ALT ERNATE MATERIAL AND METHODS OF CONSTRUCTION
(a) The provisions of this c ode are not intended to prcvcnL Lhc
use of any material or method of construction not specifically p1·c1:ic 1·lbcd
by this code, provided any alternate has been appi:ov ed and its use. authorized
by the building official .
(b) The building official may approve any such alternate, provided
he finds that the proposed design is satisfactory and complies with the
provisions of this code and that the material, method or work offe1·cd is,
for t he purpose intended , at least equivalent of that prescribed in this
code in suitability I strength , ef f cc tiveness , fire reslstance, Jurabi! lty,
safety and sanitation.
(c) The building official s hall require that s uff icient eviJl.!1H.:e
or proof be submitted t o substantiate any c laims that may be made rc.g,ar<ling
its use. The details of a ny action granting approval of an alternata shall
be recorded and en tered in the fil es of the code e nforcement agency.
3-1 -5: MODIFICATIONS
Whenever there are practical difficulties involved in carrying uuL
the provisions of this code, the building off icial may gran t modifications
for individu al cases, prov ided he shall first find that a special individual
reason makes the s trict le tter of Lhis code impract ical a nd c.hat the modifica-
tion is in conformity with the sp irit and purpose of this code and that such
modification docs not lessen any fire prot ec tion requirement s or any degree
of structural integrity. The de tails of any action granting modifications
shall be record e d and entered in Lhc fil es of the code enfoccement agency.
3-1-6: TESTS
(a) When eve r there is insu f f icient evidence of compliance with any
of the provisions of this code or e vidence that any material or construction
does not confo rm to the requirement s of this code, the b uild ing official
may require tests as proof of complia nce to be made a t no ex pense t o Lhi s
jurisd iction.

(c) All test'li shall be made by an approved agency . RcporL i;
of such test shall b.! retained by the building officia l (or the pe rio d
required for the retentjon of publ ic record s.
3-1-7: DUTY TO COMPLY WITH CODE
(a) lt shall be the duty of a ll officers and employees of ·.nc City
of Englewood to cooperate in the enforcement of the Dulle.J ing Co de. .S uch
cooperation shall include aHy assi !;tance that may be required (oL· the en -
forcement of the Building r;ode.

(b) A variance granted by the Board of Adjustment and App ea ls shall
become null and void if the permit is not obtained and the wo rk star t eJ with in
six (6) months from the date the va riance is &ranted.
(c) No over s ight. neglect or dereliction on the part of the building
inspector or any authorized assistant shall authorize viola tion of this
code. Each day a violation is continued c,::mstitutes a separate offense.
(d) The building inspector or any employee charged with the enforce-
ment of this code, acting in good fai th and without malice for the city in
the discharge o f his duties, shall not thereby render himself liable t>cr son..il ly
and he is hereby relieved from all personal liability for a ny dama1,c that
may acc rue to person s or property .JS a result of any act rcquil·ed OL" t,y rca~.:o n
of any act or omission in t he disci,ar ge of his duties. Any suit brought
against the building inspector or cmplcycc becau se of s uch act or o mi ssion
performed by him in the cnforcemcnl: of any provisions of this co<lc s lwll IJt.:
defended by the legal departmen t of the City until termination of the pro-
ceedings .
(e) This code shall not be c onstrued to relieve from or les s en the
responsibility of any person owning, operating or controlling any building
or structure for any damages to person s or property causc<l by defect s , nor shal l
the code enforcement agency or it s parent jurisdiction be held as ..issum.ing
a'"ly such liability by rea son of Lh e inspections authorized by thi s code or
any certificates of inspection iss ued under this code.
3-1-8: DEFINITIONS
(a) The term 11 Building Code 11 shall mean thi s entire title and

Building Inspecto r in the event of the Ins pector's absence, ditrnUlliLy ur
his need for as s istants t o carry out his func tion s. The deputies s h all be
vested with such authority as the Inspec tor lawfully p osse sses .
3-1-10: IDENTI FICATION
&ach employee of thi s Division shall be provided by the City with an
identification card bearing a ph otograph o f the employee and inforn1a.tion
required by the Chief Building In spector. Such identifica tion ca rd shall
also Uea r the a uthority granted herein. Such cord shall be ca rried by the
person so identified and s hall be used when necessary to properly i dentif y
himself while pe rforming his off icial du ties .
3-1-11 : GEN ERAL POWERS AND DUTIES
(a) The Building Division shall administer and enforce t his Building
Code and all o ther ordinances and c odes which may hereafter be assigned to
tht! Division for enforcement and a dministration. There are hereby vested to
the Division the dut y of enforcing ~nd administering this Building Code and
all powers necessary for s u ch enforcement.
(b) Inspectors ; Authority . Such inspectors, a.rnistants and other
employees as shall be required and authorized in the annu al budget s hall be
ap poin ted and a ssigned to the Divi s i on in accordance with the provisions of:
the Career Service Rules as contained in t his co de . Inspectors sha ll have
s u ch a uthority a s the Chief Building Inspector lawfully posses ses in cu rry in ~
out their assigned duties .
(c) Records. The Ch ief Building Inspector shall maintain r ecords
of applic ation s for permits, permits issued, certificates of o ccu panc y,
inspections and investiga tions, applications for licens es, license::. lt:itiuct..l,
fe es collected a nd other info r ma Lio'l tha t may be required . He s ha ll make
s uch re ports to the Dirl!c to r of Community De v e lopmen t concerning th\?
ac tivities of t he Division, violat ion s of the Build ing Code and suc h o chc.:-
ma tte rs as may be required.
(d) Pu blic Inspection of Reco rds. Ge neral fi le records of the
Building Division s hall be open for pub l i c ins pection but may nor: be
removed, Specific investigation r ec o rd s on individual cases and licen s e
app lications are not o pen t o t he \JUb l i c excep t by d irec tion of the City
Ma nager or o rder of court .
(e) Author ity to I nspec t. Th e Chlef lluilding Inspector, or h.is
au tllorized repres entative I s hall have the authority to inspec t or cause
t o be inspected for complia nce wilh the Building Cod e , all buildings ,
structures or ut i lities.

for the purpose of ascertaining wh e ther the requit·ement s of th t Building
Code have been violated.
(g) Right of Entry . Incide ntal to s uch inspec tion s, invl:!::.tig..i Li uni-..
and surveys , the Chief Building Ins pector may enter into and upon and cause I
any land, building , s tructure or u t ility to be inspec ted and examine d. The
right to entry and inspection ma y be e nforce d by a\l plicat.i.o n to an<l pL·opcr
orders from a court of pro per juri s diction : accordingly rc(u s al of access
constitutes con t empt of court.
(h) Stop Orders . Whenever a ny wor k i s b e ing performed contL·ury to
the r rovisions of this Bu ilding Code. the Chief Building Inspector may
orde the work stopped by notice in writing served on any per s on ::; e nl;ahc d
in :;uch work and/or causing such work to be performed. The order s hall be
given to the own e r o r lic en see or t heir agent s. It s h ..i ll Uc unl awf11 l fu L·
any person to proceed with such work until the corrective work require d to be
pe rformed by s u c h notice is complie d with within the L.i.me s pec ified .
(i) All buildings or strucLu res regulated by this code 11hich are
structurally unsafe or not provided with adequate egr ess, or which c onstitute
a fire hazard, or are otherwise dangerous to h uman life are, for the purpose
of this section, unsafe. Any use of buildings or structures constituting a
hazard to safety, health or public welfare by reason of inadequate maintenance,
dilapidation, obsolescence , fire haz ard, disaster, darua g~ or abandonment is ,
for the purpose of this section, an unsafe use . Parapet wall s , cornices,
spires, towers, tanks, s tatuary an<l other appendages or s tructural mem b ers
which are supported by, at tached to , or a part of a building and wh.i.ch an!
in deteriorated condition or otherwi se unable to susta i n the design loads
which are specif ied in this code a r e hereby designated as unsafe bu ilding
appendages.
All such uni-..afc buil dings, st L·uctures or appendages a1·e hereby declared
to be publir nuisances and s hall be abated by repair, rehabilita tion , demo-
lition or r~moval in accordance wi t h the procedures se t forth in the O.:.int,ero us
Buildings Co.le or s uch alternate procedure s, as may have been or as ma y be
adopted by this jur i s diction. As .:in a lternative. the build ing official , or
other employee or ofiii;.ial of this j u risdiction as d esignated b y the governing
body , may ins titute any other appropr iate action t o p r event, restrain , co rrect
or aba te the violatlon.

ments are hereby made in the provisions of the Uni f orm Mech anical
Code, 1982 Editio n, he reinabove adopted:
(1) Section 304 (a ), page 19, PERIII T FEES. Add to the e nd
of the first sente nce, "o f the Unifo rm Building Co de".
(2) Section 304 (b), page 19 , PLAN REVIEW FEES. Add to
t he end of the second and third sentences , "of the Uni form
Building Code ".
(3) Section 305 (f), page 21, REINSPE CTIONS. Add t o t he end
of the sentence of the four th paragraph, "o f the Uniform
Building _Code ".
(4) Table No . 3-A, pa ges 22 , ME CHANICAL PERMIT FEE S . De l ete

(5) Section 801, page 61 , SCOPE . De l e t e "floor Furnace" in
the firs t pa ragra ph.
(6) Sectio 802 , page 61 , GENERAL . Delet e the words ,

fiftee n (15) days prior to publi c hearing and subject t <' public
inspection at al l times while said Code is in full force and
effec t. The Cierk shall maintain a t all times reason able copie s of
the Code available for pu rchase by t he public at mode rat e pr ice .
Section 6. It shall be unlawful f o r any person, firm o r
corpo rati on to ere ct, c o nst ru ct, enlarge , alter , repair , mov e ,
imp ro ve , remove , convert o r demolish , equip , use, occupy , o r
maint ain any building or structure in the City, or cause the same

this Code .
