ORDIN ANCE NO. ~ SERIES OF 1938.
{A Bill FO~ AN ORDINANCE RELATING TO FIREWORKS, PROHIBITING THE SALE
ArJD bISCHARGE 1i.rEREOF IN THE CITY OF ENGLEWOOD; REPEALING All ORDINANCES IN
CONFLICT HEREWITH.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF ENGlEWOOD:
SECTION.!.:. No person, firm, company, corporation or association shall cast,
throw or fire any a~uib, rocket, cracker, torpedo, grenade, gun, revolver,
pistol, cap or cartridge, or other combustible fireworks of any kind in the
City of Englewood.
SECTI ON 2. No person, firm, com pany, corporation or association shall exhibit
or have Tii his possession, with intent to give away or sell or offer for sale
or sell, within the City ot Englewood, any s~uib, rocket, cracker, torpedo,
grenade, gun, revolver, pistol cap of cartridge, or other oombu•tible fireworks
of any kind in the City of Englewood, provided, however, that thia section shall
not apply to the sale of any such article or articles by wholesalers to each
other or to the sale of any such article or articles at wholesale to merchants
conducting business entirely without the City of Englewood, or to the sale
by wholesalers for private or public demonstrations as hereinafter provided.
SECTION A.:, Nothing in this ordinance shall be construed to apply to the sale,
atorage or use of railroad track torpedoes, or other signalling devices used
by railroads, nor to the sale, storage or use of flashlight composition by
photographic suppl ies, or prevent any public or private demonstration or
di splay of fireworks of any kind if conducted under proper p~lice supervision
after application made and permit issued by the Chief of Police of the City ot
Englewood for such demonstration. Said permit shall not be granted unless
such demonstration or display shall be of such a character, and so located,
discharged or fired, as in the opinion of the Chief of Police of the City of
Englewood, after proper inspection , shall not be hazardous to property or en-
danger any person or persons.
SfCTION .!.:. Any person.firm, corporation, company, or association who shall
v oiate any of the provisions of this ordinance, or suffer or allow the same
to be violated, shall upon conviction therefor be subject to a fine of not less
than Ten nor more than Three Hundred Dollars.
~ECTION ~ In the opinion of the Council this ordinance is necessary for the
immediate protection and preservation of the public health, safety, convenience
and general welfare, and it is enacted for that purpose and shall be in full
force and effect immediately after its final passage and publication.
