ORDI NANCE NO. JO, SERIES 1956
AN ORDINANC E PROVIDING FOR THE PLACING OF BENCHES WITHIN THE CITY OF ENGLEWOOD FOR THE
CONVEN IENCE OF THE GENERAL PUBLIC AND AUTHORIZI NG THE MAYOR AND CITY CLERK TO ENTER
INTO A CONTRACT THEREFOR ON BEHALF OF THE CI TY WITH EMPIRE BENCH ADVERTISING COMPANY.
WHEREAS, the City Council of the City of Englewood believes that the health,
welfare and conveni ence of the City will be served by the installation or benches
at certain locations along the public eidewalks and ·at other places within the City,
to be used by the g eneral public at bus stops and other locations for the comfort
and convenience of the g eneral public, and Empire Bench Advertising Company has
offered to place benches at certain locations under conditions to be expressed in
writing; and
WHEREAS, the City Council of the City of Englewood finds and determines tnat
the placin~ of bencheA at certain locations along the public sidewalks and at other
public placeA within the City is necessary for the health, welfare and convenience
of the g eneral public of the City of Englewood;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Englewood
to-wit:
Section 1. The City of Englewood shall cauae benches to be placed at certain
locations along the public sidewalks and at other public places within the City,
to be used by the gen eral public at bus stops and other locations for the comfort
and convenience of the general public by entering into a contract with Empire Bench
Advertising Company, which contract shall provide for the placement of said benches ·
within .the City for a period of two yeara plus an option or renewal for a further
period of two years under like terms; said contract further providing for ownership
and maintenance in said Company; said contract further providing that the Company
may use said benches for the display of advertisements and may enter into agreements
with third. persons for the utilization of such advertising space on such terms and
conditions as may be desirable to the Company with provisions for payment to the
City or ;~ of the g ross revenue quarterly as received from the sale or advertising;
aa1d contract further providing for reasonable contro1 of the type or advertising
and termination of the contract upon violation of the conditions thereof and failure
to correct after reasonable notification.
Section 2. The Mayor and the City Clerk of Englewood, on behalf or the City
Council of Englewood, are hereby authorized, directed and empowered to enter into
said contract for benches with Empire Bench Advertising Company and to sign said
contrac~ on behalf of the City of En gl ewood.
Section J. If any sentence, paragraph, subparagraph, section, clause or phrase
of this ordinance is held for any reason to be unconstitutional, such decision sha11
not affect the validity of this ordinance. The City Council hereby declares that it
would have passed this ordinance and each sentence, paragraph, subparagraph, section,
clause or phrase thereof regardless ot the fact that any one or more of said items
mi ght be declared unconstitutional.
Section 4. The City Council of the City of Englewood hereby finds, determines
and declares that this ordinance 1a necessary for the immediate preservation of the
public peace, safety and convenience.
Section 5. In the opinion of the City Council of the City of Englewood an
emergency exists and the refore this ordinance snall take effect and be in force
from and after its final passage and publication.
Passed on first reading by the-City Council of the City or Englewood, Colorado,
this 19 <J.JJ.y of Novembe r A.D., 1956 and ordered publication in the Englewood Herald
and Enterprise.
