BE IT EllACTED BY THE CITY COUNCIL OP THE CITY OF EllGLEWOOD: ' Section l •• DRrINITION Th• term "auto-bus" shall include any motor vehicle, e&PJ!f'iRS- oarrying passenge~e for hire, having a normal capacity of seven or more passengers. Section 2 •• CON SENT OP CITY COUNCIL No person,. persons, firm, association or corporation shall oper~t• or maintain any auto-bus or auto-bus line as 001111on carrier for hire over the streets aJU} avenues of the City of Englewood without obtaining the consent of the City Council. · Section 3 •• APPLIC ATION An application shall first be filed with the City Council, which application shall contain the following _information: 1 2 3 4 6 6 Ham• and residence of applicant Character of applicant, ''person, corporation, etc." rloute over which the bus or busses propose to operate in the City of &nglewood Soedule on which such bus or busses propose to operate a ate of far~ which such bus or busses propose to oharge A brief description of the bus or busses proposed to be used including make and model of oar, horsepower, etc. The license fee hereinafter provided for shall be tendered at the ti~e of filing the application. Section 4. APPL ICATION TO BE INVESTIGATllD . •• Th • aaid application shall be investigated and approved or rejected by the City Counoil or a Coraaittee by it appointed. Each 48 hours that any auto-bus shall be maintained and operated without compliance with this Ordinance ahall be deemed a aeperate offense. Ordinance No.15, Series of 1926, and all Ordinances and parts of ordinances in conflict herewith are hereby repealed. If any section, sub-section, sentence, olause, or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not effect the validity of the remaining portions of this ordinance. 'rhe City Council hereby decl•i•• that it would have passet the Ordinance and each section, sub-section, sentence, clause and phrase thereof irrespective of the fact that any one or more sections, sub-sections, sentences, olauaee or phrases be declared unconsti tutional. 'l'he City Counoil hereby finds, determines and declares tbat this Ordinance is necessary for the iwaediate preeervation of public peace, health and safety. In the fpinion of the City Counoil an emergen~ exists; therefore, this Ordinance shall take effect and be in force from and after its passage.
