WHEREIIS , the Ci t y of EngleWvod has e mbarked upon a prog r am of
limiting Little Dry Cr eek t o the confines of its channel in the
City of Englewood ; and
WH EREIIS , the goal i s to prevent loss of public and pr ivate
property to flood damag e ; and
WHEREIIS , School Di stric t No. 1 , Arapahoe Co un t y , Co lorado,
Englewood School s , des ires to assist in contro lling flood wa te rs in
the City of Eng l ewood to protect , a mo ng o ther things , t he school
tax base ; and
WHEREIIS , the City of Englewood desires to coopera t e with an~
prol ect the School Bo ard;

Section 2 . '!'he afo redesc ri bed Ag r eement g enerally prov ides a s
follows :
l! School 's use for ed ucati onal purpose is pararrount us e.
2) II nonexclusive easement is granted by the School Distr ict
t o the City of Englewood fo r storm wa ter deten t i on ove r p roperty
ownP.d by the Sc hool District and u sed fo r athl eti c purpose~.
3) The School Distric t shall revi ew a nd approve f inal plans
for construction of the sto rm water de t ent ion a rea .
4) City shall save and hold harmless Schoc,1 Disc.r ict and its
Board of Directo rs against a ny a n d all cla i ms aris ing f rom City 's
use of the detenti on a rea .
5) City shall not use the property in a manner that creates
a nuisance; construction and maintenance shall be coordinated with
the Schoo l Board and shall be at City 's expense; City r ecog nizes
the need for open space and shall attenpt to provide for the same
along histo ric Little Dry Creek; City shall not make alterations
unless approved by the School Boa rd; City shall cause no liens to
attach to the property ; School 's use shall not hi nd er capacity of
the storm water holding area .
6) Ci ty shall p roperly insure the property.
Section 3 • There is hereby repealed Ordina,,ce No. 21 , Se ries of

Sec tion 4 . The Mayo r of the City of Englewood , Colorado , is
hereby authorized to affix his signature to the aforedescribed
Agreement fo r and in behalf of the City Council of the City of
Englewood , Colo r ado , and the ex officio City Clerk-Tr easurer i s
authorized to attest the same.
