1985, AS AMENDED.
WHEREAS , the Colorado Court of Appeals , in the case of
Martinez v. Kirbens, No . 83CA1357 , CA ; P.2d ,
(decided Jun~l:985), held that anrunTcipalcourt may not impose
a sentence of probation for any longer t <,on than the l ength of
imprisonmen t that could otherwise be imposed for the same municipal
ordinance violation; aOO
WHE REAS , i t i s deaned necessary by the Englewood City Council
t o prov ide the Eng l ewood l'\m ici pal Court Judge with a uthority to
impo se a sentence to probatio.1 in excess of ninety days by increas-
ing the rnaximum p.mishment the l'\micipal Court can impose;

enfo r cenent of any provision of this Code o r any secondary
code adopted herein , and .tiere no speci (ic penalty is
provided therefor , the viol ation of any prov ision of this

Sectio n 2. '!hat Title VII, Chapter lA , Section 2 , Sub-
section C. of Englewood f'\Jni c ipal Code 1985 is hereby amended to
read as follows:

e• ea~ violating a ny provisions of this Section shall , upon
the first conviction , be subject to the payment of a fine
of not less than fifteen dollars ($15); upon the second and
subsequent conv iction shall be fined a s un not less than
t ·.enty-fi ve dollars ($25) oor more than one hundred dollars
($100); and upon the third and subsequent convictions shall
be fined a n anount not less than one hundred dollars ($100)
nor more than ef\Eee A\IMEeei <ieUaE6 t~39Gt FIVE HUNDRED
DOLLARS ($500) and be subject to not more than R>Reley

B, of Englewood t>lm 1 ·ipal Code 1985 is hereby amerooo to read as
follows:
