DEPARTMENTS, EllPLOYBBS AND DUTIES PRESCRIBED BY
SAID ADMINISTRATIVE PLAN; PRESCRIBING SALARIES AND WAGES FOR EMPLOYEES;" AND
REPEALING ALL ORDINANCES AND PARTS OF ORDINAMCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL or THE CITY OF ENGLEWOOD, COLORADO.
Section 1. All of Section (c) of Article I of Ordinance No. 47,
Series of 1955, as amended by Ordinance No. 31, Series of 1956, and Ordinance
No. 37, Series of 1957, is hereby repealed and tbe following Section (c) is
substituted therefor and shall read as follows:
"Section (c). The City Council recognizes, as a part
of the organizational plan,
(1) The 'Board of Examiners of Electricians' (3
members) provided by Section 6 of Ordinance
No. 2, Series of 1953,
(2) The 'Public Library Board' (6 members) pro-
vided by Ordinance No. 28, Ser:iB of 1958,
(3) The'City Planning and Zoning Commission' (6
members) provided by Ordinance No. 35, Series
of 1958,
(4) The 'Water and Sewer Board' (7members) pro-
vided by Ordinance No. 34, Series of 1958,
(5) The 'Zoning Board of Adjustment' (5 members)
provided by Article II, Section 6, of
Ordinance No. 45, Series of 1955."
Section 2. Section (d) of Article I of Ordinance No. 47, Series of
1955, as amended by Ordinance No. 31, Series of 1956, and Ordinance No. 37,
Series of 1957, is hereby amended to read as follows:
SECTION (d). The departmental and operational control
of City government shall be vested in the City Manager.
The various departments to be operated under the con-
trol of the City Manager shall consist of:
1. Utilities Department
(a) Water Division
(b) Sewer Division
2. Finance and Recording Department
3. Police Department
4. Fire Department
5. Public Works Department
(a) Engineering Division
(b) Streets and Drainage Division
(c) T1 ·asb and Garbage Disposal Division
6. Building Inspection Department
(a) Inspections Division
(b) City Hall Maintenance Division
7. Parks and Recreational Department
8. Civil Defense Agency
9. City Planning and Traffic Department
10. Public Library Department."
Section 3. Section (c) of Article II of Ordinance No. 47, Series of
1955, as amended by Ordinance No. 31, Series of 1956, and Ordinance No. 37,
Series of 1957, is hereby amended to read as follows:
"SECTION (c). Finance and Recording Department.
"The Finance and Recording Department shall consist of a
City Clerk, a Deputy Clerk, and such other office workers
as are deemed necessary by the City Manager for the efficient
and economical operation of the office functions. The City

Clerk shall be ex-officio clerk of the Council and
ex-officio treasurer of the municipality. The function
of the office shall include the recording of Council
proceedings, ordinances and resolutions; the filing of
documents, contracts, vouchers and pertinent papers;
the issuing of licenses and permits as required by law
or ordinance; the collection or acceptance of all
service ch arges, fees, rentals, accounts, bills and
other funds and monies due to the City; and/or as trans-
mitted to the Clerk-Treasurer's office by other City
Departments; and such other duties as are set forth in
Chapter 139, Article 6, Sections 15, 16 and 17, Colorado
Revised Statutes 1953, as amended and supplemented, and
in Section 31 and in Sections 97-103 inclusive of the
Home Rule Charter of the City of Englewood, and as may
be required by ordinance, or directive from the City
Manager. As ex-officio treasurer, the officer shall
maintain a constant and complete record of all receipts
and disbursements, and shall be in a position to re-
port the conditions of all funds at all times. He
shall make disbursement only upon authority from the
City Council, or as required by ordinance· or state law.
All warrants issued by the City shall be signed by the
mayor and attested and counter-signed by the City Clerk.
All bank checks issued shall be signed by the City
Clerk. In all matters or duties of the City Clerk, the
deputy shall act for and on behalf of the City Clerk
when the City Clerk is absent or incapacitated. The
City Clerk shall maintain a constant budget control,
prepare vouchers, supervise payroll•, maintain complete
insurance records and personnel records, and perform
such other accounting duties as directed by the City
Manager. The City Manager shall deaignate one "employee
in the Clerk-Treasurer's office to perform the duties of
a Purchasing Agent who, under directive from the City
Manager, shall make purchase and procurement of supplies,
materials, repairs, services and other items of need for
all departments, and in such manner as will be for the
best interests of the City.
"The City Clerk as head of the Finance and Recording
Department, and all other department eaployees, shall be
appointed by the City Manager. Such employees shall be
subject to the control of the City Manager through the
department head."
Section 4. Article II of Ordinance No. 47, Series of 1955, as
amended by Ordinance No. 31, Series of 1956, and Ordinance No. 37, Series of
1957, is hereby amended by adding thereto a new Section (k) which shall read
as follows:
"SECTION (k) Public Library Departaent.
"The Public Library Department shall consist of a
Librarian, Assistant Librarians and such other
employees as are deemed necessary by the City
Manager to operate the Public Library function.
The Librarian shall supervise all activities of the
Library personnel, and enforce the rules and regu-
lations as prescribed by the Public Library Board and
perform all things in the manner provided in Ordinance
No. 28, Series of 1958.
"The Librarian and all department employees shall be
appointed by the City Manager. Such personnel shall
be subject to the control of the City Manager through
the Librarian."
Section 5. Article IV of Ordinance No. 47, Series of 1955, as amended
by Ordinance No. 31, Series of 1956, and Ordinance No. 37, Series of 1957, is
hereby amended to read as follows:
"ARTICLE IV.
"SALARIES OF EMPLOYEES
"All employees of all departments of the City of Englewood, except the
City Manager, Police Magistrate and City Attorney, Assistant City Attorney, and
special Water counsel, shall receive salary compensation effective January 1,
1959, as follows, to-wit:

1953, as amended and supplemented; increases and increments in compensation
within the limits provided for the grade may be granted at any time by the
City Manager."
Section 6. Article V of Ordinance No. 47, Series of 1955, as
amended by Ordinance No. 31, Series of 1956, and Ordinance No. 37, Series of
1957, is hereby amended to read as follows:
"ARTICLE V.
"SALARIES OF CITY COUNCIL APPOINTEES
"The City Manager shall receive annually the sum of $10,000.00,
payable in equal monthly installments, plus $300.00 annually for
expenses; the Police Magistrate shall receive annually the sum
of $2,600.00, ~ayable in equal monthly installments; the Police
Court Clerk shall receive a monthly salary within Grade 6, to be
determined by the City Council; the City Attorney shall receive
an annual retainer of $2,400.00,payable in equal monthly instal-
lments ; the Assistant City Attorney shall receive an annual re-
tainer of $2,100.00, payable in equal monthly installments;
the Special Water Counsel shall receive an annual retainer of
$1,200.00, payable in equal monthly installments; in each case,
until changed by ordinance of the City of Englewood."
