4 . l\ccess . Grantee s hall have the perpetua l, nonexclusive
right of ingress and egress in, to , over , throu;ih arx:1 across the
Easene nt Property for a ny pur po se necessary or desi r able for the
full e njo)'Tl ent of the rights gr a nted to Gra ntee under thi s Gr a nt.
5 . Restoration . Grant ee agrees that after th e construction ,
mai nte na nce , repan , repl acan e nt , or e nl a rganent of any of the Li nes
and Appu r tenance s , Grantee shall restore the sur (ace of the Easenent
Property as nea rly as reasonably possibl e to the> grade a nd cond i t ion
i t was in inrnediate l y pr ior to said constroction , maintenance ,
repa ir , replacan ent , or enlarganent , except as may be necessay to
accorm od ate the Li nes and Appur tenances . Gr antee agrees to res tor e
and repa ir a ny improvenents of Gr anter on the Easenent Property

6 . SU bjacent and La t e ral support. Grante r covenants and
agrees that Grantee shall have the :1ght of subj acent and later al
sapport on the Easenent Prope r ty to whatever extent is necessar y or
desirable for the full , conple te a nd undistur bed enjo:,ment of the
rights gr anted to Gra ntee unde r this Gr a nt.
7 . Rights of Gr a n tor . Gr a n tor reserves the full right t o the
undisturbed owner s hip , use , a nd occupancy of the Easenent Proper ty
insofa r as said D'wflersh i p , use , ana occupancy is consistent with and
does not impair the rights granted to Grantee in th is Gr a nt.
8 . Abandom ent . In the event that Grantee sha ll abandon the
rights granted to 1t un der this Gran t , all r ight , title and interest
he r e under of Gr antee shall cease a nd t e ominate , and Grantor shall
hold Eas enent Property, as the same ioay then be , free fran the
rights of Grantee so a bandoned and sha ll own all mater ia ls and
structur es of Grantee so aba ndoned , provided that Gr a ntee sha ll have
a r easonable period of tim a fter sa id abandonm e nt i n which to
rBTlove any o r all Lines and Appurt e nances fran the &sanent
Property . In th<> ev e nt that Ea senent is aba ndoned by Gr a ntee ,
Gr antor shal l have --ne rig ht , at i ts sol e option , to requir e Gr antee
to ranove or neutr alize any improvem e nts ~o nstrocted in the E'asanent
by Grantee.

Grantor is the f ee simpl e owner o ( the Easenen t Property and tha t

Granter has full right , title a nd authority , that this Grant is
effective to grant and convey to Gr an tee the Water Line Easanent ,
and that this Grant of dn ea,;anent is superior to a ll other grants .
Granter further covenants and agrees to indannify, defend and hold
Grantee haonless Eron and agai nst any <>:!·:e rse cla im t o the title of
the Easanm t Propert y by a ll and every per son or persons l awfully
claiming or to c l aim the wh ole or any part thereo~.
10. Binding Effect. Thi s Grant sha ll xtend to and be
;;ind ing upon the heirs, persona l repr esentatives , successors and
