WHEREAS , the City Council of the City of Engle.ood declares that it i s
in the best interest of the Ci ty of Engle""°d to prohibit the pr0100tion of
obscenity within the City ; and
WHEREAS, the previous Cbsceni ty Ordinance , E.M.C. of '69 , a s amended ,
Section ll-7-7 , has been held to be unconstitutionally vague by the Engle.ood
Municipal Cour t .

(a ) Definit i ons . As used i n this section , unless the context
othe rwise requires :
l. "Material " means anyth i ng tangibl e that is ca pabl e of
being used or adapted t o a r ouse interest , ~,ether through the
medium of reading , observation , or sound , but does not include
an actual three·-dimensi onal obscene device .
2. "Cbscen e device " means a dev i ce such as a d ildo or
artificial vagi na , des igned or marketed as useful for the
sti mulation of human genital o r gans .
3. 11 Perfo rmance " means a play , rootion picture , dance , or
other exhibit ion performed before a n aud i ence .
4. "Cbscene " means material or pe r formanc e ~1ich:
a . the ave r age po r son applying contemp:,r a ry
community standa r ds would find that , taken as a ~1ol e , appeals
to the prurient inte rest in sex ;
b. depicts o r describes in a i:atently offensi ve
way
(1 ) ero tic r epr esentat i ons o( ultimate sex
ac ts , normai. or perve rted , actual o r s imul a t ed , inc luding
sexual intercour se , sodomy, and sexual best i ality , or
(2) erotic representations of masturba t ion,
excre t o ry functions, sad ism, masochism , le""1 exhibition of the
genita l s , the male or female genita ls i n a s tate of sexual
s ti mulation o r arousal , covered mal e genitals in a di scernibly
turgid s t ate , o r a de v i ce des i gned and marketed as useful
prima rily fo r s timulation of t he human genital organs, and
c . t aken as a .tiole , lacks se ri ous lite ra r y ,
a rt istic , p::,liti c. .... l, or sc i e nt ific val ue.
5. "Contem por ary commu ni t y standa rds " mea ns sta te-wide

prov i de , lend , mail , del iver, tr ansfer, tr ans mit , publish ,
distribute , circula te , disseminate , present , exhi bit , or
adve rti se , o r t o o ffe r o r agree t o do the same .
8. "Pe rson" mea ns any individ ual , coq::oration ,
assoc i ation , partne rsh i p , trustee , l essee , agent, o r assignee .
9 . 11 Know i ngly11 means having gene ral kno wledge of the
conte nt o r cha racte r of ma terial , dev i c e , o r pe r fo rm ance .
(b ) Pr omo ting obscene ma t e r ial , devices , and pe r formances
prohibited . [t i s unlawful for an y person knowingly to promote
o r p:,ssess with intent to promote , any obscene material or
dev i ce , o r to produce , present , or dire c t any obscen e
rX?rfo rmance o r pa rtici pate in a p:,rt i on t he reof rl-aat i s obsce ne
or tha t cont ributes to its ob scen i t y .

Section 2 , That an emergency is hereby declared in that the Engl e...,od
Muni c ipal Co ur t has found legislation relating t o obscene materials , dev ices
and perfor,nance , unconstitutional and the passage of thi s ordinance ls
necessa ry for the irrrnedi ate health, safe ty and welfare of the public .

of September, 1982.
