This Ordina nce sets fo r th uni form requ irements for d irect and indirect con t ributor s i nto t he was t e wate r collect ion and tre a tmen t system for the City and e nables it to comply with a ll applicable stat e and federa 1 laws . The objectives are: 1. To prevent the introduc tion of po llutants into the PCY1'li which will interfe r e with the opera tion of the sys t em or contam i- na te the resulting s ludge ; 2 . To pre vent the introd uction of polluta nts Into the PCY1'li whi c h will pa ss through t.'l e sy stem, i nadequa t e l y t r ea t ed , into r ece i v ing water s or the a tmosphere or otherwise be i ncompat ible with the system; 3 . To irrprove the oppo rtuni ty to recycle a ncl rec l a im wast ewaters ancl sludges Eran the system ; 4 . To prov ide for equitabl e distribution among use r s of the cost of the PO'l\-1 ; and 5 . Author ity (Control Au thority) shall mean the City of Englewood , Colorado . Authorized Representative of l ndu,;tr i a l User. An du t horized re presentative of a n industria l user may be: (a) a pri ncipal executive off i cer of at l east the level of vice president , if the indust ri a l user is a corporation; (b) a general partne r or proprie tor if the industrial user i s a partnership or proprietorship, respecti vely ; and (c) a duly authorized represen- tative of the individual designated above if such re prese ntative i s r esponsibl e for the overall operation of the facilities f r an wh ich the indirect discha rge orig inates . Bi ochemical Oxyge n Demand (BOO) sha ll mean the quant ity of oxygen utilized in the biochemica l oxidation of orga ni c ma tter under standard labor a tory proc~' ,re in five (5) days at 20 .C, expressed in mill igrams per li\ .. c . Business Classification Cod e (B:c) shall mean a cla ssi- f i cation of discharge rs based on the 1972 Standa rds Industrial Class ification Manual , Bureau of the Budget of the United States of America . Chemical Oxygen Demand (COD) sha ll mean the measure of the oxygen equiva l e nt of that portion of organic matter i n a sample that is susceptible to oxidat ion by a strong chem ical oxidant unde r la boratory pr ocedures . Chlorine Demand . The amo un t of chlor ine requ ired t o produce a free chlorine res idual of 0 .1 m:.J /l af t e r a contact time of 15 minutes as meas ured by the DPD (N , N, Di ethyl-P-Phenylene- Di am i ne) Method on a sample at a tem pera ture of 20 degrees Ce nti- grade i n conforma nce wi th Standa rd Methods . ~ shall mean the City of Englewood , Co l orado . Any person who discha r ges or causes the d i scharge of wastewater to the P(ID,I . Discharge Rate sha ll mean tha, vollllle of effluent from the pl ant whi ch has ·been determined by the Director to be represen- tati ve of the process effluent from that pl ant . Such effl ue nt will be based upon metered water usage unless , in th e opi nion of the Director , signi ficant amounts of water ar e dive .. ted and not d is- charged in to the wastewa ter treatment system . I Dissolved Solids shall mean tha t concentration of mat- ter i n the wastewate r consisting of colloidal particul dte matter one micron in diamete r or l ess , and both organic and inorganic molecules and ions pr esent i n solution. ~rtmen~ of Utilities shall mean the Department ..,;ch is responsible for the, operation and maintenance of the wastewat e r collect ion system . Danes ti c (Sanitary) Wastes zha ll mean liquid waste s (a ) fron the noncamiercial preparation , cooking ana handl ing of food or (b) containing human excrement and similar matter fran the sanitary conveniences of dwelli ngs , ccmnercial build ings , indus t ria l facili - ties , and in sti tutions . Environmental Protect ion Ag e ncy (EPA). The U.S. Envirnnmei:ta l Protection Agency , or whe r e appropriate , the term may also be used as a designation for the Admi n i strator or other duly authoc .. 7.ed off i cial of said agency . Existing ':!.'!.'!.". shall mea n an industri a l user which is in operation at the time of pr onulgation of Fede r a l Categorical Pr etrnatme nt Standards. Fecal Co l iform sha ll mean any number of organisms conmon to the intest ina l tract of humans and anima l s ..,ose presence in sanitary sewage is an indicator of pollution . Fats , Oil or Gr ease (FOG) shall irea n any hydr ocarbons , fatty acids , soaps , fats , waxes, 011:;, and any other material that is extracted by freon solve nt. Flow shall mean vo lLJTie of wastewater . Gar~ sha ll mean solid wastes fron the danes tic and canmercial preparation , cooking and dispensi,: of food , and fr an the canmerdal handling , stornge and sa l e of produce . Garbage , Properly Ground or Shredded shall mean the wastes fran the preparat i on, cooki ng and dispensing of foods that have bee n ground to such a degree that all particles will be carried free ly under the flow conditions norma lly prevailing in public sewers , with no pa r ticles gr eater than one-ha lf inch (1/2 ") in a ny d i mension , Grab Sample . A sample whi c h is taken fran a was te str eam on a one-time basis wi th no regard to the flow in the waste stream and without consideration of time. Holding Tank Sewage . Any wastewat e r fran holding tanks such as vessels , chenical toilets , campe rs , trailers , septic tanks, sea led vau 1 ts , and vacuum-p.m,p tank trucks . Incompatible (Noncoventional) Pollutant shall mean a ny non treatable waste product , incl uding nonb1odegradabl e dissolved solids. Indirect Disch~. The discharge or the introduction of nondanest1c pollutants fr an any source regulated unde r Section 307 (b) or (c) of the Act , (33 U.S .C. 1317), into the roIW (including holding tank waste discharged into the systen). Individual (Private) Wastewater Disposal Systen shall mea.' a septic tank, cesspool or similar self-contained receptacle o facility which collects and/or treats or otherwi se disposes of wastewate r and .!"lich i s not connected to the PCYIW . I ndustrial shall mea n of or perta ining to i ndustry, man ufactu ring , coome rce , trade or business , as distinguished fran dcxnest ic or residential. Industrial surcharge sha ll mean that charge assess ed against indust:r'fal custaners based upon the amount tha t the str ength of their d i scharged wastewater exceeds normal domestic strength in the parameters of BOO , mo , or TSS . Industrial User shall mean any user that discharges wast e water fran rndustrlalprocesses not to include sa.n itaq 1 wa stes . Industria l Wastes shall mean the liq uid wastes fran the industrial manufacturin9Processes , tr ade , or business as dis tinct (ran sanitary wastewate r . Int e rference shall mean the inhibition or disruption of the ro'IW treatment proce'sses or ope rations which contributes to a vio l a tion of a ny requi rement s of the PCYIW ' s NPDES Permit. The term includes prevention of sludge use or disposal by the roIW in accordance with Sect ion 40 5 o f the Act , or any c rite ria , guide lines or regulations devploped pursuant to the 5WDA , the clean /\it Act, the Toxic Substanc:es Control Act , !CRA , or mor e str ingent stat e crite ri a applicable to the method of d isposa l or use employed by the PO'IW. I Jackson Turbidity Uni ts (J'l"IJ) shall be the meaRure of the optical pr ope r t ies of a sample win di causes light to be scattered and absorbed rather than transmitted in straight lines . ~L • onal Categorical Pretreatment Standard or Cat~ical Standard ~r Pretreatment Standard (?CPS) s hall mean any regulation containing pollutant discharge limi ts pranulgate,; by the EPA i n accor daroc:e with Section 307 (b) and (c) of the Act ""1ich applies to a specific category of Industrial Use rs. National Pollutant Discharge Elimination System (NPDFS) shall mea n the program for issuing , cond itioning and denying per- mits for the dischdrge of pollutants fran point sources into the navigable waters of , the contiguous zone and the oceans pursuant to Section 402 of the Act . Nat:ona l Pollutant Discharge Elimina tion System Permit (NPDES) Perm'Itsfiall mea n a permit i ssued under the National Pollu tant Dischar ge Elimination System for Discharge of Wast ewaters to the Navigable Waters of the United States pursuant to the Act . Radiolog i cal Contro~ shall mean disposal by release into sanita ry sewer systems in accordance with Rules and Reg ulations p.,blished by Co l or ado Department of Health and the State of C0l orado . Rece~~~~~~ shall wea n l akes , rivers , streams or other water courses whi ch receive treated or untr eated wastewater . Receivi ng Water OJality Requirements . Reqt.irements for the wastewate r treatment plant effluent established by app licabl e state or feder a l regulatory agenci es for th e protection of re c e iv- i ng 1<ater quality . Such requirements shall include effluent limitations , and waste discharge standa rds , requirements , limita- tions , or prohibitions which may be esta blis hed or adopted fran time to time by state or feder a l l a ws or regula tory agencies . He sha ll see tha t such system is kept properly cleaned a nd in good working order and r e pair. He shall insure proper compli a nc e with all local , state and federal r egulations for collection o f waste wate r and shall perform all other duties in connect ion wi t h such system as may be required. 2 . '!'h e Director of Was tewate r Tr ea tme nt (M') shall be r esponsible for the manageme nt of the Bi-City and\or Englewood Wast e wate r Tr eatment Plant and a ll of the property perta ining the r e to . He shall see that such system is kept properly cleaned and in goOO working orde r and re pa ir. He sha ll insure proper comp l iance with all local , state and feder al r eg ulat ions for trea tme nt a nd d ischarge of wastewater and shall petform all other duties in connect ion with such system as may be required . 3 . The Dire ctor of Util i t i es a nd Director of Waste water Treatment may adopt rules and regulations in their re specti ve ar eas of r espons ibili ty , jointly or individua lly, consistent with the pr ov is i ons of tliis Mticle f o r the adm inist ration of the wa s tewa t e r systan . Rul e s and regu l ations adopted sha ll pertain t o , bu t sha ll not be limited to , dischar ge , limitations , pr e treatment require- ments , standards f or install ation of wast e water lines and services , and implanentation of s tandards pr 001ulg a ted pursuant to the Act. In e stablishing such rul e s and reg ula tions , they shall establish standards that wil l assure safe , e[f i c i e nt ope rat ion o f the wa ste- water systen , wastewater treatment pr ocess or equi pne nt , tha t will not h::ive an adve rse effect on the receiv ing water , or will not otherwi se e ndanger pe rsons or prope rty , or const itute a nuisance . 4 . The Di r ector of Uti 1 i t ies , the Di r ector of Wastewat e r Trea tment and the Director of Finance shall keep such records a nd prepa re such re ports concerning tl 1e wastewater utility as the City Manager d irects . The City Man age r shall keep the Ci ty Counci l adv ised of the operat i ons , financial conditions and futu re needs of the Depa r tments and sha ll prepare arxl s ubni t to the City Co uncil , at l east annu a lly , a repo rt covering the acti vities of the Depart- ments , includirKJ a s t atanent of revenues and expend itures of the preceding year . 5 . The Director of Utilities and Director of Wastewate r ·rreatment sha ll have the power to formu l ate and pranu lgate rules and regulations for the administration of this Ordi nance , such 15 rules and regulations sha ll not be incons i s t e n t wi t h provi s ions of this Olapte r. 6 . No per son shall cause to be d i scharged or mak e a con- nect ion to the l'O'IW wh ich would a llow any storm wa t e r, surfac e dra in age , g roun dwat e r , wate r fron unroo fed drains , roo f run-off, cooling wat e r or othe r wa ter into an y san ita ry sewer. No person sha ll cause any of the a bove mentioned wa t er t o be mixed with tha t person 1 s sewage in orde r t o dil ute said sewage . 4 . A toxic polluta nt shall include , but not be limited to , any pollutant ident ified pursuant to Section 307(a) o f the Act. e . Any noxious or ma l odor ous Liquids , ga ses , or solids w'hi ch either si ngly or by interaction with other wastes are su f fici e nt ·.:o prevent entry into the sewers for th~ir maintenance and r epair . f. Any substance wtiich may cau s e the PCYJW 's effluent or any other prcx1uct of the PO'I\v, such as res id ues , s ludges , or scuns , to be unsui table for reclamation and re us e or t o interfere with the reclama tion process , .. ,h e re th e POIW is pursuing a reuse and reclamation program . In no case shall a subst,nce discha rged to the POTW cause the P01W to be in noncanpliance with the s lucige use or d i sposal c r iter i a , g uidelines , or regulations affecting sludge LJse or d i sposal . 18 g . /\ny substance which w· ll cause the E'Ol'W to violate its NPDES Pe onit or the receiving water quality standards. h . Any wastewater with objectionabl e eolor not remov- able in the treatment pr ocess , such as , but not limited to , dye waste s and vegetable tanning solutions . i. Any pollutants , i ncluding oxygen dema nding pollu- tants (BOO etc.) which a user knows or has reason to know will cause inte r fer ence to the E'()'IVI. In no case s ha ll a slug load have a flow r a te or eonta in eoncentra tions or quantities of pollutants that exceed for any t ime period longe r than fifteen (15) minutes mor e tha n five (5) times the aver age twenty-fo ur (24) hour eoncen- trat ion , quantities , or f low during normal operation . j . Any wastewate r contai ning any radioactive wastes or isotope of such ha lfl ife or eoncentration as may exceed lim its established by the Di rector in canpliance wi t h a pplicable State Rules and ru,gulations Pertain i ng to Radiological Control , published by the Color ado Dep a r tment of Hea l th , State of Co l orado . k . Any wastewater which causes a hazar d to human life or creates a p.iblic nuisance and i s not contained in the wastewater system . l. Any wastewater having a tenperature whi ch will cause the temperature of the influent to the wastewater treatment pla nt to exceed 104 degrees F a nd/or inhibit the biolog i cal activ- ity in the P0'1''.'. m. Any water or waste whi ch contains grease or oil or any other substances that wi ll so lid i fy or become discernably vis- eous at temper atures between 32 deg r ees F. (0 degrees C) and 15 0 degrees F (65 .S degrees C). n. Any wat e r or waste conta in ing free , floating or insoluble oil. o . Wastes Eran septic tank pumpag e or vaults except at locat i ons permitted by the Direct<'' of Wa s tewa t e r Trea tment. p . Waters eontaining garbage tha t has not been ground or eomminuted to such a deg r ee that a ll part icles will be ca rried free ly in suspension under eonditions normally prevailing in p.iblic se.;ers . Solid pa rticles s ha ll be no more than one-ha l[ inch (1 /2") in any d imension . 19 q . Unusual concentrations of dissolved solids . r . Any wastewate r containing BOO , total solids, or sus pended sol ids of such character and quantity tha t unusual att en- tion or expense is required to handle such mate ri a ls a t the waste- wa t er treatmen t pl a nt; provided , however , that a user may be per- mitted by specific , written ag r eeme nt with the PCJ1'"1 which agreement to disc harge such BOO o r TSS may provide for special charges, sur - cha rges , payments or provis i ons for trea ting and test ing equipment. s . mmonia nitrogen or substances read ily converted there to , in amounts that would cause the PCJ1'"1 to fail to comply with its NPOF.S Permi t. 2 . Any mate ri al or substance not specifically ment ioned in this section which in i t se l f is c:o rr os ive , irritating , or noxious to hl.l'Tlan beings and animals , or which by inte raction with othe r water o r wast e in the public sewer system cou l d produce undesi r abl e effects or c r ea t e any othe r condition deleterious to structures , treabnent pr ocesses , and quality of the receiving stream , is he reby prohibited . 3 . Any ma t erial or substance ente ring into the public se'wet whidl interfetes with the treatment process even if i t is within the concentrat i on limi tations stated in 15-5-7 (A) may be prohibited upon written no t i ce by the Di r ector of Uti lities . 4. 'I'he Director o f Utilities with the a pproval of the Di r ec tor of \-Jastewate r •rr eatme nt may gr ant a variance fran the provi sions of this 01apter t o those persons ap plying for s·1ch a va ri a nce in accordance with the rules and r eg ula t ions publishe<l by the Dire c tors . Variances may be considerru uncler the following ci tclJTlstances : a . (D) federa l ~~r ical _Pr etreatme n t Standards Upon the pranulgat ion of the E'ederal categ o ri ca l Pre treatment Sta ndard fo r a particula r industrial subcategory , the Fed e ral Standard , i f more string nt than Umitations imposed he rein for sourc es i n thnt s ubcategory , shall inroedi a t e ly supersede the limi tation:. impos ed he re in . 'rhe Dir ector of Utilities shall notify all affected use r s o( the applicable repor t ing r,aqu ireme nts. 20 I (E) Specific Pollutant Limitat i ons No person shall discharge wastewa t e r conta ining poll utants in excess of the LIMI TATIONS 00 D!s:::HARGE, as set forth in 15-5-7 (II). (F) State Req uirements State requi rements and limita tions on d ischarges shall a pp ly in any case wh e r e the y a r e mor e str i ng e nt than federa l requirements and limi tat ions or those conta in ed here in. (G ) PO'JW' s Right of Revision No user sha l l inc t ease the use of process wate r or , in any way , attempt to dilute a d i scha r ge as a partia l or complete subst i- t ut e for adequa te treatment to achieve compli a nce with any appli- cabl e limita tions . ( H) Excess ive Discharge No user sha ll inc rea se the use of process water or in any way attempt to dilute a discharge as a pa r t i al or complete subs t i - tute for adeq uate treatment to achi e ve compliance wi th any appli - cable limitat ions . (I ) Acc identa l D~~~'!.':.'l~ Each user sha ll provide protect i on frnn acc i dental dis- ch arge of proh ibi ted materi a ls or ot her su bstances r egula ted he rein . Facilities to prevent acc identa l discha r ge of prohibited materia ls sha ll be provided a nd ma inta ined at the user 's own cost and expense . In the case of an accide nta l discharge , it is t.,e responsibi lity of the user t o imned i a t e ly notify the Director of Utilities a nd the PO'JW of the incident. '!'h e not ification sha ll in c l t.rle l ocation of d i schargC?, type of wast e , concentration , vollll",e , and rorrect i ve act i ons . Wi thin five (5) days following a n accidental d ischa r ge , the user sha ll ~ubm i t to the CXJ a detai l ed wr itten report describing the cause of the discharge and the measu res to be t aken by the user t o prevent simila r future occurrences . Such notification shall not relieve the user of any e xpense , l os s , damage , or other liabi lity which may be incurred as a res ult o f damage t o the l'O'IW , fish kill s , or any othe r damage to persons or property , and such user sha ll be li abl e the refor , no r shall such notif i cation re lieve tl'l e user of any fines , civil pena l ti es , or other liability which may be imposed by tbs Ordinance or other applicabl e law . Fail ure to report accidental discharges may , in addition to any other remedi es , result in tne revocat ion of tl'le discharger 's wastewater discharge permit . If tne PO'IW is f ined by the State or Federal goverrrn nts for violation of 21 the roIW 's NPDES Permit or violat ion of Wat er 0-,ality Standards as the result of a spill or inte ntional slug d i s c harge of a toxic pollutant , then the fi ne , including a ll rorw legal , sampling, analytica l t esting costs and any othe r related costs shall be charged to the responsible user . (J) Disconti nu ance of Privy Vaults , Cesspools , and Sept ic Tanks and Du thouses 1. Co nnection Required : All i mprovanents now usi ng privies , vaults , outside toilets , cesspools , septic tanks , grease traps , l ead, fields or othe r sewage disposa l f acilities in the City , or hereafter in the City , sha ll be con nected with the public sewer lines of the City or of any sanita tion district in the City, provided •,uch public sewer line ha~ been brought within four hundred f ee t (400 ') of any part of such dwelling or improvenent requiring sewage disposa l service , and provided that such connec- tion shall only be r equired ,J.,en such privies , vaults , outside t o i l ets , cesspools , septic tank s , gr ease traps , l each f i elds or other sewage disposal fa c ilities fail t o function pr operly so that the y have to be r epa ired so as to make them usable . 2 . Payment will ccmnence withi n one (1) year of the date of initiation of service through the Bi-City and/or Englewood Plant. Nonpayment: All sewe r charges and surcharges , includ- ing , but not limited to , collection charges, pretreatment charges, monitoring charges , sha ll be a lien upon the property to which sewers are connected fran the date said char ges becane due until said charges a re paid . 1'ne owner of every structu r e of prenise sha ll be lia ble for all sewer charges for uses on hi s premi s es , which lien or liability may be enforced by the City by act i on at law to enforce the lien. In case the tenant in possession of any premises shall pay the sewer charges, it shall r e lieve the landowner fran such obligations and lien , but the City sha ll not be requi r ed to seek payment fran any person whan soever other than the owner fo r the payment of sewer charges . No change of ownership or occupat ion sha ll affect the applicat i on of t his section , and the fa ilure of any owne r to discover t ha t he purchased property agai nst wh i ch a lien for sewer ser vice ex ists s ha ll in no way affect hi s liability for such payment in fu ll. Said de linquent payments, and the lie n c r eated thereby , sha ll be enforced by as sessment upon the property and premises so served and certificat i on thereof to the County Treasurer for the collection under and in purs uance as prov i ded for in th i s Code . The pl ug in the ol d pr i va te sewer must be i nspected and a pproved and a pla n r eview and i ns pection fee will be charged by t he City . (C) De sign and Construction 1h e si ze , s l ope , al i gnment , and mate ria l s of construc tion of a privat e sc·.aer , and the meth od s t o be used in excavat i ng, pl acing of pipe , jointing , test i ng , and backf i ll i ng the tre nch and all other wo r k sha ll conform to the requ irements of the Bu ilding and Plunbi ng Code or o the r appli cabl e codes , l aws , rules and regulat i ons of fed era l , sta t e , and l ocal e nti ties . The s e r vice line fran the pu blic sewer main line to the structure to be ser ved shall be insta lled by the property owne r at h i s expense . The owner sha ll hold the Ci ty harl!'less for any los s or damage that ma y direct l y or indi r ectly be occasioned by the installat i on of the service line or the malfunc:t ion of any old pri va te sewer . 32 The owner o f any property connecting to the roJW shall be r e sponsible for the maintenance of the s e rvice line fran the E>Jblic s ewer to the structure to be s e rved. The owner shall keep the serv i ce line for which he is responsible in good condi t ion and shall replace at hi s expense any portions thereof whi ch , in the opinion of the Director of Utilities , have becane damag ed or d isintegrated as t o be unfit for further us e , or is in such condi tion to permit infiltra tion '.nto the s ystem. All r e pa irs shall be canpleted within thirty (30) days after noti f ication and s hall be completed by a bonded contractor. Th e owner shall be responsible for r eturning the E>Jblic right-of-way and the street to acceptable City standard s . If a [l.lblic sewer is not available within four hundred (400) feet of the property line of the property upon which a house or building is :ocated, a private sewage disposal system constructed in accordance with applicable regulations of the Hea lth Department shall be utilized to dispose of sewage . 4 . In c .,ses \Jlere a public sewer was not previously avai l able within i:our hundred (400) feet of the property line of a property but a pu!.>iic .sewer later becanes available within such distance , the owner may be required to connect with the public s ewer as provided in part A a bove. In such event, after the connection is canpleted , the private sewage disposal system sha ll be emptied, cleaned and filloo with sand 01: dirt . 5 . It shall be unlawful for any person to deposit or discharge, or to cause to be deposited or uischargoo , to any wastewate r collection facilities any solid or liquid waste unless through a connection approved by the City . Pecnit Issuance The Dir-ec:tor shall issue a wastewat er discharge pecnit to the applica nt if he fi nds that all of the follow i ng conditions are met : a . The proposed d i scha r ge is in canplia nce with the prohibitions and limitations of Sections 15-5-2 and 15-5-7 (A ) and (Cl of this Oiapte r; b . The proposed discharge would permit the normal and eff icient operat i on of the wastewater trea tment system ; and c . The pr oposed discha rge wo uld not result i n a violation by the City of the terms and conditions of its NPDES Permit. 3 . Pecnit Denial and Appea l a . In the event an app li cation fo r a Wastewa ter Discharge Permit is denied , the Di rector of Utilities s hall noti fy the applicant in writing of such de n ial. Such notification s !,all sta te the grounds for such de nia l with that degree of specificity which will info,.m the applicant prior to issuance of a permit. b . Upon r eceipt of notificat i on of denial of a pecnit application, the applicant may request and shall be granted a hea ring to be held by the Director of Utilities . At such hea ring the applicant sha ll have the burden of establishing that the cond itions set ou t in this 0-apte r have been me t and tha t a permit should issue . The hearing shall be held wi thi n thirty (30) days of applicant 's request but may be continu ed upon a showi ng of good caus e to do so by either the City or the applica nt. c . Users shall compl ete and file with t he Direceor c f Utilities an application in the form prescribad by t he Division antl accompanied by a fee as set forth in Schedule e . In support of the application, the user shall submi t , i n uni ts and terms appr ... pr iate for eva luation , the following info r.c1t-.on : a. Name , address, location of discha r ge (if differe nt fran t h o addr e ss) , b . SIC number according to the Standil:d Industrial Classification 1-Bnual , Bur eau of the Budget, 1972, as amended . c . Time(s) and d uration of discharge . d . Site plans , floor pla ns , mecha nica l and plunbing plans and details to show all sewers, connections, and appurtenances by size , locati on and elevation . If deemed necessary by the City , such plans shall prov ide for sepa r ate systems for handling sanitary and industrial wastewate r . Nonresidential buildings may be required to have i nstalled a sewer sampling manh o l e fo r City access t c, its wastewater being dis=harged to be installed per City engineering requ i rements. e . 'l'he Director of Utilities shall require a signif icant industrial user lo obtain an Industr ia l Permit, T;ll existing signi ficant industr i al users sha ll apply for an Industrial Permit prior t o Decanber 31 , 1984 , and proposed new significant industrial use rs shall apply at l east ninety (90) days prior to connecting to or contributing to the PO'!W . Users sha ll complete and f ile with 36 I I the Director an application in the form prescribed by the Depar tment and accanpanied by a f ee as may be required, containing information, in addition t o that required for a General Permit , in uni ts and terms appropriate for evaluation , as follows: a . Wastewater qu a ntity and quality . Persons or occupants of premi ses where wa stewate r is created or d i schar ged shall allow the Director o f Utilities or his representatives ready ac:~.ass at all rea sonable times t o a ll parts of the premises fo r the purpose of inspect ion , sampling , records examination , or t 1 ,e performance of othe r duties . (B ) Not ificat i on of Violation When ever the Di r ector of Utilities fi nd s that any person has viola ted or i s viol at ing thi s Olapter , or any prohibition limitation or requ ireme nt conta ined herein , he may serve upon such person a wr itten not ice s t a ting the na ture of the violation and prov iding a reasonabl e time , not t o exceed th irty (30 ) days , for the sat isfactory co rrection thereo f. l\ mee t ing with the Director of Utilities may be scheduled at the r equest of the violating person or the Di r ector of Utili t i es to discuss the viol ation and/or satisfactory correction s chedule . (C J ~thods of Noti fica1:_ion Any not ifica t ion requir ed he re in sha ll be served either persona . ·• or by registered or certified maU. The City may suspend the wast ewate r trea tment service and/or a v'astewa t e r Di scharge Perm it when such suspensi on is necessary, in the opinion of the Director of Ut ilities and/or Di r ector of Wastewater Treatment in order to s top an actual or th reat e ned discharge which pr esents or may present an imninent or substanti a l endangerment to the hea lth or we lfa r e of persons , to the env ir onment , ca uses interfere nce t o the ro rw , or causes th e rorw to vi o l ate any condi t i on of its NPD ES Permit . Any person noti fied of suspensi on of the wastewater t r eatnent serv ice and/or the Wastewa t er Discharge Permi t shall immediately stop or eliminate the di scha r ge . In the event of a failur e of the user to com ply volunta r ily with the suspensi o~ order , the Di rector of Uti lit i es may take such steps as de emed necessary , including imnedia t e severanc e of the s ewe r con nection , to pr event or mi nim ize damage to the rorw or endan germent to any individua l s . The Di r ector of Uti l ities shall re ins tate the Wastewat er Discha r ge Permit rmd/or the wast ewat e r treatment se r vi ce upon pr oof of the e limina tion of the nonconpl ying discharge . The user s ha ll pay a ll rorw costs and expenses for any such suspensi on and rest or ation of serv ice . A de t a iled wr itten statement subm itted by the user describing the caus e~ of the harmfu l. contri buti on and 44 I the measure£, taken to prevent any future occurrence shall be submitted to the Director of Utilities within fif•een (15) days of the, date of occurrence . (E) Permit Revocation Any user who violates the following condit i ons hereof, or applicable state and fede ral regulations , is s ubject t o having his permit revoked: 1. Failure of a user to cepc,rt factually the wastewater constituents and dlaracteriotics of its discharges ; 2 . Failure of the user to r e~rt sig nificant changes in operations or wastewater cons tituents and dlaracteristics ; 3. RefuGal of reasonable dcces:; to th e use r 's premises for the purpose of inspection or monitoring; 4 . Viola tion of conditions of the permit or this Ordinance or any final jud icial order ente r ed with respect thereto; 5 . Failur e, to pay any fees or charges; 6. Tamperin, wi t h , disrupting , or dest roying Ci t y equipment as determ ined by the Director, which determ ination aha ll be conclusi ve; 7 . Failure to report an acc idental di scharge of a toxic pollutant. (F) Lega l Action Authorized If any user d i scha rges in to the roJW -:ontrary to the provis i ons of this O,apter, federal or state pre t r ea tment requin."r,e nts , or any orde r of th e Cit.y, the City At torney may conme nce an act ion for appropriate l egal and/or equ itable relief , including a petition jn a court of competent jurisdiction for a tempor a ry restraining'· or der , prelimina ry and permane nt inj unction aga inst the violat i on . (G ) Te rr.,jnation of Se rvi ce The City may terminate or cause to be t e rminated wastewate r tre atment se rvice to any use r for a v iola tion of any i;>rovisions he re in . (H) Ci vil Li a bilit:x_ for Expens es 45 Any person violating the pc ovisions herein shall be liable for any expense, loss or damage caused the city by reason of such v i olat ion, including the increas"-~ costs, if any , for managing efflue nt and/or sludge , whe n such i nc reases are the result of the use r's discharge of toxic pollutants . The Director shall add such charge to the discharger's treatment charge . (I ) Civ il Fine Pass Through In the event that a user discharges such po llutants whi ch cause the Ci t y to viol a t e any condition of its NPDES Permit and the City is fined by EPA or the State for such violation , then such user shall be fully liable for the tota l iE!Ount of the fine assess ed against the City by EPA and/or the State , (J ) Criminal Penal.. ,nd Fines_ Any person who viol ates the provisions of this Olapter sha l i be subject to a fine of not more than Three Hundred Dollars ($3CO) or by im prisonment in the County Jail f c a period of not more than ninety (90) days , or by both such f i · e and imprisorment , for each violation. Each day in whi ch any such v i ola ti on shall conti nue shall be deemed a separate offense. (K) Appropriate Civil Pe nalties In addition to the penalties provided herei n, the City may recover reasonable attorney 's fees, court costs , court repor ters ' fees , a nd other expenses of litigation by appropriate legal action agai ns t the user found to have viol ated any prov isions he rein , or the orders , rule s, regr.l ations , and permits issued hereunder. The a ttorney for the City , upon request of the City Co uncil, shall petiti ')n an appropriate cou rt to im pose, assess , and recover such sums. Any person who shall violate a ny prov ision of thi s Olapter shall be sub J ect _o imned i ate d isconnection of t he sewer servicing the ~co perty upon or in connection with which the violation occ urred .
