Jl, SERIES OF 1956 AN ORDINANCE AMENDING ORDINANCE NO. 47, SERIES OF 1955, ENTITLED 1 AN ORDINANCE REORGANIZING THE GOVERNMENT OF TH E CITY OF ENGLEWOOD, COLORADO, PURSUANT TO CHAPTER 139, ARTICLE 6, COLORADO REVISED STATUTES 1953, AS AMENDED AND SUPPLE- MENT ED; ADOPTI NG AN ADMINISTRATIVE PLAN PURSUANT TO SECTION 15 OF SAID ARTICLE 6; SETTING FOR TH THE DEPARTMENTS, EMPLOYEES, AND DUTIES PRESCRIBED BY SAID AD- MINISTRATIVE PLAN; PRESCRIBING SALARIES AND WAGES FOR EMPLOYEES"; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: Section 1. Para.graph 4 of the preamble of Ordinance No. 47, Series or . 1955, 1s hereby amend ed to read as follows: 'WHEREAS, The City Manager has now presented to the City Council, an amended plan of organizatio n. and a revised salary and wage scale, and the City Council deems such amended plan and revised salary scale to be practical and realistic, and for the beat interests · of the City;11 • Section 2. Sections a, b, c, of Article 2 of Ordinance No. 47, Series or 1955, are hereby amended to read as follows: "SECTION (a). City Manager Powers and Duties. 1 The duly appointed City Manager of the City of Englewood shall possess all ot the rights and powe rs and pertorm all of the duties set forth in Chapter 139, Article 6, Sections 11, 12, lJ, 14 and 15, Colorado Revised Statutes 1953, as a- mended and supplemented, and shall have such other powers and perform such other duties as may be presc ribed in Chapter 139, Article 6, Colorado Revised Statutes 1953, as amended and supplemented, and further amendments and supplements thereto. He shall a ppoint and designate the personnel necessary for the efficient operation ot his office; including an assistant, a secretary, and a •service Center" operator. Such assistant shall p erform the duties of a Purchasing Agent, who, under directive rrom the City Manager, shall make purchase and procurement of supplies, materials, repairs, services and other items of need for all departments, and in such manner as will be for the best interests of the City. Said City Manager shall have such further powers and pe rform such further duties as may be granted or prescribed by the OrdinanceA of the City of Englewood, Colorado, or amendments thereto, or future Ordinances or amendments thereto, and Resolutions. Said City Manager shall further turnish any reports or statements as shall be, from time to time, reasonably re- quested by the City Council of the City of Englewood, Colorado.• 'SECTION (b). Utilities Department. •The Utilities Depa rtment shall consist or a Water and Sewer Commissioner, Superintendents, Operators, Foremen, Main tenance Men, Mechanics, Office Workers, and such other employees as are deemed necessary by the City Manager for the con- struction, operation, maintenance and expansion of the Municipal Water Works and Water Distribution System; and for the operation and maintenance of the City Sew- age Disposal Plant and Sanitary Sewer collection system; and for the billing for water and sewer service charges and fees, and for the collection or acceptance of all service charges, tees, rentals, accounts, bills and other monies due to the utilities function of the City; and such other duties as may be required by ordinance, or directive from the City Manager. Al.l funds and fees collected by the Department shall be transmitted to the City Clerk-Treasurer for proper credit. The Water and Sewer Commission er as head of the Utilities Department, and all De- partment employees, shall be appointed by the City Manager. Such employees shall be subject to the control of the City Manager through the Department head.11 •SECTIO N (c). F inance and Recording Department. "The Finance and Recording Department shall consist of a City Clerk, a Deputy Clerk, and Auch other office workers as are deemed necessary by the City Manager for the efficient and economical operation of the office functions. The City Clerk shall be ex-officio Clerk of the Coun cil and ex-officio Treasurer of the Municipality. The function of the office shall include the recording or Coun- cil proceedings, Ordinances and Resolutions; the filing of documents, contracts, vouchers, and p ertinent pap ers; the issuing of licenses and permits as required by law or ordinance; the collection or acceptance of all service charges, fees, rentals, accounts, bills and other funds and monies due to the City; and/or as transmitted to the Cle rk-Treasurer's office by other City Departments; and such other duties as may be required by ordinance, or directive from the City Manager, or ae set forth in Chapter 139, Article 6, Sections 15, 16, and 17, Colorado Re- vised Statute s 195J, as amended and supplemented. As ex-officio Treasurer, the officer shall maintain a constant and complete record of all receipts and disburse- ments, and shall be in position to report the conditions of all funds at all times. He shall make disbursemen t only upon authority from the City Council, or as re- quired by ordinance or state law. All warrants issued by the City shall be signed by the Mayor and attested and countersigned by the City Clerk. All checks issued shall be signed by the City Clerk or by his Deputy, if said Deputy be so authorized by the City Clerk and the City Council. In all other matters or duties of the City Clerk the Deputy shall act for and on behalf of the City Clerk, when the City Clerk is a bs ent or incapacitated . The City Cl erk shall maintain a constant budget con- trol, p repare vouchers, supervise pay rolls, maintain complete insurance records, and p erform such other accounting duties as directed by the City Manager. I :I I •The City Cle rk as head of the Finance and Recording Department, and all other department employees, shall b e appointed by the City Mana g er. Such employees shall be subject to the control of the City Manager through the Department head.11 · Section J. Article 4 of Ordinance No. 47, Series of 1955, is hereby amended to read as follows: "ARTICLE IV. Article 5 of Ordinance No. 47, Series of 1955, is hereby amended to read as follows: 331 32 "SALARY OF CITY MANAGER, POLICE MAGISTRATE, CITY ATTORNEY, AND ASSISTANT CITY ATTORNEY 1 The City Mana r,er shall receive annually the sum of $9,100.00, payable in equal monthly installments, plus $JOO.OO annually for expenses; the Police Magistrate shall receive annually the sum of •2550.00,payable in equal monthly installments; the City Attorney shall receive an annual retainer of t1,500.oo, payable in equal monthly installments; the Assistant City Attorney shall receive an annual retainer or t1,ooo.oo, payaole in equal monthly installments; in each case, until changed by Ordinance of the City of Englewood.• Section 5. Ir any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to oe unconstitutional, such decision shall not affect the validity or this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one, or any section, sub- section, sentence, clause or phrase be declared unconstitutional. Section 6. All Ordinances and parts of Ordinances in conflict herewith are hereby repealed. Section 7. The City Council hereby finds, determines and declares this Ordinance is necessary for the immediate preservation of the public peace, health, safety and convenience. Section 8. In the opinion of ~ne City Council an emergency exists; therefore, this Ordinance shall take effect and be in force from and after its final passage and publication.
