includes any s ewer that conveys wastewater to the POIW treatment
plan ts , e xcept private sewers . For the purposes o f this Chapt er ,
POIW shal I a lso include a ny sewers that convey wastew,te r to the
PO'fW fran pers o ns outside the POIW boundaries who ar,, by con t r act
or ag r eanent with t he P01\v actually users of the P01\v •
Significa nt lndus trial USer . Any industrial user of
the Ci ty 's wa ste wate r treatment sys tan whose flow (a) exceeds
twenty-five tho usand (25 ,00 0) gallons per day, or (b) exceeds five
percent (5 %) of the daily capacity of the trea tment sys tan, (c) is
subject to a surcharge for excessive 000, COO and/or TSS as
provided for i n this O\apte r , (d) has toxic material in its waste
stream in toxic amounts as defined in s tandards issued und er
section 307 (a) o f the Act, or (e) i s determined by the Directo r,

15-5-2 : GE NERAL REGULATIONS

Each use r sha ll prov ide protec tion fran accidental dis-
cha rge of prohi bi ted mate ri a ls or o the r substa nces r egulated
here in . Facil ities to prevent accidental d i scharge of prohibited
materials shall be provide:l and mainta ined at t he user 's own cost
and e xpense . In the case of a n acc iden ta l d i scha r ge , it is the
r esponsibil ity of the user to ii,rnedi ately ncti fy the Di r ector of
Utilities and the roJW of the incident. IF TH E DISCHARGE CXX:URS TO
TH E PORTIO N OF THE POTW WHIC H ULTIMATELY DI SC HARGES TO THE METRO
TREA'!M EN'l' PLAN'!', MET RO MUST M.SO BE NOTIF l8D IMMED IA TELY . '!he

other danage to persons or property, and such user shall be lia ble
there for, nor shall such notification r e lieve the user of any
fine s, civil penalties, or other liabili t y 1,nich may be imposed by
thi s Ord i na nce or o t her a pplicable l aw. Failure t o report
acciden tal di scharges may , in addition to a ny ol:her ranedie s,
result in t he revocation of the discharger's wastewater discharge

(d) If any water or was t es a re dischargAd , o r are p roposed to
be di scharged to the public sewers , wh ich waters con tain the
substances or possess the cha racteristics e numerated in Subsection
15-5-2 (b) above a nd , in the judgment o f the Di rector of Uti lities ,
may h a v e a delete rious effec t upon the sewage works , processes ,
equ ipt1e nt or recei·;ing wate rs , o r wh ich otherwise c reate a hazard
to life or constitute a public nuisance , the Directo r shall a l so
charge the fo llowing fees :

given to the tota l surcharge.

{a) (2) (C) The proposed discharge would not result in a

(a) (3) Permit O,,n ia l and Appeal
(/\) In the even t a n applica:i on for a wastewater
discharge permi t is denied , the Directo r of Uti lities shall notify
the appl icant i n wr iting of such denial. Such notification shall
state the ground s for denial with that degree of specificity which
will in form the applicant OF TEE MEASURES CR /ICT ION.5 WHI CH MUST BE
TA KEN BY THE APPLt C/\ITT prior to issuance of a permit.
(c) Ind ustrial Permits

zhould normally be situated on the industr i a l user 's
pranises, but the City may , whe n such a location
would be impractical o r cause undue ha r d sh i p on the
industrial user , allow the f acil.ity to be
constructed in the public street or sidewalk area
and located so tha t it will not be obstructed by
landscaping or parked vehicles. '\t\e facility should
be capped wi th watertight lid and that facility
shall not be l ocated in street or gutter .

The City may susperd the wastewater treatment service
and/or a Wastewater Discharge, E\lani t when such
suspens i on is necessd ry, in the opinion of the Director
of Utili t i es and/or Di r,ac t o r of Wastewa ter Tn ,Jtmen t in
order t o stop ;a n actual or thre atened d i scharge which
presents or may pres~nt an inminent or sub stantia l
e nd angeanent t o the health or lfa r e o f persons , to the
envirol"ITlent , causes inte rfe rence to the fO'I\-J , or causes
lhe PO'IW OR Tli E METRO DIST~ICT t o violate a ny condition
of its NPDES Aeanit.
Any person notified of suspension c,f th~ wastewater
th r ea tme nt service and/or the wastewater discharge
peauit shall inrnediately stop or e liminate the
clischarge . In the event of a failure ?f the user to
cn:nply vo l unta ril y with the suspensi on order , the
Di r ector of Utilities may t ake such steps as .'eened
necessary , includ ing imnedi a t e sever ance of the sewer
co nnect ion, to pr event or minimize dcrnage to the R)'IW or
endang eanent to a ny i rd i viduals , The Di recto r of
Uti lities shall r e instate t he wastewa ter discha rge
peanit a nd /or the wastewate r treatment ser vice upon
proof of Lhe elim ina ti o n of the noncanplying di scharge .
The user sha ll pay all PO'IW ccst~ and expenses for any
su ch suspension and restorr1tio:1 of serv i ce . A detai l ed
written statanent subni tted by t he user describing the
causes of the harmful contributi ion and the measu r es
t,1ke n to prevent any future occ ur rence shnl l be
s ubni t ted t o the Di rector of Uti li ties within fifteen
(15) d a ys of the date of occurrence .
