BE IT ORDAHIED BY THE CITY COlilJCIL OF THE CI TY OF ENGL !'..WOOD , COLORADO: to re Section 1 . Paragraph 2 of Section C of Artic le I of Ordinance No . 47, Series of 1955, is hereby amended as f o llows: "There is he re by created a "Wate r Ad visory Board " of seven members, consisting of the Mayor and two bers of the City Council and four reside nt ex-members of the City Counc i l, to be appointed by the City Council the first regular session of the Council following each regular City Election . The terms of the members of the r Advisory Board shall run concu rrently with the terms of the members of the City Council. The City Manager and ater and Sewer Commissi oner shall be ex-officio mem be rs of the Water Advisory Board but without voting privilege. Office Man age r in the Utilities Depa rtme n t shall act at Rec ording Secretary of the Board. The Board shall convene at 8:00 P.M. on the third Wednesday in November following the regular City election, to organize and to select a chairman and vice-chairman. All other sessions of the Board shall be upon call of the chairman. 'h e Water Advisory Board shall have the f ollowing duties: Utilities Depai:tment, reviewing of all ma jor matters referred to it by the City Council in connection with the/Utilities Plants constMlction , Utilities Plants Op eration , Wa t er Distribution System, Sewage Collection System, Contracts, Water Ri2hts and Development of Supply, and the assisting of the Utilities Commissioner and any Consulting Engineer in and all referred problems in connection with the Utilities Department; and it shall further be the duty of said Bo ard to arrive at a determination of all su ch referred issues and recorrunend to the City Council and City ManaRer such action as it shall deem nece s sary in all such matters, including determinations of policy. In ion to its other duties , the Water Advisory Board shall have the authority to investigate both legal and ngi neering phases of all possible sources of additional water and water rights for the City to determine avail- ability thereof for use by the City of Englewood , to investigate all possibilities of contamination or jeopardy the City Water su ~p ly from any cause , and shall recommend to the City Council the action to be taken thereon, he Wat er Advisory Board is specifically hereby granted authority to designate a special legal counsel ho shall, without compensation , sit as a n advisor to the Board. /Any counsel so designated who e of appointment a memb er of the City Attorney's office or staff shall not be deemed a member of the 's office or s taff by reason of the provisions hereof and said At torney shall be retained only on a the City in the event of necessary legal work or litigation as its special counsel in connection with r matters; the City Counc il shall first be advised of any expenditures to be made for litigation or services to be perfo rmed by said special counsel , it being expressly provided, however, that in the urgency or emergency , any contract fo r l e gal services entered into by said Water Advisory Board with counsel shall be binding upon the Ci ty . The memb ers of the Board shall be compensated for actual expenses in connect ion with their duties whene ver said duties require the members to leave the City limits of of Emdewood ." Section 2 . All Ordinances and parts of Ordinances in conflict herewith are hereby repealed. Section J . The City Council hereby f inds, determines and declares this Ordinance is necessary for the te preservation of the public pe ac e, healt h , safety and convenience. Section 4 . In the opinion of the City Council an emerg ency exists; therefore, this Ordinance shall take effect and be in force from and after its final passage and publication.
