ORDINANCE NO. 5, SERIES OF 1957
AN ORDINANCE AMENDING ORDINANCE NO. 17, SERIES OF 1956, ESTABLISHSNG A BUSINESS AND
OCCUPATIONAL TAX, BY RE -DEFINING CERTAIN PROVISIONS THEREOF RELATING TO THE RATE S .AND
PAYMENT OF SAID TAX.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO:
Section 1. Ordinance No. 17, Series of 1956, entitled ''An Ordinance Establishing
a Business and Occupational License Tax for the Purpose of Raising Municipal Revenue
and Licensing and Regulating the Carrying on of all Business, Trades , Occupations and
Professions Wi thin t he City of Englewood, Colorado'', is hereby amended as follows:
(a) T able I of Sec t ion 3 is hereby amended to read:
"$3 0 .00 for Lhe first owner , partner, manager or employee, plus
10.00 for each additional owner, partner , manager or employee,
up t o a maximu m number of taxable employees of 36. No tax on
employees over the number of 36."
(b) Table II of Sec t ion 3 is amended to read:
$15.00 for the first owner , partner, manager or employee , plus
$5 .00 for each additional owner, partner, manager or employee, up
o a maximum number of taxable employees of 36. No tax on
employees over t he number of 36."
(c) "S ection 4 is hereby amended by deleting from Group A the words
"motels and hotels", and from Group B the words "Sheet metal works".
(d) Group I of Section 4 is hereby amended to read:
"Sub-group 1: Resi dential rental units.
"(a) Any person who rents , leases or otherwise
provides one or more residential units for
hire shall be subject to a tax of $3.00 per
unit per year".
"(b) A residential unit shall be construed, by way
of i llustration, to mean a house, duplex apart-
men L, hotel room, motel room, or other like
unit , in which a person or family .resides ,
either t ransiently or permanently".
"Sub-group 2: Commercial rental units.
"(a) Any person who rents, leases, or otherw i se provides
any number of commercial rental units for hire shall
be subject to a t ax of $4.00 per unit per year."
"(b) Commercial rental units shall be construed to be
any type of premises or units rented for business
purposes , not including units in which persons or
families reside , as defined in Sub-group (b) above.
"(c) This tax shall no t be construed to be a tax on per-
sons who pay reht or occupy rental units owned 'or
leased for ren t al purposes by other parties.
(e) Secti on 9 is .h e r ~by amended by adding thereto the following sen-
tence:
The license t ax provided for in this ordinance shall be paid not later
th an January 31 of each calendar year, and any person or firm failing
to pay said t ax by January 31 of the calendar year , shall thereafter
be deemed delinquent and subject to the penalty provisions of this
ordinance.
Sect ion 2. The City Council hereby finds, determines and declares this Ordinance
is necessary for the imme diate preservation of the public peace, health, safety and con-
venience.
Section 3. I n t he opinion of the City Council an emergency exists; therefore, this
Ordinance shall t a ke effect and be in force from and after its final passage and publi-
cation.
Passed on First Reading by the Ci ty Council of the City of Englewood, Colorado, this
7 t h day of January, A. D. 1 957, and ordered published in the Englewood Herald and Enter-
prise.
