S ection 1 . Definitions .
1 .1. Swimming Pools: T he term "Swimmin g Pool" or "Pools
includes all bodi es of wa ter of water sufficiently deep for comp-
lete imme rsion of the body and u sed collec ti v e ly by a number of
persons fo r swimming o r recreative bathin g , together with the
s hore s , buildings , e quipment, and appurt e nanc es pertaining to
such bathing places . IL do es nol include pr i vate swi@ning pools
used solely for family puroises or nat ural bathing places; or
public or semi -public ba ths , whore the main object is the clean-
ing of the body o r t h e practice of the heal ing art, unless such
ba ths consist of a pool or poo l s u sed colle ctively by a number
of indi viduals .
1 .2 Pool Ope rator: T he te rm "Pool Op e ra t or" shall mean the
owner or his authori z ed agent who is responsibl e for maintaining
the operation of the pool in a sa fe and sanitary manner .
1 .3 Person : The term "Pe rson" include s without r eserva t ion
any person, firm , corporaLion, p ublic agency, s chool, motel,
church, inst i t ution, a ssoc iation, club, group, or organization
of any ki nd owning , ma naging , or maintaining a bathing place,
swilllming poo l or p ools as herein defined .
1 .4 Manage r: T he s i ngle t e rm "Manager" sha ll mean the City
Manager or an·y person authori z ed by hitn to a c t as his representative.

1. .3 . Inspection Se rv ices : T h e s in g le te rm "Inspection
S ervice!:>" refers to inspection, inv estigations or examination
s ervices furnished by the Manage r to s wimm ing pools and bathi ng
places and areas that comforrn with tho r equir e me nt s of this a r ticle
and rules and re gul ation s promul g ated un de r the authorit y of this
ordinance .

to a bathing pool ; all piping r equir e d for the i ntroduction
into or c i rculation throu gh s uch p ool; all colle ctin g devic e s
and drainage piping , conduit, or channel r equir e d t o circulate ,
r aat , carry a way or d i spo se of water fron1 a p ool starting at
he point of deli v ery to the p r e mi ses from an approved wat er
system and including all e .. 1uipment , t reatment devices, pumps
and appurtenances up to th e point of dischar ge t o a n approved
·e wera gc s y s t em , storm dra in , d ra ina ge s y stem, or natural wat e r
course .
S~CT ION 2 . Licenses . T he l i cense fe e for an y s wimm in g pool as
defined ju Se ctjon 1 .1 . s hall be ($ .OO )
an11ually, payable on or before , January 1 st of each calendar year.
S~CTION 3 . Inspection S ervices il e4uired . It shall be unlawful for ~n y person,
firm, or corporat i on, to operate a s winmimg pool or swimming pools as def ine d
in this ordinance except as provide d in and authorized by this ordinance and
in accordanc e wilh applicable rule s and re g ulation s pro~l ~atcd under
the autboriLy or tl1is ordinance , and wi tnouL having been accorded inspection
servic es by the ~anager .

SECT ION 5 . Plans and Specifi ca tions .
SECT ION 6.
5 .1 It shall be n ece ssary to submit to the Manager detailed
plans and specifications before any swimming pool is installed,
con s Lructed, modified,. remodeled, extend ed or enlarged . Before
such wor k commences, s uch plans and specifications shall be app-
roved by the Manage r i n wr it ing in respect to the following:

6 .1 If the Manager shall find , after inv esti g ation , that all
conditions and speci fic re4uircments r e lating to a s wi mming
pool for which inspection ser vices are sought have been met in
accordance with th e terms of this ordinance and applicable rules
and regul ations promulgated hereunder, the Manager shall thereupon
accord ins pection se rv i ces to the applicant, e v i dencin g such
accord by an approprial\) c c rliitcaLe •
. 2 If the Manager sh all not so find, he s hall thereupon
issue an order denying such i nspe ction services and notify the
applicant oI the denial .

been kno wn to exi e t at the time of of the application for inspection
s ervices , would 11 av e warran te d the Manager to refuse originally

SECT I ON 11. Unlawful Acts I t sha ll be unlawful for any person, firm '
or corporatio n to cond uc t or cause lo be conducted any swimming pool not
accorded inspecLion servic es or an y s wimming pool for which the privilege
of inspection ser vic es has been s u spen d e d or revoked.
SECT I ON 12. Emergen cy S u spension oi Inspection Serv ices . If the Manager
finds th at provable cause e xist s for the revocation of t he privilege of inspection
se rvice s for a s wimm ing pool and that ~h a t the l1ealth and safety of those who
utilize lhe s wi1nmint; pool is me naced, h e may enter an order for immediate
suspension of s wi mm in g pool operations, pending further investigation, for
a period not to exc ee d ten (10) day s .
SECTION 13 . Reinst atement . T he Ma n a ger may reinstate suspended inspection
service certificates or issue new c e r ti ficates to a person, firm or corp-
oration, as defined in this ordinance, whose privile g e of inspection services
has been re v olted or su rr en d e r e d if no fact or condition then exists which would
warrant the Manage r to refu se t o accord inspection services to the
s wimming pool under the terms of t his ordinance and the applicable rules
and re g ulat i ons .
SECTION 14 . Basic S ani tary Provisions; Rules and Regulation to Amplify
and Au gment . i'he foll owin g bas ic i·e L1uirements shall apply to all swimming
pools . The ~t ana ge r s ha.11 pr omul g a te from Lime to time urles and regulations
hi ch amplify and augment the se rc ~1u i rments iu respect to sanitation, clean-
liness, and ade 4 uacy of facilities, e~uipment, and structure:
14 .l ConsLrucLion and Design . Construction and design shall be
such that t h e pool can be eas ily operated, cleaned and shall be
kept clean and in g ood repair .
14 .2 Filt ration System . Filtration sys te m shall be such that the
s wi111 min :j pool can be ope rated in a most efficient and clean condition.
14 .3 He ating and Ventilating . T he swimmin g pool and the pool
water s hall be ade4uately and properly heated . T he pool and the
a lhho usc shall b e ade4uately ventilated.

conducted s hall b e well li g hted .
14 .J . Wale r S upply . T h e wat er s upply shall be ade~uate and of
a safe , sanitary ~uality approved by the Mana ger .

SECTION 17 . S cv ~rabili1..y . If a n y provisions of tl1is ordinance, or any
rule or r v;~ul.1L ;on p ro 11 1ul ,..;ate d hereunder , or its application t o any person
or circu mstance s i~ h e ld in valid, s uch inv alidi ty shall not affect other
provisions or app l ic ation s of the ord inan c e or of the rules and re g ulations
promulgat ed there u n d e r . The Council h e reby declares that in these regards
