AN CIIDINANCE APPROVING THE UNITED STATES GEXJI.CGICAL SURVEY JOINl' FUNDING
AGRm!ENl' FCR THE ceERATICN l\ND MAlNI'mANCE CF A S1'REAM FLO/ GAUGING
STATICN CN THE SCX1l'II PIATl'E RIVER AT UNICN AVENUE.
WHEREAS, c.ouncil has previously approved a joint funding agreement
for the period of l\pril to Septem:ier of 1989; and
WIIEREAS, Englewood applied to transfer tiie Petersburg Ditch and the
"1706" rights to an alternate point of diversion -Chatfield Reservoir; and
WIIEREAS, the Water Court found that Englewood must take all the
accretions to the South Platte River bet,;een Chatfield Reservoir and Union
Avenue before it could toke any water that was transferred to Chatfield
Reservoir; and
li!!EREAS, Englewood was required to install a stream flow gauging
station just ll!) stream of the Union Avenue Intake and Pul1p Station; and
WIIEREAS, the stream flow information fran this gauge will be used on
a daily basis to determine the am:runt of water that can be taken at the
Chatfield Reservoir;

Section l. The Department of the Interior Geological Survey Joint
Funding Agreement for Water Resources Investigations between the Geological
Survey, United States Department of the Interior and the City of Englewood
is hereby approved. Said Department of the Interior Geological Survey
Joint Funding Agreement for Water Resources Investigations contains
generally:
1 . 'nle parties subject to the availability of appr~riations and in
accordance with their respective authorities shall maintain in
~ation, maintenance and ~ation of a streamflCM gauging
station with data platform on the south Platte River at Union
Avenue .
2. Th<· folla.,ing orrounts shall be contributed to cover the cost of
necessary field and office work directly related to this program
but excluding any bureau level general aaninistrative or
accoun.:ing work in the office of either party.
A. $3,050.00 by Geological Survey, U.S. Department of the
Interior during the period of o::tober l, 1989 to SeptElliler
30, 19~0.

B. $3,050.00 by the City of Englewood d!ring the period of
October l, 1989 to Septerber 30, 1990.
C. Additional am:,.mts by by each party d!rir.g the above period
or succeeding periods as may detennined by nutual agreenent
and set forth in an exchange of letters between the parties.
section 3. Expenses incurred in the performance of this program may
be pa,.cf15yeITher party in conformity with the laws and regulations
respectively governing each party provided that so far as may be nutually
a(Jt'eeable all expenses shall be paid in the first instance by the
Geological Survey, U.S. Departnent of the Interior with appropriate
reimburserent thereafter by the <..:ity Englewood. Each party shall furnish
the other party such staterents, reports or expenditures which maybe needed
to satisfy fiscal requirerents.
section 4. The field and office work pertaining to this program shall
be uncler'tiie'direcion or subject to periodic review by an authorized
representative of Geological Survey, U.S. Departll'ent of the Interior.
section 5. The areas to be included in this . reg.cam shall be
determined by rutual agreerent between the parties. Methods erployed in
the field and office shall be those a~ted by Geological Survey, U.S.
Departll'ent of the Interior to insure the required standards of accuracy
subject to n-odi.fication by rutual agreerent.
section 6. During the prO(Jt'ess of work all cperations of either party C
shall be q,en to the inspection of the other party and if the work is not
being carried on in a rutually satisfactory marmer either party may
t ,rminate this agreerent upon 60 days written notice to the other party.
Section 7. The original records resulting fran this program shall be
depos1 ted 1n the office of origin of those records and upon request copies
shall be provided to the other party.
Section 8. The maps, records or reports resulting fran this program
shall be made available to the public as prooptly as possible and will
normally be published by Geologicl',l Survey, U.S. Oepartrrent of the
Interior. HOw'!!Ver, the City of Englewood reserves the right to publish the
results of this program and if al·,eady published Geological Survey, U.S.
Oepartrrent of the Interior shall ·,pon request furnish, at cost, inpressions
suitable for purposes of reproduction similar to that of which the original
copy was prepared. The maps, records and reports published shall contain a
staterent of the coq,erati ve relations between the parties.
Section 9 . Billing ~or this agreerent will be rendered September 30,
1990. Pay,rents of bills are due within 60 days after the billing date. If
not paid by the due date, interest will be charged at the current treasury
rate for each 30 day period.
