Section l. There is hereby approved the attached easemen t for
Public Service O:mpany to install a gas service line to a new
portion of the Encllewood wastewater Treatment Pla nt expansion.
Said easemen t is incorpora ted herein and ma::le a part hereof by
reference .
Section 2 . City Counc i 1 a~thor i zes the l\ayor to sign a r<l the ex
officio City Cl e r k-Treasurer to attes t said easement for a nd on
behalf of the City Co unci l and the Ci ty o f Englewood .
Introduced , r ead in fc:11 , and passed on first r ead ing on the
17th day of December, 1984 .
Published a s a Bill for an Ordinance on Lhe 19th day of
ember , 1984 .
Read by title and passed on fina l reading on the 7th day of

6 . SUbjacen t a rd La ter a l suppo r t. Gr a ntor c ovenants and
agrees that Grantee shall have the r i g ht o f subj acent a nd l a t e r a l
s upport on the Ea sem e n t Property to wtiatever ex t e n t 1s n'!Cessa r y or
desira ble for the fu ll , c011plete and urdisturbal enjoyment of the
r i ghts gran ted to Grantee urder this grant.
7 . Ri ghts of Gran tor. Gr a n tor reserves the full right to
the undisturned ownership , use , and occupa ncy of the Fasenent
Proparty insofa r as sa id owner shi p , use , and occupancy is
consistent with a nd does not impair t he rights granted to Grantee
in this Grant.
8 . No Improvements . Gr a ntor covenants a nd ag r ees not to
construct , e rec t , place or plan any "Improvanents , 11 as hereinafter
de final , on the Easement Proper ty wi t hout obtai n ing the prior
written c onsent of Grantee . 11 Improvanents11 sha l l mea n any
structur e or building . Grantee shall have the r ight to remove ,
without any liability to Gr anter , any improvanents constructed ,
e r ected , placed or planted on the Easenent Property wi thout
Gr <1 ntee 1 s having obtaine:1 the prior wri tten consent of Gran tor .
9. /\bandonment. Ir. the event that Grantee shall aband on the
r ights grantP.Cl to it under this Grant , all right, title and
i nterest hereunder of Grantee shall cease and termi nate , and
Grantor sha ll hold the Easement Prope rty , as the same may then be ,
free fra,, the rights of Grantee so abandoned and shall own a ll
mate ria ls and structures of Grantee so abandonal , prov ided tha t
Grantee shall have a reasonable, pe riod of time after said abandon-
ment in which to renove any or all Lines and Appurten anc es fr001 t he
&lseme nt Proper ty . In the event that Easement is a b a ndoned by
Grantee , Gran tor shall have the right , at its sole option , to
require Grantee to renove or neutralize any improvanents
constructed in the Easement by Grantee .
10 . Warranty of Title . Granto r warr a nts a nd represe,1ts that
Grantor is the (ee simple owner o( the Easemen t Property and that
Grantor has full right , titl e and authority , and that this Grant is
effective to gran t and convey to Grantee the Utility Easemen t.
Gran tor further covenants and agrees to indenni fy , defend and hold

Gcantee harmless fran and against any adverse claim to the t i tle of
the Ea5"51\ent Property by all and every person or persons lawfully
claiming or lo claim the \oklole or any pa r t thereof.
11. Biooing Effect. Th is Grant ~hall e xte oo to aoo be
biooing LtXJn the heirs, personal representat ives , successors aoo
assigns of the respective par ties hereto. 'Ihe terms , covenants ,
agreements and rooo i tions i n thi s Gr a n t shall be construed as
covenants running with the l aoo .
