WH EREAS , the r e i s a dispute concerning the west right of way line of South Broadway in the City of Englewood , Co l o r ado; and WHEREAS, there i s a desi re t o settle the dispute wi thout li t igation ; a nd WHEREAS , by the g r ant of an easement, the matte r will be settled to the sa ti sfaction of the parties; NO,I , THEREFORE, BE I T ORDAINED BY THE CITY CO UN CIL OF T'HE CITY OF ENGLEWOOD , COLORADO , AS FO LLC/.-IS : Section 1. WHEREAS , the above described prope rty has upon it a one- s tory brick build i ng whi ch does now and has for many yea r s encroached upo n p r o pe r ty belonging t o t he City , specifically the dedica ted rights-of-wa y known as West Oxford Ave nue and South Broadway as described on the attached s urvey cond ucted on the 3 r d da y of December , 1964 by John James Nicholl ; and WHERUS , the part i es :o thi s Agr e eme n t desi r e to fo reg o leg al proceed ings to qui et title to said e ncroachment ; NO,I , TH EREFORE , THE PART " ES AGREE AS FOLLCl,/S : 1. The City he reby g rants to Grantee , its hei rs , ass i gns and successors , an exc lu s i ve easeme nt ove r and ac ross that po rti on of South Br oadway directly East of Lo t 46 , Block 17 , Jackson 's Br oadway Heights , described as : Beginn i ng at Lhe Southeast corner of said Lot 46, then~e East O. 30 feet ; thence North 25 . 77 feet to a point 0 . 31 feet East of the East boundary of Lot 46 , Block 17 ; thence O. 21 feet West of the East boundary of Lot 46 , Block 17; thence South 25 . 77 feet to the po int J f begiMing , and West Oxfo rd Avenue to the North, to wit: Beginning at the Northeast corner of said Lot 46 , Block 17 , Jackson 's Br oadway He ights ; thence North 0 .34 feet; thence We s t 58 .20 feet to a point 0 ,02 feet North of the North boundary of Lot 46 , Block 17; thence South 0 .02 feet; thence East 58 .20 feet to the point of beginning . The within easement sha ll endure for so long as the e xi s ting building and/o r the north and/or east wall thereof remain loc ated within the said easement . Should that portion of the building eve r be damaged , relfOd e led , or r emoved , the easement shall be terminated and no longer shall Gr antee use said easement; and Grantee s hall convef ~asement to the City by qui t claim deed , 3 . Grantee shal 1 mai nta in insurance coverag e sufficient to :Jatisfy any liability arising a s a r esult o f thi s .,asement , and the City shall be held harmless from any and all liabi lities arising fr om this action . 4 .
