SECTION 15
INTERPRETATION, PURPOSE, AND CONFLICT
In interr reting and ap p lying the provisiona or this ordinance,
they shall be held to be the minimum requirements for the promotion
of the public health , safety, morals, order, convenience, happi-
ness, prosperity, and general welfare. It ia not intended by this
ordinanc e to interfere with or abrogate or annul any easements,
covenants, or other agre ements, between pa ~ties: provided, howev e r,
that wherever this ordinance L1poaes a greater restriction upon
the u s e of buildings or premises or upon the height of buildings
or requires larger o p en spaces than are im p ose• or required by other
ordinances, ru l es, regu l a tions, or pe r mi t s, or by easements,
covenants, or agreements, the provisions or this ordinance shall
govern.
SECTION 16
CHA NGE S AND AMEi"DMENTS
The Co ~ncil may, from time to time, on itsown motion or on
pet i tion, after public notice, and hearings as p rovided by law,
amend, sup p lement, or change the boundaries or regulation herein
or subsequently established. Whenever the owners of fifty (50)
er cent or mo re of the fr ontage in any district or part thereot,
it ~hall be the duty of the Council to vote upon shuch petition
ithin ninety (90) days af t er the filing by tJle petitioners with
t h e Clerk of Council: in t 11e case a pro\e•• to .ite proposed amend-
men t, supplement, or change he presented duly signed and acknow-
ledgedby the owners of the twenty (20) per cent, or more, either
ot the a rea of the lo ts included in such proposed change, or those
immediately adiacent in the re [r thereof extending one hundred (100)
feet therefrom, or those directly opposite thereto extending one
hundred (100) feet from the street frontage of such opposite lots,
such ammend ment or change shall not -e passed except by a majority
vote or the Council.
SECTION 17
VAIIDITY
Should any section, clause, or p rovision of this drdinance be
declared by the Court to be invalid, the same shall not affect
the validity of the ordinance as a whole or any part thereof,
other than th e c a rt declared t o be invalid.
SECTION 18
ENFORC E;.t ENT
It shall be the duty of the Building Ins p ector to see that t
this ordinance is enf ~rced. Appeal from the decision of the Build-
ing Ins p ector may be mad e to the Board of Adjustment as provided
in S ection 12.
SECTION 19
VIOlA T ION AND PEt ~A : TY
Any pe rson, firm, or corporation that violates, di s b-eya
omits, negl e cts, or regus es, to com r ly with or resists the entorcea•nt
of any of th ep rovisions of this ordinan ce shall be fined not less
than Ten ~ollars ($D•OO) nor more than One Hundred Dollars ($100.00)
for e a c h offense. Ea ch day that a violation is permitted to exist
shall constitute a sep arate offense. Any buildingserected, raised,
converted, or lan d or premises used in violation ot any provision
of this ordinance or the requirements thereof, is hereby declared
to be a common nuisance may be abated in such man 11 er as nu6aancea
are now or may •ereafter be abated under ex1at1ng law,
SECTION 20
WHEN E FECTIVE
This ordinance shall be in effect from and after its passage
and legal publication.

WHEREAS, The City Council vf the City of Engl<>
wood, Colorado, deems it necessary, in order to conserve the
value of property in th e city and to encournge the most ap
propriate use of land throughout the city; lo promote health
and general welfare ; to secure safety from fire, panic, and
other dangers ; to provide adequate light and air ; to prevent
the overcrowding of land ; to avoid undue concentration of

INTERIOR LOT : A lot other than a corner lot.

NON.CONFORMING USE · A building or land occupied

SETBACK : The minimum horizontal dist.\nce between

SllCTION 15-INTERPRETATION, PURPOSE,
AND CONFLICT
In interpreting aud• applying the pr0\•i8Jona of this or•
dlnance, they ahall be be,d to be the minimum requirements
tor the promotion of the public health, safety, morals, order,
convenience, bappineaa, proaperity, and pneral welfare. It
is not Intended by this ordinance to interfere with o~ abro
gate or annul auy easements, covenants, or o!llier ~
ments between partit?s; provided, however, that wherever
this ordinance impoees a greater restriction upon the use of
buildinp or premiMa or upon the height of buil41nga or re
quirell luger open spacea than are Imposed or rEquired · by
other ordlnancea, rulea, regulations, or permit&, or by ease
ments, covenants, 1>r agreements, the provisions of this ordi•
nance shall govern.
SECl'ION 16-CHANGES AND AMENDMENTS
The Council may, from time to time, on its own motion
or on petition, after public notice and hearings as pro•
vided by law, amend, supplement or change the bound
aries or regulations herein or aubsequcntfy established.
Whenever the owneni of titty (i50) per cent or more
of the frontage in any dlatrict or part thereof present
a petition duly signed and acknowledged to the Council re
queatlng an amendment, mpplement or change in the regu
latiolUI prescribed for such dlatrict or part thereof, it shall
be the duty of i. ~e Council to vote upon such petition within
ninety (90) day,, after the filing by the petitioners with the ·
Clerk of Council: in the case a protest to the propooed
amendment, 8Upplement or changa be presented duly signed
aad acknowledged by the owners of twenty (20 ) per cent
or more either ot the area of the lots included in auch pro
poeed change, or thooe Immediately adjacent in the rear
thereof extendlr.g one hundred (100) feet therefrom, or
th-directly •oppoNte thereto extending one11undred (10u)
feet from the atreet frontage of auch oppoeite lots, aucb
amen~'llent, supplement or change shall not be paaaed ex-

SECTION 17-VALIDITY.

SECTION IS-ENFORCEMENT
It shall be tbe duty of tbe Building Inspector to oee
that thia ordinance ia enforced. Appeal from the deeiaion of
the Building lnapeetor may be made to the Board of Ad
juatment "" provided in Section 12.
SECTION 19-VlOLATION AND PENALTY
Any pen,on, firm or corporation that violates, disobey,,,
omita, negleeta or refuses to comply with or reeiata the en
forc ement of any of the provialona of thia ordinance ahall
be fined not leaa than Ten Dollara ($10.00) nor mor, than
One Hundred Dollara ($1001 for each offenae. Each day
that a violation ia permitted to exiat &hall conatltute a sepa
rate offenae. Any buildings ereded, raiaed , converted or land
or premises used in violation of any provision of thia ordip
nance or th e requirements thereof, ia hereby declared to be a
common nuisance and such common nuisance may be abated
in such manner as nuisances are now or may hereafter be
abated under existing law.
SECTION 20-WHEN EFFECTIVE
This ordinance shall be in effect from and after lta p818•
age and legal publication .
