aHEREAS , The City Council of the City ot Englewood by virtue of the laws ot
the State of Colorado, in such case made and provided, has heretofore established
and created South Broadway ?aving District Number 4, and has oaused to be oonstruot -
ed certain local improvements within said Distriot; and
"IHEREAS, the construction of said looal improvements has been oompleted and
accepted by the Ci ty Council, and the total oost of said improvements definitely
ascertained, and notic e thereof duly g iven as required by law; and
~AEREAS , among other things said notice provided that any com p laints and
objections which migh t be made in writing by the owner ot the property afteoted
to the City Council , and filed i n the office of the City Clerk, within twenty
(20) days fro m the first p ublication of said notice, would be heard· and deter-
mined by the City Council before the passage of any Ordinance assessing the cost '
ot said improveme n ts, and that such complaints and objections would be heard
by the City Coun cil at a regul a r meeting thereof, to be held at the City Hall of
the City of Eng lewood, on t he 19th day ot December, 1928, at !ive (5) o'clook
P .Y.; and
HEREA3 , t he first pub lication of said notice was duly made on the 29th
day of NQve mbe r, A.D. 19 28 ; and
NHERSAS , no com plai n ts or obJections were tiled within twenty (20) days
in accordance with t he above n oti c e; and
WHERE AS, t h e whole co s t of the improvements as shown by the statement
prepared b y the City Eng i ne er, includi ng the oost of inspection, collection
and ot her incidentals, and also including interest on the bonds issued to the
time the fir st inst allment of the assessment was made payable, is the swn of
Six Thousand Three Hundred and Eighty-Two and 30/100 (16,382.30) dollars; and
tiHEREAS , it appears f ro m a thoroug h consideration of the entire matter
that the assessment apportioned upo n eaoh lot or tract of land is in proportion
to the actual benefits accruing to eac h lot or tract of land, to whioh the same .,
is apportioi;ied.
OW , THE!tEFORE , BE I T ORD AI NED BY THE CITY COU NC IL OF T!i E CITY OF ENGLEWOOD:
~ECTION 1: That the whole cost of the said improvements and apportionment
ot the same upon each lot or tract of land in said District, together with
suvh modifications and chang es as have been made by the City Council, is
hereby ap prov ed and decla red to be in propo rtion to the actual benefits accruing
to each lot or tract of land .
SECTION 2 : That therE be and there he reby is assessed upon each lot or traot
of land withi n South Broadway ?avi ng Distriot Number 4, the following amounts
apportioned and set oppo s ite t he se ver al lots or tracts of land to-wit:
