WHEREAS, the owners of the site bounded by South Zuni Street on the
west, West Yale Avenue on the north, and South Vallejo Street cn the east, and
All Anerican Bottling ea,pany on the south have requested a resubdividing of
the platted portion and subdividing of the •mplatted portion of the property
to facilitate the sale of a portion of the site; and
WHEREAS, this area was annexed to the City of Englf!l,,Q()d in 1957 and is
zoned 1-1, · Light Industrial District; and
NHERF.AS, public hearing was held !>efore the Planning and Zoning
Carrnission on this subdivision and resubdivision request, and the Planning and
Zoning Camlission approved the sane;
NCM, THEREFORE, BE IT ORDAINED BY THE CITY OJUNCIL OF TIIE CITY OF

Section l. City council hereby approves the resubdivision of Lots

of Colorado and a tract of land lcx:ated in the NW 1/4 of the NW 1/4 of Section
33, Tawnship 4 South, Range 68 West of the 6th P.M., and being irore
particularly described as follows: Ccmrencing at the southwest corner of said
NW 1/4 NW 1/4; thence northerly along the west line of said NW 1/4 NW 1/4 a

BACKGROUNO
The owners of the s.ubject property, Fischbach Properties, Inc . currently lease the
entire site to the Natkin Company . Natkin anticipates consolidating their
operations and moving into the buildings located on the proposed Lot 2. When this
consolidation is complete, the owners of the property will sell Lot 1, including the
bu11~i ng thereon. The owners ant1 ~ipate that this sale w111 be cllfflJ)lete in late
Deceh .. Jr, 1989 .

The applicant is requesting the resubdivision of Lots I -5, Block 1, Yale-Tejon
Industrial Park , and the subd i vision of a tract of land in the Northwest 1/4 of the
Northwe st 1/4 of Section 33, Town 4 South, Range 68 West, which has not been pre-
vi ou sly platted .
The applicant is proposing to rep lat the above property into two lots to facilitate
the sale of a portion of the property .

oped and does have acces s to all of the utility services , so the requirements nor-
mally considered when reviewing the prel i 111 inary plat of undeveloped ground do not
necessarily apply i n this case .

der to accomplish the purposes set forth herein.
After the public hearing and Planning Commission consideration of the preli111lnary
plat, the Commission 111ay give its unconditional approval, conditional approval, or
the subdivision plat may be disapproved.
If the preliminary plat is approved or conditionally approved, the applicant shall
prepare a final plat _incorporating any suggestions or conditions resulting fr0111 the
public hearing. If the preliminary plat is disapproved, the applicant ■ay appul
the decision to the City Council as set forth in Section 10-2-9 of the Subdivision
Regulations .
Upon the submission of the final plat, the Planning Com111ission shall review the fi-
nal plat for confor111ance to any conditions imposed on the preliminary plat . After
this review, the Co11111ission shall either approve, conditionally approve, or disap-
prove the final plat . When the final plat Is approved , it Is forwarded to City
Council for their approval . Upon approval by City Council, the plat will be record-
ed in the Office of the Arapahoe County Clerk and Recorder.
