WHEREAS , the City has been working with the Urban Drainage and Flood
Control Distri ct and the Colorado Oepartrrent of Highways on the final design
of prcposed irproverrents to oartrrouth and Santa Fe with particular regard to
Little Dry Creek , to prevent flood erosion, to construct structural
inproveircnts to the channel, and to protect the future bridge; and
il~IERE:AS , during design of the road i.-;proverrents, it was detennined by
the Utilities Departr-lent that the City .ould benefit by upgrading the size of
the e-~isting waterline fran a 12" to a 24" line during the relocation by the
Colorado Oepartnent of Highways, and the Highway Department is willing if the
lltilities Departrrents pays the difference in cost;

Section 1. 'Ihe contract between the City of Engle,,ooct and 'Ihe State
Depar t:r.ent of Highways, Di vision of Highways, for relocating and upgrading the
existing 12" waterline in Darbrouth in connection with construction of
L,l)rovernents to the box culvert outlet and rechannelization of Little Dry
Creek is ,iwroved. Said contract provides generally:
1. ~e 1•.ork uneer the contract is for rechanneli.zation of Little Dry
Creek and t.'le replacerrent of 700 linear feet of 12-inch waterline
beneath IlartJT'outh Avenue east of Santa Fe Drive with a 24-inch
waterline.
2. 'ltle City shall prepare the plans and ~pecifications of the waterline
replacen-ent; the State shall prepare th.i plans fm: rechannelization
of Little Dry creek.
3. '!he estimated total cost of the waterline replacerent is $45,535
with the City's portion not to exceed $31,045, pay.lble in a lunp sun
wit.'1in 30 days after ccnpletion and final acceptance of the
waterline replace,:ent by the State and the City.
4. 'ttle estimated toted <>0st of the rechannelization of Little Dry Creek
is $575,000 with t.'le City's portion not to exceed $250 ,000 unless
increased by a written Sllpple:rent to this contract. If the actual
cost is less than $500,000, City's portion will be 50,. of the actual
costs.

5. 'Ille City's share of a ll project costs incurred is not to exceed
$201,045 unless such arrount is increased by a written supplerrent t.o

6 . 'Ille term of the contract shall continue through written acceptanc.-
of the wo rk by the State an d receipt of final paynent fran the City.
Section 2. 'l'he Mayor and City Clerk are hereby authorized to sign and
uttest said contra,,t for and on behalf of the City Council an d the Cit.y of
F,iglewood.

~-LITTLE DRY CREEK CHANNELIZATION
CONTRACT
THIS CONTRACT, made this ___ da y of 19 __ , by
and between the Sta.e of Colorado for the use and bP.nP.fit of THE STATE
DEPARTMENT OF HIGHWAYS, DIVISION OF HIGHWAYS, hereinafter refereed to
a s th e State, and the CITY OF ENGLEWOOD, STATE OF COLORl\00 ,
hereinafter referred to as the Loc ~l Agency,
WHERl;:AS, authority exists in tb11 1.,,w and Funds have been budgeted,
appropriated and otherwise made available, and a sufficient
unencumbered balance thereof remains available for payment in Fund
Number 2001, G/L Account Number 52046, Contract Encumbrance Number
88703 ; and
required approval , clearance and coordination has been
from and with appropriate agencies; and
WHEREAS, t he State anticipates a construction project for the
rechannelization of Little Dry Creek and the replacement of 700 linear
feet of 12-inch water line beneath Dartmouth Avenue in Englewood,
Colorado ; a nd ;
WHEREAS, the project will be completed in conjunction with and is
physic a lly adj a cent to two State highway improvement proj e cts, Project
No s . CXFCU(GF) 10-0085-09 and RRS 085 -2(44); and
WHEREAS , the State and Local Agency consider it to be in their
mutual interest to cooperate in accomplishing the project; and
WHEREAS, the cost of replacement of the WG t er line ~nd the cost of
the cechannelizat i on of Li ttle Dry Creek shall be shared between the I State and Local Agency ; and
WHEREAS, the Local Agency desires t~e size of the water line be
increased to a 24-inch water line: and
WHEREAS, the State has agreed to install a 24-inch waterline to
coplace the existing 12-inch water line: and
WHEREAS, the Local Agency will reimburse the State for the costs
that are attributable to the increased size of the proposed water
line: and
WHEREAS, the State Highway Commission on April 21, 1988, gave
approval for the State to enter into a contract with the Local Agency
for Project cc 10-0085-08, thereby accepting Local Agency funds for
the project: and
WHEREAS, the State and Local Agency desire to agree upon certain
responsibilities with regard to the project: and
WHEREAS, the contract is executed by the State pursuant to the
provision of Section 43-2-144, C.R.S ., as ame~ded; and
WHEREAS, the Local Agency has executed this contract under the
authority of · an appropriate resolution attached hereto and made a part
hereof.
NOW, THEREFORE, it is hereby agreed that:
1. The work under this contract shall be the rech,,nnelization of
Little Dry Creek and the replacement of 700 linear feet of
12-inch water line beneath Dartmouth Avenue, east of Santa Fe
Drive, in Englewood, Colorado. Said water 1 ine repla,~ement
will be by installation of 700 linear feet of 24-inch
waterline.
2. The plans and specifications for t 'le water line replaceme11t
shall be prepared by the Local Agency and made a part of this
contract by refecen_ce.

3 , The plans and specifications toe the cechannelization ot
Little Dey Creek shall be prepared by the State and made a
part of this c>ntract by reference .
4. Th~ State will provide liaison with the Local Agency through
the State's District Engineer, District VI, located at
2000 South Holly Street, Denver, co 80222. Said District
Engineer will also be responsible foe coocdinatlng the
state's activities under this contract.
s. The State will perform the work in accordance with applicable
·.state and Federal specificati~ns.
6 . The State and Local Agency have estimated the total cost of
the water line replacement to be $45,535. The Local Agency
shall contribute an amount not to e ~ceed $31,045 for its
portion of the water line replacement costs, unless such
amount is increased by a written supplement to this
contract . Reimburse~ent to the State by the Local Agency
o h; 11 be a lump sum of $31,045, payable within 30 days after
completion and final acceptance of the watec line replacement
by the State and the Local Agency . The line replacement
shall be deemed acceptable if it conforms to final plans .
Final acceptance shall not be unreasonably withheld by the
Local Agency .
7 . The State and Local Agency hav ~ estimated the total cost of
the cechannelization of Little Dey Creek to be $575,000 . The
Local Agency shall contribute an amount not to exceed
$250,000 for its portion of the rechannelization costs,
unless such amount is increased by a written supplement to
this contract . The State will bil l the Local Agency monthly

for the percentage of the total contribution that represents
the ratio 'of work performed during the month to the total
amount of work to be performed on Project No .
CXFCU(GF) l0-0085-09. In the eve n t the actual total cost of
the rechanneliza t ion of Little Dry Creek is less than
$500,000, the Local Agency portion of the costs will be 50\
of the actual costs .
8 . The Local Agency shall contribute to the State an amount not
to exceed $281,045 for the project costs incurred by the
-s~ate in the performance and completion of the work. This
shall be the maximum amount of Local Agency contribution
obligation unless such amount is increased by a written
supplement to this contract.
9 . Interim funds, until the State receives the re i mbursements,
will be payable from the State Highway Supplemen t ary Fund
(2001).
10 . The Loca l Agency's contribution for the work shall not be
derived from its sh~re of the Highway Users Tax Fund .
ll . The term of this contract shall continue through written
acceptanc e of the work by the State and receipt of final
payment from the Local Agency.
12 . This contract shall inure to the bene f it of and be binding
upon the parties, their successors attd assigtts .
13 . The II Nonjisccimination Provisions II and ''Special P~ovisions I1
attached hereto ace hereby made a part hereof .
14 . For the purposes of this contract, the Local Agency shall be
known as the contractor for benefit of the Special Provisions .

SUBJECT Rechannelization of

Passage of Ordinance approving contrac ~ with Colorado
Department of Highways for deaign and construction of the rechannelization
of Little Dry Creek and replacement of the waterline in Dartmouth.
BACKGROUND
Since December of 1986 1 the City has been working with the Urban Drainage and Flood
Contr• District and the Colorado Department of Highways (CDOH) on final design of
ptopr iJ "'\ improvements to Dartmouth and Santa Fe, with particular regards to Little
Dry u• ak. Currently the outlet of the existing Little Dry Creek box culvert emp-
tie s into an unimproved channel and erosion is occurring daily.
During design of the road and bridge improvements, it became apparent that major
structural improvements to the channel were required to protect the future bridge ..
Several alternatives were proposed by C0OH's engineering consultant, along with as -
soclated costs and impacts on the other improvements, particularly during the 100-
year flood.
Based on revlew of the information, it was detemined that all three entities would
benefit from construction of an energy dissipater at the bu>.. culvert outlet and
rechanneliz ation of t he Creek . Estimated cost of these improvements is $575,000 .
Based on estimates of benefit, it was agreed that CDOH would be responsible for
$3 25 ,000 of the estimated cost and the City and Urban Drainage and Flood Control
District (UD & FCD) would share the cost of the r emaining $250 ,000. In August,
1988 , the City passed an Ordinance approving an Agreement vith UD & FCD for sharing
the cost of the $250,000 on an equal basis.
Later, during des i gn of the road improvements, it was determined that the existing
12" waterline in Dartmouth would require reloc11.tion . The Utilities' Department de-
cided that it would be to ,he City's benefit to upgrade the size of the existing
waterline from e 12" to a 24" line during the relocation by CDOH. The Utilities

Department designed the replacement waterline and CDOH is willing to construct the
upsized waterline if the Utilities Depertment pays the incremented cost between the
installation of a 12" line and a 24 " line .
FINANCIAL
-$125,000 was appr~priated by tho City in the 1988 Public Improvement Fund for the
Little Dry Creek Rechannalization con1truction. The agreement for the ma tc hing
$125 ,000 fro11 UD IS, FCD waa •~gned by the City in September, 1988 . In the proposed
agreement with CDOH, if the 001 t 1 are leH than $500,000 then the City and UD IS,

It 1s recommended that the proposed contract with the Colorado Department of High-
, ,ys for design and construction of the Little Dry Creek Re c hannelization Improve-
ments and the Waterline Replacement be approved. Funds for the Rechannelization and
Waterline Replacement have previously been appropriated in the Public Improvement
Fund and the 1/ater Enterpr.ise Fund .
