WHEREAS , through Iesolution No. 16, Series of 1982, the City Council directed the Englewood Urban Ienewa l /\uthori ty to pre pare an Urban lenewal Plan consistent wi th the adopted Downtown Plan; and WHEREAS , the Urba n Renewal Authority prepar ed t he Downtown Redevelopnent Pla n; and WHEREAS , the Englewood Planning and Zoning Cmrni ssion r ev i e wed t he Plan a nd found it consi stent with the goals of the Engle wood Con pr ehensive Pl a n and passed Reso lution 1 , Series of 1982 , on Ju~y 20 , 1982 ; a nd WHEREAS , the City Council rus received ccmnents fran individuals businesses and goverrmental entities and t aken these carmen '.s into considerat i on in formulati ng the Plan; and WHEREAS , the City Counci l anended the Plan on December 21 , 1982, March 26 , 1984 and April 30 , 1984 (the Plan , a s so anended, being her ein referred to a s the Urban Iene wa l Plan); and WHEREAS , a n independent market ana l ysis by a r epu tabl e firm '.Brown e , Bortz & Coddington) indicated a strong ma rket exists which may be captured if a canpr ehensive approa ch is undertaken; and WHEREAS , a fina nci a lly a ttractive method exi s ts to fun d red e velopnent utilizing Tax Increnent and other financing ; and WHEREAS , an inde pende nt financi a l a nalysis by a reputa ble firm (Laventhol & Horwath) shows adequate tax incranents and other revenue sources to co ver debt serv i ce needs ; NO,I , THEREFORE, BE IT ORD'\IN ED BY THE CITY COUNCIL OF THE CITY OF Et,l;LEl,000 , COLORADO , AS E'OLLCMS : Section 1. Notice as r equired by Colorado Revised Sta tutes , 31 -25-107 (3), has been properly given on the J uly 28, 1982, August 4 and 11 , 1982 , October 27 , 1982 , Februa ry 29 , 1984 , March 7 , 1984 , March 21, 19 84 , March 28 , 1984 , Apr i l 4 , 1984, and will be given June 13 , 1984 in the Engle wood Sentinel having a general circula tion in the City of Engle"°;xl , which notice described the time , d ate , place and purpose o f the hea ring on the Urban Rene ""l Pla n a nd its amendme nts and generally identiLed the Urban Iene ""l area covered by the Plan a nd outlined the general scope of the urt-a n Renewal project under conside r a tion. Section 2. Ql the 23rd day of August , 1982 at the 1,our of 7:30 P.M. in City Council Oiambers in City Hall at 3400 s. Elati Street, l'Ilglewood, Colorado 80110 , City Council he ld a public hearing as required by CRS 1973 (as .mended) 31-25-107 (3), on the Urban Renewal Plan/Downtown Red evelopnent Plan. Prese nted at this meeting was an Urban Renewal Plan titled Englewood Downtown Redeve lopnent Plan. Sect ion 3 . 'Il1 e proposed Urban Renewal Plan inclu:les t he follow- ing a rea : Bounded on the west by South Santa Fe Drive, on the north by West Flo)d and Easbnan /\venues , on the east by the South Broadway/South Lincoln alley , and on the south by U.S. 285 . In addition to this area is the e ntire right-of-way of Little Dry Creek e a st to South Clarkson Street and adjacent land . 'Il1i s a r ea is bounded by the U.S. 285 right-of-wa y on the north, Eas t Lehigh Avenue on the south , South Clar kson Street on the eas t , and South Sierman Street on t he wes t. Also , the a rea north of U.S . 285 a l ong the Little Ory Creek right-of-way is inclu:led. Section 4. 'Il1 e scope of the Urban Renewal Plan inclu:les t he acqui- s1t1on of r:eal proper ty , i nc lu::ling any easanents or rights-of-way , the construction of public improvanents, the method or methods of financing the public improvanents, the relocation o f individuals and businesses within the l'lan area and developnent or redevel op- me nt of priva t e property . II full and comple te CO'f'i of the Urban Rene wal Plan is on file with the Clerk of the City of l'Ilgle wood and the l'Ilgle wood Crnrnun ity Developnent Deparbnent. Section 5 . '!11 e Ci ty Co unc il of the City of El1gle .ood finds that the Urban Rene wal Pla n , known as the Downtown Redevelopnent Plan , meets the following c rite ri a of State sta tute: (a) II feasible method exists fo r the r e location of businesses , ind i v idua ls and fanilies who will be displaced by the Urban Renewal project in decent, safe , a nd sanitary d.ell ing acccxnncxl ations o r f ac ilitie s within their mea ns and without undue hard ship to such bus inesses , indiv iduals or families ; (b) The Urba n Renewal Pl an co nforms to the ge ne r a l P' ·n of the municipality as a whole; a nd (c ) Th e Ur ban Re ne wal Pla n will af ford maximum oppo r- tunity , consisten t wi th the soun d needs of the muni c i pal ity as a whol e , for the rehabilitat i on or redevelopnent of the Urban Renewal area by private enterprise . Sect i on 6 . II feas ible me tho<l e xis ts fo r t he fina ncing o f s a id I Urban Renewal project ut ili zing the tax allocat i on fi nancing plan described i n Section 31 -25-107 (9), CRS 1973 (1 977 repla canent Vol u ne 12 ), as amended by Senate Bill 14 2 which became ef fec tive on July l , 1981. Section 7 . I n accordanc:e with the r equ iranents of Section 31 -25-107 (9) (d), CRS 19 73 (1 977 replacanent Volune 12 ), (as amended ), School District No. l , Ara pahoe County , Colorado , has been peonitted to partic ipa t e in a n adv isory capacity concerning project financing described in the Ur ban Renewal Pl an. Section 8 . Based on the r ecord befor e the Counci l, incluling , but not limited to, the Redev elop,ie nt Area Justifi cation whi ch was canpiled by the Depa rtme nt of Ccmmnity Develop,ient fo r the City of Englev.000 , dated April , 1982 , it is hereby found a nd deteoninecl that the Urban Re newal area described i n the Ur ban Re newal Plan consists of a b lighted area , as def ined in the Ur ban Renewal Law , wh i ch is appropriate fo r an urban renewal project pursuant to the Urban Re newa l Law of the Sta t e of Co l or ado . Sect ion 9. '111 e contemplated acquisition require s govermiental act ion because of b lighted conditions in the area. Section 10. '111e Ur ban Renewa l P:.an is hereby ra tified , and the Engle=od Urban Rene wal A:rthodtf i s authorized to take a ny and all appropri a t e action as prcwidecl b y the Urban Renewal Plan . Sect i on 11 . Hearing. In accordance with Section 40 of the City Cha rter , the City Co un c il shall hold a publi c hea ring on this Ord inance , before f inal passage , at 5 :00 P.M. on '111ursday , June 28 , 1984 . Section 12. '111e Ci ty Counc il finds and de t e onines that the Engle lNOod Urban Renewa l /\uthority is immediate ly pr e;,a red to unde rtake f ina ncing pursuant to t he Urban Renewal Pl an and that ratification of the foregoing will serve to s uppor t a nd f ac ilita t e ac t ion by the Eng lelNOod Urban Re newal /\uthor i ty .
