WH EREA S, the City Counc i 1 of Englewood, Colorado, pursuant t o the Charter and the Municipal Cod e of th e City , and the La ws of the Sta t e of Colorado , hereby finds and determine s Lh et the re exists a necessity for the creati o n of Paving Di strict No . 29 , in the City , a nd the construction and inst allation t herein of street p av ing , curb a nd gutter and s id e walk im provements, together wit h necessary incide n tals o n certain s tr eets in the City; and WHEREAS , notice of il public hearing co n cerning the creation of tile Di s trict and the con s truction and in stalla ti o n o[ the improvements t herei n has been publ ished once a week for three consecut i ve weeks in the Englewood Sentine l, a newspaper of gen er al circu ation in the City , and in addition, a notice has b een ma iled , p os tage prepaid , to each known owner of re al pro~c rt y wit h in the p. sed lli s tricL; , d WHEREAS, at the time and place set forth in the n otice, the City Cou ncil me t in open session for the purpose of hearing an y objections or p rote s t s that might be made aga inst t he proposed district or the impro vements to be constructed or installed; and WHEREAS , all prote s ts have been heard a nd cons ide red by the City Counc i l , and the Council has determined that such pro- tests should n ot be allowed ; -1 BE tT ORDAINED BY TH E CITY COUN CIL OF THE CI'rY OF ENG LE WO OD, COLORADO: Se ction 1, Creation of the Dis tr ict . That a special impro vement district for the construction, inst a llation or im- pro v ement of the impro vements hereinafter described, is hereby created and established in accordanc:e with t he Charter and the Municipal Code of the City, and the Laws of t he State of Colorado, a nd s hall be known and desig nate d a s "Pa ving District No . 2 9". All p roceedings heretofor e t a ken and adop ted in conn ect i o n wi t h the District are hereby ratified, approved and confirmed, Sec t ion 2 . ~inee ri ng Plans and Specifica tion s . The con struction u r installation of the stre e t paving, curb and gutte r and sidewalk improvem ents in and for th e District , as shown by t he plans, s pec ifi c ations and maps ther eof , approved by the City Council o f the City, is hereby authorized and ordered, the material to be used in the construction of said improvement s to be in acco rdance with suc h maps , plan s and specifications. Se c t ion 6. Assessm ent of Costs. The probable tota l co st of the i mpro vemen ts to be constructed or inst a lled i s $54 9,10 0; i t is proposed . tha t the City o f Englewood will pay approximately $200,000; t he rema i nder o f the cost will be asse ssed again st th e pro perty within th e di st ric t a nd s pecially benefited by the cons t ructi on and instal lation ,,f the improvements . The ap p roximate share of the total cost t a oe asse ssed per front foot agains t any lot or tract of land fr , 1·ti ng or a butting on said i mprovements will be as mo re particularly set forth int~~ reso lu- t i on p assed a nd adopted o n Feb ruary 7, 198 3 , and wh i ch is in co r - po rated he rein by specific r efere nce. Sect ion 7. Payment of Assessme . ts. The assessments will be due and payab l e witho u t demand within t hirty (30) days from a nd a fte r the fin al publi cation of the Ordinance assessing t h e whole cost of said impro v eme nt s a ga in s t the real property in the Di st ri ct. In the event an y owne r o f real estate s hall fail to p ay the whole of such asses smen t against his or her -3 - prope rty wit hin said thirty (30) day s , then the whole cos t of the impro vem e nt s s o a ssessed against such property s hall be paya bl e i n t e n ( 10) equ al annu a l installme nt s of pri nci pal. Th e fir s t of such installment s of principal shall be due anl 'payable at s uc h time as will be d e term i ne d in the a sse s sing ordinance a nd the remainder of s ai d inst a llments sh all be du e and payable s ucce ss ively on the sam e d ay in each year thereafter, until all are paid i n full . The r a t e o f interes t t o be paid on un pa id and defe rre d insta llm e nt ., will be esta bl ish ed by ordinance to be adopted by th e City Coun ci l at a later d a t e . Section 8. Special Improve me nt Bonds. By virtue of and purs uan t to said laws and the Ch arter and t he Muni c ipal Code of t he City , loc al imp rov e me nt bo nds o f th e Ci ty s ha ll be iss ued fo r the p ur pose o f paying for the local improvements described in th is Or d i na nce, in an amo unt not to exceed the cost and expe ns e s of sa i d i mp r o veme n t s , i nc l ud i ng e ngin ee ring, l e gal an d inc id e n t al e xpe nses , as provided by law. Hearing. In accordance with the Cit y Charte r and Municipal Code of the City, the City Counc.il sha ll hold a public hearing on this ordinance, befor~ final passage, at 7:30 P.M. on Monday, Apri l 4, 1983. Section 12. Publication and Effective Date. This Ordinance, after its final passage, shall be numbered and record- ed, and the adoptio n and publication sha ll be authenticated by the sig nature of the Mayor and the Director of Finance, ex-officio City Cl erk-Tre asurer , and by th e Certificate of Publication.
