ltiEREAS, there are !1\lll\Y parking violations in the City of Engll!WOOd by
drivers who rent or lease rrotor vehicles; and
WHEREAS, the vel1icle owners declare no knowledge of the parking
violations or responsibility for thw paynent of such fines; and
WHEREAS, Section 42-4-1110 C.R.S. makes owners of rented or leased
vehicles liable for payment of parking violation fines unless after a
reasonab.1 e tirre the owner furnishes the prosecution with Mm! and address of
driver lessee and authorizes local authorities to adopt this lleCtion which
would assist Englewood in oollecting parking fines for such violations;

Adopt an ordinance amending Title II, Chapter 1, EMC, placing financial llabllity to
this City for payment of parking violations on owner of vehicle when motor vehicle
ls leased by anti ther person who comita the violation .
BACKGROUND
This proposed ordinance requires motor vehicle owners who lease vehicles for hire to
furnish the name and address of the rentee vho violated an Englewood parking or-
dinance when the owner ls notified of the violation . The propoaed ordinance paral-
lels a state statute and providea this City with a means of obtaining parking fines
in the event a lessor or renter of a leased vehicle did not cooperate and provide
the City with the required information .
At the present time , people who rent auto11obilea and other vehicles can escape the
payment for parking violations because the tracking system now stops at the rental
c ompany . This i solates the vf ,,lator . Generally, the rental companies hav e cooper -
ated . This is a proactive me ·,aure to avoid a problem in the future.

This ordinance should provide the City vith the ability to collect parking fines and
should have a positive financ!.al impact on the City . Rental co11panie1 may have ad-
ditional financial burden in giving rental inforution. Generally, they have been
cooperative .
