There is hereby approved an agreeme nt titled "Agreement Storm Water Detention Area" between the City of Englewood , Colorado , and Scl1001 Distric t No. 1 , Ar apah oe County, Co l o rado , as attached hereto and i ncorporated by re fere nce as Exhibit II. I I I 4 . IIOLD 11/\llMLESS. '.l'he City agrees fully to save harmless and defend t lie District and the District's Board of Directors per,:;onally from al l s uit s , ac tions, demands, o r claims in law or in equity, arising out of the execution of this Agreement, or the use, con- struction , and maintenance o f the real property her e in described. The City shall be responsible for any liability resu lting from an y l itigation and shall pay t e costs of suit, attorneys ' fe es , appellate costs, and any other costs or expennes which may be asse ssed a gainst the District and the Di strict's Board of Director personally as a res ult of any suit, demand, or claim filed concer ning this Agre0men t. 5. OOLIG/\TIONS OF CI'l'Y. a. Purpose. 'fhe premises shall be used solely for the facility an d purpose described in pa ra graph l above or for such other purposes as the District may approve. The City will not ca rr y on or permit upon the premises any offensive, noisy, or dangerous activity or any nuisance to the public or to the adjoining neighbors. The City will pay, upon demand, any damages to the premis es caused by the mis use of same by it or its agents or its em ployees. '!'he Ci ty s hall not exercise any control over th ll routine use o f the facilities by the District. Surrender of Premises . 'l'he City sh ill , in .::ddi t ion , include the a bove -descri bed real proper t y in its i nsura nce coverage for loss resu lting from the use of said property as a storm wa ter de t ention area for lia bility in excess of the coverage maintained by the Di strict, at the City's e xp e nse.
