AN OODINANCE APPROVING THE COOIBI\CT BETWEEN THE CITY OF l'NGLEIDOll AND 'fflE
DEPAR'Il·lENT OF HIGHWAYS, DMSION OF HIGHWAY SAFETY, STATE OF COLORADO.
Wl!ERFAS, the City of Engl<M'.Xld, on behalf of the Engl<M'.Xld Departrrent of
Safety Services, Police Divis ion, has suani.tted an application to the Coloraoo
Departlren~ of Highways, Division of Highway Safety, for federal funding to
conduct :,. traffic safety project; and
WHEREAS, the matching funds for this project are included within the
Departrrent of Safety Services budget; and
. l'IHEREI\S, the State of Coloraoo requires .J ,e City to formally approve the
contract between the City and the Division of Highway Safety by signature of
the Mayor;
lO'I, THEREFORE, BE IT ORDAINED BY 'fflE CITY COUNCIL OF 'lllE CITY OF
~, COLORADO, AS FOL!.O/S : .
Section 1. The contract between the City of Engl<M'.Xld and state of
Co l orado Departrrent of Highways , Di vision of Highway Safety, is hereby
approved. The contract generally contains the fo,l ~',Jing :
1. Cicy shall carry out the program, conduct all the activities and
provide services in identifying h.i.gh hazard locations for selective
enforcement programs; analyze traffic enforcement data; prepare
roadway hazard reports and traffic enforcement activity reports ;
provide training in accident investigation and reconstruction for 8
traffic officers and one sergeant at Coloraoo Law Enforcement
Training Academy thru 9/30/90; purchase equiprent for use in
accident investigation; deploy traffic unit for 10,600 hours of
enforcement and related activities and 1300 hours of supervision
thru 9/30/90; provide quarterly reports and final inpact evaluation
thru 11/15/90; provide equiprent accountability fonn and analysis of
traffic enforcement data ; provide description of training; provide
equiprent accounta.1:,ility fonn; provide description of hours of
enforce:rent by location, nurrber of citations written; provide f i nal
i.rrpact evaluation.
2. City shall crnply with all applicable acininistrative procedu:.:·es an d
contract requirements contained i n the Coloraoo Highway Safety
Contract Management Manual.
3. Maximum total arrow · of contract shall be $276,035 of federal funds:
State share of fede funds to be $28,216; City's share of federal
funds to be $247,819; City to pay all costs incurred in excess of
this budget arrount. City's reirrburse-rrent by the State shall be
contingent on City's contribution of its participating share and
upon the continuing availability of federal funds under the Highway
Safety !\ct (Title 23, u.s.c. Section 402). In the event such funds
or any part thereof are not received by the State, the State may
irnrediately terminate or amand this contract.
4. Term of contract is date Contract is approved by signature of State
Controller and shall terminate on Septerrber 30, 1990, and

6. If City fails t.o fulfill its obligations under this Contract or
shall violate any of the covenants, agreements or stipulations of
this contract, the State has the right to terminate this Contract
for cause. Of the State may terminate this contract if it
determines the p.irposes of the distribution of monies under the
Contract Nould no longer be served by coopletion of the Project.

Contract for and on beha .f of the City council and the City of Englewood.

WHEREAS, the State is authorized under Sections 43-5-401 and
24-42-103, C.R .S ., as amended, to c oordinate with the fede cal
qovernment and other entities to d•velop and implement plans and
proqrams involvinq all a s pects an rt •omponents of traffic safety in
Colorado; and
WHEREAS, the State has received approval and funding f or
implementation of its Fi scal Year 1990 Highway Safety Plan (HSP)
from the U.S . Department of Transportation , National Highway Traffic
Safety.Administration and Federal Highway Administration; and
WHEREAS, the HSP contains proqrams and activities designed to
reduce t he frequency and severity of traffic crashes or improve the
operat i onal effic i ency of existing traffic safety programs i n
Colorado ; and
WHEREAS, the State de termine s which agenc ies or entitles would
be most appropriate in completing the objective s, conducting the
activities and providing the services required by the HSP ; and
WHEREAS, the Con t ractor has submitted an Applicat i on to conduct
certa i n activities approved i n the HSP which has been approved by
the State and which is incorporated herein to the exten t consistent
with the terms of th is co n tra c t; and

WIIER~AS, this contract is 01.,,cuted by the State under authority
of section ■ 43-5 -401 and 24-42-lOl, c .R.S ., as amended , and is
executed by the Contractor under authority of Section 29-l-203,
C.R.S., as a ■ended, and as aut horized by the formal resolution
attached hereto a ■ Attachment B; and
WHEREAS, the Contractor warrants it has taken all neces1ary
atepa to ensure the individual Contractor si9natory bolow ha ■ the
authority to 1i9n this Contract.
NOW THEREFORE, it is hereby a9reed a s follows :
1. The contractor shall carry out the pro9ram, conduct all the
activities and provide the 1orvices described in the scope of Work
attached hereto as Attachment A. This attach~ent is attached hereto
and is incorporated herein by this reference.
2 . In the petformance of the work. the Contractor shall comply
with all applicable administrative procedures and contract
requirement• containqd in the Colorado Hi9hway Safety Contract
Mana9ement Manual, hereinafter referred to as the Contract Manual,
which is incorporated herein and made part hereof by reference .
such procedures and requirements are conditions of this contract .
3. The Contractor shall submit periodic and final reports to
the State accordin9 to the requirements of the Contract Manual and
the reportin9 criteria set forth in pa9e 2 of Attachment A.
4.· The Contractor shall comply with the budget for this
contract as set forth in pa9e 3 of Attachment A. The Contrac t or
shall be solely responsible for all cost s incucred in excess of this
bud9et amount.
5. Th e maximum total amount of the Contract shall be
$276,035. Subject to the condit i one of this contract, the State and
Contractor shall participate in providin9 this amount as follows:

The State share shall be compris e d entirely of fedetal funds made
available to the State . The State shate amount of this Contract
shall not be exceeded without the benefit of a written supplemental
contract executed prior to the performance of additional a ctivities
or the incurrin9 of aodi ~i onal costs.

6. The State shall reimburse the Contractor tor the
accomplishment of thl1 Contract exclualvely from funds made
available tor thls contract under the Hl9hway Safety Act, Title 2l,
u.a.c . Section 402 . such reimbursement shall b• only as provided In
the contract Manual . such relmbur1ement shall be cont l n9ent upon
the contribution by the Contractor of lts partlclpatln9 sh a re as
provided he rein , and shall be c ontln9ent upon the con ti nuing
ava i lability of federal funds under t he Hl 9hway Safety Act , Titl e
23 , U.S .C. Se ction 40 2 , toe the purposes hereof .
7 . The teem of tn l s Contract shall be9ln on the e f f e ctive date
and shall term i na te o" ~•ptember 30 , 1990 . Th e effective date of
this contract a n•ll be t he date the required sl9nature ap proval of
the State Cont coll e t I s o bt a i ned on thla Contract, as ev i denced by
the date first appea r l n9 d bove. Contractor agrees that any contract
work pertorm•d or cos t • Incurred prior to the effective date shall
not be compen s ated un d e r t he term• of thls Contract .

requirements and mu se be ap proved by the Director , Di vision of
Hl9hway Safety, pc \or l o execution . Contractor shall not a s sign

9 . a) Ter mi na t io n Due to Loss of Funding . The partie s heret~
expressly re c o9n l i e the Contractor la to be paid, reimbursed, or
otherwise compensated sol ely wlth federal funds provided to the
State for the purpose of contractin9 for the services provided for
herein . Therefore, the Contractor expressly understands and a9rees
all its rights, demands and claims t o comp e nsat i on a r isln9 under
this Contract are continge nt upon re c eip t of suc h fund• by the
State . In the event such f unds or any pact thereof are not received
by the State, the State ma y Im mediately terminate or a mend th is
Contract .
b) Termination for Cause . If, for any cau s e , the Con ~ractor
sh•ll fall to fulfil l in a timely and proper manner its obligations
under this Contract , or if the Contractor shall violate any of the
covenants, a9reements or stipulations of this Contr.act , the State
shall thereupon have the r l 9h t to terminate this Contract for cause
~y 9lvinq written notice to the Contractor of such ter ~lnatlon and
specifying t he e f fective date thereof , at least 30 days before t he
e ff ec t i ve da t e oC suc h t P.rm i na t \o n . In t ha t e ve nt , a ll f i nis hed or
unf i nishe d do c um e nt s, da t a , st udie s, s ur vey s , dr awl n9 s, map s , .
models, pho t ogr a ph s and report s o r othe r ma t e rial pr e par e d by the
Contractor under thi s Con t ract s hall, at the opt i on of the State ,
become I ts prop e rty , and t he Contrac tor shall be e ntitle d to receive
Ju s t and equitable compen s atio n for any s atisfactory work completed
on such documents and other materials .

Not wlthst1ndin9 the 1bove, the Contr1ctor shall not be relieved of
llablllty to the State tor any da ■a9e1 1u1tained by the State by
virtue of a breach of th• Contract by the Contractor , and the State
■ay withhold any pay ■ent ■ to the Contractor tor the purpoae of
1etoff until 1uch ti ■e a ■ the exact amount of dam19e1 due the State

Contract at any time the State determine ■ the purposes of the
dlatrlbution of monies under the Contract would no lon9er be served
by completion of the Project . The State shall effect such

daya before the effective date of euch termination.
10. The Special Provisions attached hereto are hereby made a
part hereof.

Adop t a bill for an ordinance approving the Highw11y Safety Contract with the
Colorido Department of Highways, Division of Hig~11ay Safety, for Project 19-90 (see

STAFF ANALYSIS
The adoption of this bill for an ordinance approving the Highway Safety Contract
between the City of Englewood and the Colorado Department of Highways, Division of
Highway Safety, 1s required in order to receive the grant funds for the project.
BACKGROUND
The application for this traffic safety grant was submitted 1n April of 1989 . The
purpose of the grant request 1s to provide a fully equipped vehicle and other
necessary equipment for a newly cm plemented traffic unit, and to provide nec essary
training for eight officers and one sergeant .
The ultimate goal of the traffic unit 1s to reduce all accidents within the city by
5" (with a particular emphasis on injury accidents), increase accident related
su11111onses by 5", provide selective traffic enforcement ut ilizing compiled dah, and
develop strategies to reducr identified traffic hazards.
FINANCIAL
The amount of the contract 1s $276,035 . The state share (federal funds) 1s for
$28,216 . Englewood's share 1s $247,819, an in -kind match in employee salaries .
