BAClGllOUND In January of 1989 , the Englewood Police Department, the Englewood Municipal Court , and t he Englewood Municipal Court' a Proaecutor initiated a formalized progrw against doL>estic violence which emphulzed the oafety of persons and prote ction of property . Pr orlty ls given to scheduling court hearings as soon as poas lble after police arrest ur ticket the defendant . In January of 1989 , twenty-five do110stlc violence cases were heard, resulting in twenty-nine scheduled hear ing ■. In February of 1989 , there were thlrty -aeven case ■ re ■ultlng in forty -five court hearings . Cases involving domestic violence are moat often fraught with bitterness , hate , and distrus t. There ls a very high potential for v iolence . \lhere the defendant , at the initial court hearing , pleads not guilty, the judge determlneo whethe r a 'No Con t act Order• ls required . Such an Order prohibits the defendant from initiating any con- tact with the vlctl11 at any place or t lllO designated in the Order . At this stage of the proceeding&, the defendant h preaumed not guilty and the No Contact Order ls enforceable through the Court' a conteapt powers . Recently a ,•afendant who dhobeyed ■uch II No Contact Order vldted the victim'• residence and was arrested by the police . He a ■1aulted the police of ficer ,luring t h• arrest . This defendant was charged with a felony and the whole domestic vio-A lence case was incorporated in the Dhtrlct Court . The Municipal Court Judge opined W th<t without a grant of euti,ority by ordinance, he waa without jurhdictlun t o en- force a No Cont ,a.c t Order pr ior to conviction without a aubstantive offen1e also • b ■ing b oforo the Court (e.g . a ■■o11lt).
