WITNESSETH: WHEREAS, the Arapahoe Library District, being a statutory library district organized and existing pursuant to Title 24, Article 90, Colorado Revised Statutes, for the purpose of providing library service to the residents of the unincorporated areas of Arapahoe County and those municipalities within said county not operating their own public libraries; and WHEREAS, the City of Englewoo~ o p erates a public library within its corporate boundaries and desires to cooperate with the District in prov i ding library ser v ice to District residents according to the terms and conditions as set forth bElow, and in accordance with applicable statutes of tho State of Colorado; and WHEREAS, the parties have contracted previ o u sl y for a cooperative approach to provision of sa~ library services and desire to continue providing said services between the City and the District; NOW THEREFORE, for and in consideration of the mutual promises herein, it is agreed by and between the parties hereto as follows: L The District shall circulate to library cardholders of the City of Englewood any item available for circulation from the District's library facilities, and the City shall circulate to library cardholders of the District any item available for circulation from the City's library facilities. Both the District and the City shall maintain circulation records for said transactions and shall submit s uch records to each other on a quarterly basis, Within 30 days after rec e ipt of said reports, the number of transactions reported by each party shall be compared, and payment for the net difference between transac '.ions sh a ll be made at the rate of fifty-five cents ($,55) per t ransaction by the library with the lesser circulation figure to the library with the greater circulat i on figure, subject to the provisions of paragraph 7. 2. The term of this Agreement shall be from January 1, 1990 chrough December 31, 1990, During said term, all qualified cardholders for both the District and the City libraries may use reciprocal borrowing nt both the City and the District facilities, and said cardholders shall be subject to all applicable rules and regulations associated with the use of such facilities. 3, It is understood between the parties heteto that the District shall not receive any equity in book stock or in any of the City's library facilities by virtue of the terms of this Agreement; and the City shall not receive any equity in the book stock or in any of the District's library facilities by virtue of this Agreement, 4. The District shall have access to City library r ecorde during normal business hours for the purpose of verifying all figures supplied to the District by the City and the Cit} shall have access to District library records for the same purpoie. 5. During the term of this Agreement, the City shall, at its opticn, provide once-a-week Bookmobile service .,t the Alice B. Terry School. Circulation service provided at this atop to Arapahoe Library District students enrolled at the school will be reported to the District for reimbursement to the Cit) at the rate of 27,5 cents per loan. Circulation s e rvice provided at the Sheridan Library to Englewood students enrolled at Sheridan High School will be reported to the City for reimbursement to the District at the rate of 27.5 cents per loan, 6. The fo ur public libraries in Arapahoe Countr , Aurora Library, Edwin A, Bemis Library (Littleton), Englewood Library and Arapahoe Library District are participating in ,t project called APAL --Arapahoe Public Access to Libraries. In order to administer county-wide projects such as joint proi ramming, collect .t on development and training, each library will lepos it o mutually agreed upon amount r,Jt to exceed $1,000 in a restricted fund h e ld and administered by the Arapahoe Library District, The Englewood Public Librar· contribution will be cled,cted from the Arapahoe Library District', fi r ~t quarter r<!ciprocal ,orrowing payment and placed in the restricted APAL fund. 7. Because of a change in the r~ciprocal borrowinq program of the Central Colorado Library System, no payment for r!ciprocal '-.../ borrowing is being made by the cities of Littleton, Engl11wood and Aurora for the reciprocal use of each other's libraries. It is reasonable to offer a certain ~mount of service without charge in the name of library cooperation, and the APAL direct~rs have estimated this amount to be somewhere between 9 ~nd 101, Therefore, in order to include the District in the benefits of this base level of service being given without charge among the other APAL libraries, the District shall receive a credit: aga J.nst any payment due the City for the final quarter of this Agreement in the amount of 9. 51 of the payment otherwise paid or owed to the City during the entire term hereof, including the fourth quarter. Notwithstanding anything contained in this Agreement, the other party hereto acknowledges a nJ agrees that no covenant, agreement or obligation of Arapahoe Library District ("ALD"i under this Agreement shall be deemed to be a covenant, agreement or obligation of any pre.sent or future trustee, director, officer, employee or agent of ALD in his or her individual capacity and neither the members of the governing body of ALD nor any trustee, director or officer who has executed this Agreement or any amendment or addendum thereto, shall be liable personally thereon or be subject to any personal liability by reason thereof, IN WITNESS WHEREOF, the parties have set their hands and seals below. It recognizes the impo rtan ce ·of cooperation among libraries in order to meet the needs of area residents for l i brary services . In addition, the Agreement currently provides income for the City and fund s the C) Library 's participation in Arapahoe Public Ac cess to Libraries (APAL). The Library Board and staff recomm en d that Council approve the 1990 Agreement for Library Services with the Arapahoe Library Di strict. PREVIOUS COUNCIL ACTION The Council ha s approved the Agreement for Library Services with the Arapahoe Library Oi strict annu ally s i nee 1965 . Council adopted the ordinance approving the 1988 Agreement on first reading on November 21, 1988. STAFF ANALYSIS The Di strict desires t o enter into this Agreement with the City . Its Bo,,d adopted the Agreement on November 14, 1989 . The Agreement is advantageous to the City and its residents . BACKGROUND The Library Board at its November 14, 1989, meeti ng accepted the 1990 Agreement for Library Services with the Arapahoe Library District and asked that it be forwarded to City Council for approval. The Agreement for Library Services with the Arapahoe Library 01 strict is presented to Council annually . It establishes recipr,:al borrowing services (circulation) for residents of the two library jurisdictions. This jointly-administered fund is used to implement cooperat1v~ projects designed t o serve residents of the four APAL member librari es --Englewood Public Library, Littleton Public Library, Aurora Public Library, and Arapahoe Library 01 strict . For examp 1 e, the APAL fund is used to produce the union 11 st of serials for APAL member libraries. FINANCl~ The Agreement is transaction -based specifying a payment to the net lender library of $0.55 per net loan. Effective with the 1986 Agreement, 9.5% of the reciprocal borrowing service provided via the contract is non-chargeable. This percentage was calculated to pa r allel the leve l of reciprocal borrowing service provided at no charge among the three municipal publ 1c 1 ibrar1es in Arapahoe County . Effective with the 1987 Agreement, net loans provided to students at the Al ice B. Terry School in Sheridan are reimbursed at $0 .275 per loan. During the first three quarters of the 1989 Agreement, Dis tr ict residents borrowed 17,988 items from EPL . Of these, 1,041 loans occurred at the Alice B. Terry School via the Roadrunner Bookmobile . Englewood residents borrowed 1,331 items from District locations. Of these, 95 loans occurred at the Alice B. Terry School via the District's school/public library facility. Englewood Publ 1c L 1 brary continues to be a net 1 ender under the Agreement al though use of EPL by 01 strict res I dents has declined in recent years. This trend wi 11 most likely continue over the long term as District facilities and services improve . Conversely use of District facilities by Englewood residents will likely increase. C District circulation to Englewood residents increased by 24 % in 1989. Income via the 1989 Agreement through 3rd Quarter 1989 is $7,901.21.
