COI.aWJO, l\S FOLT.al'S: Section 1. Title 1, Olapter 6, including Articles ,\ through K, Engl~cipal Code 1985, Aaninistrative SeJ:vice, is hereby ,:epealed. Section 2. A new Title 1, Olapter 6 , including Articles A through H, Englewood Municipal Code 1985, entitled llepartrrental Organization, is hereby enacted to rea d as follows: 1-6-1: Ol!FINlTICIIS: STAFF OR STAFF MEMBER includes the City Manager and assistants to the City Manager, department heads and any e,rployee while acting in the capacity of City Manager or depart11'ent director. 1-6-2: 'llEPAR'.IMfJffi\L acANIZA'.l'ICII: A. The departrrental organization of the City shall be divided under the City Manager into the following departrrents and directors thereof: -1 - Departrent Adninistrative Services Financial Services canmunity aleveloprent Library and Recreatio., Services Public Works Safety Services utilities Direc.tor of Adninistrative services Director of Fit..mcial services ex offici o City Treasurer Director of Con!llnity Developrent Director of. Library and Recreatioo Services Director cf Public Works Director of Safety Services Director of Utilities B. Reference to a department director or department head in this Code by any title other than set forth in this Section shall be construed to refer to the department head as set forth herein. c. On a tenp:,rary basis the City fo'.a.~ager may reassign duti,,s and responsibilities to departments in the best interests of the City. 1-6-3: lllJllNISDlATlV PCLIC't' /BO ~: A. Staff. Each staff meniler sh,ll perform all a.iti es required of his office by federal law, stat<' law , the Charter, this Code and ordinances of the City, and such other duties not in conflict therewith as may be required by the City Manager. B. llepartlrent Directors. The directors of departments shall: 1. Be inm!diately responsible to the City Manager for the effective adninistration and organization of their respective departments and a ll activities assigned thereto. 2. Keep info.med as to the latest practices in their particular field and shall inaugurate, with the approval of the City Manager, such new practices as appear to be of benefit to the service and to the public. 3. Subnit such reports of the activities of the department to the City Manager as the City Manager shall require. 4. Establish Md maintain a system of filing and indexing records and reports in sufficient detail to furnish all informatioo necessary for proper control of departmental activities. -2 - c l 5. It shall be the chlty of the Director of Financial Services "" officio City Treasurer to act to prarote secure and preserve the financial and prq,erty interests of the City in all cases where the chlty is not expressly charged t o any other department or office. ARTICLED DEPARIMl!NT CF CXMUll'l.Y IEIIJ!UJiMl!ffl 1-60-1: General Responsibilities: 'nle Department of Camunity Developrrent shall be responsible for the fornul.ation, aani.nistration and inplenentation of all planning, building, envirorurental, housing and redevelc:pnent programs within the City and shall enforce codes relating to said programs; shall assist the City Planning and Zoning carmis-.ion in the preparation of the Master Plan for the physical, social and econanic developrrent of the City ; s hall inspect subdivision plats for ca,pliance with the Subdivision Code; and shall assist the Board of Acljustrrent and l\ppeal by providing information ancl reccmrendations on matters considered by said Board. ARTICLE E DEPARIMl!NI' CF LIBRARY l\liD Rl!D!EM'ICR SERVICES l-6E-l : General Re s ponsibilities: 'nle Department of Library and Recreation Services shall operate the City's libraries, recreation services and golf course delivery of services and aani.niste r the same in the int&est of the entire OC11111lnity. ARTICLE F Dl!PA!mll!ffl' CF PUBLIC KRS l-6F-l: General Re s pon sibilities: The Department of Public Works shall be responsible for all matters relating to construction, managE!llent , maintenance and operation of the physical prq,erties of the City, including, without limitation, st:reet and surface drainage maintenance, traffic systems, central garage facilities , engineering, parks, golf course facilities and grounds, and building maintenance. -4 - ARl'ICIZG IJ!PAlm!ml' c:, SAPmY sm!VICl!S l-6G-l: General Responsibilities : The Department of Safety Services shall oversee all police functions, including patrol, investigations, aanin.istration, camunity relations, and animal control; and all fire functions, including suppressioo, prevention, aaninistration, rescue services, training and vol unteers; and all central ccmrunications. The titles "Directo,· of Safety Services" and "Safety Services Director " are synonYff')us with "Olief of Police, 11 "Police Chief, 11 "Olief of F L e," and "Fire Chief" f or all purposes under the applicable laws of th" State of Coloraoo and the United States of Anerica. l -6G-2: POLICE DIVISIOO: A. There is hereby estab l i //ru:tl a l?olice Division within the Depart:11'ent of Safety ~;erv1Cf,~, ccnsisting of such nurrber of police officers of t arious ranks and other civilian personnel as, in the judgment of the Ci. ty Manager, may be necessary for the peace and good 01;der of the City. The rrentiers of the Police Division shall be appointed by the City Manager and shall be subject to the career St!rvice rules and regulations. B. The Director of Safety Services shall be in direct cxmnand of the Police Division . He shall assign all nerbers of the Division to their respective duties. He is responsible for their training, perfonnance, ct'fici ency, discipline and conduct. He is responsible for th/I ~"rn ru ,d custody of all property used by the Division. He shall e,;tablish policies, prcx:edures, rules and regulations, 1n conformance with the laws of the State of Colorado and the ordinances of the City of Englewood, concerning the q,eration of the Police Division and the conduct of its erployees. He shall exercise general supervision and control over all meni:lers of the Di vision . C. The Director of Safet. · &=ices is authorized to issue a permit to carry a concealed "'8a!-<)n to all Englewood police officers, netilers of the reserve police force, court marshals, and other Police Division personnel as he may deem appropriate; and may issue penni ts to carry concealed "'8apons to other persons in accordance with 18-12-105.l Coloraoo Revised Statutes. D. The Division of Police shall be responsible for the preservation of public peace, prevention of crine, apprehension of criminals, protection of personal and property rights, enforcerent of the laws of the State of Colorado and the ordinances of the City of Englewood, and such other functions as the City Manager and City Council may prescribe for the public safety function. l\ll merrt,ers of the Police Division designated by the Director of Safety Services to have such police powers shall have all powers and camensurate duties with respect to the service of criminal process and the enforcerent of criminal laws as are vested in police officers by the general statutes. l-6G-3: SP1!J:IAL P(LICE: '!he Director of Safety Services may appoint speoial ;o lice officers authorized and eirpowered to perform duties similar to those of regular police officers, coosiatent with tht· laws of the State of Colorado and the ordinances of the City of Englewood. l-6G-4: RE.!ll!-'.aVE P<LICE fQO!: 'l1ie reserve police f orce shall q,erate under the direction and control of the Director of Safety Services. Reserve police officers are appointed and camu.ssioned by the Director of Safety Services as si: ecial police officers in accordance with l-6G-3. No ment,er of l' ie Reserve Police Force shall be considered an enployee of the City for any purpose , nor shall such perSC11 be entitled to any carpensation, police pension benefits, sick leave, longevity pay or carpensatory tilre benefits; and each s uch person shall , before becaning a nenber of the Reserve ~ ·· lice Force, execute to the City a waiver of any claims for my ca,p:ns ation, renuneration, or benefits for any injury , r.,::urred as a result of his or her being a nenber of the r ,,serve Police Force. '!he City will provide insurance c cover age for "'°rlaren ' s canpensation at the City' s expense; and the City will provide false arrest insurance protection. '1he Director of Safety Services is authorized and directed to establish policies, procedures, rules and regulations governing the tenns of service and general conduct for any rrerber of the Rese1ve Police Force . The nun'ber of appointed reserve police offic'.ers will not affect the authorized strength of the regular police in the Fngl""JOOd Police Division. l-GG-5: FIRE DIVISICN: A. There is hereby established a Fire Division within the Department of Safety Services, consisting of such nun'ber of fire fighting per sonnel of various ranks and other civilian personnel as, in the judgrrent of the City Manager, may be necessary for safety of the City. The nenbers of the Fire Divi~;on shall be appointed by the City Manager and shall be s ubject to career Service rules and regulations . -6 - '-.../ B, The Director of Safety Services shall be in direct cxmnand of the Fire Division. He shall assign all nett>ers of the Divisioo to their respective duties. He is responsible for their training, performance, efficiency, discipline and conduct. He is responsible for the care and custody of all prq,erty used by the Division. It shall be the duty of the Fire Division: to aide in the preventi on of and to extinguish fires; to educate t.he public in all matters pertaining to fires and fire prevention; to make inspections of property and conditions within the City which constitute fire hazards and to assist in the elimination or abatement thereof; to enforce all regulatory provisi ons of this Code; to perfonn rescue and ant>ulance services within the City; to q,erate and maintain all firefighting apparatus and equiprent in its charges; t o investigate the c ause, origin and cir=tance of all fl.res occurring within the City ; to formulate and control a hazardous Materials cam.mi ty Response Plan that is responsible for n-onitoring and mitigating related incidents of this nature. -7 - l-6G-6: FIRE PRIM!Bl'ICll IIIRCMI: A Fire Prevention Bureau shall be established within the Fire Division under the direction of the Department of Camllnity Develq:rnent' s Code Adninistrator. The Bureau shall oonsi~t of such Fire Division persomel as may be assigned thereto by the Director of Safety Services . '111c function of this Bureau shall be to assist the Code Aani.nistrator in the aani.nistration and enforcenent of the Englewood Building and Safety Code. l-6G-7: VCUlffl!ER FIRE DIVISICll : A. Recognition, Qualification, Membership. There .is hereby recognized the Engle,oxx! Volunteer Fire Division, a Colorado not-for-profit corporation, as an auxiliary firefighting force, the rrenbership of which may be called to duty during daylight or night-time hours in the event of fires or when its assistance i s otherwise needed, subject to such additional qualifications or limitations which may be i.nposed by the bylaws of such corporation. The irembership thereof shall consist of persons eighteen ( 18) years of age or older who shall otherwise qualify. B. Crnpensation: Disability, Length of Service , Retirerrent Benefits. n No ment,er of the Volunteer Fire Division shall receive any c coopensation for services as a rrember thereof; provided ho.ever, that service as a nenber of the Volunteer Fire Di vision shall be consideree as service in a Volunteer Fire Division for the purpose of any disability or length of service retirement benefits provided to me!l'bers of such Division; and provided further that the City Council may make payirents to, or oo behalf of, the Englewood Volunteer Fire Division in reasonable am:,unts detennined and budgeted for that purpose, such payirents to be used for equipment, the training of firefighters and other general expenses of the Englewood Volunteer Fire Division. C. Officers: Election and Terms. The officers of the Volunteer Fire Division shall consist of such officers as shall be provided by its bylaws and shall be elected fran nonprobationary netbership of the Volunteer Fire Division. D. Future Men"l:lership; Limitat ions. The Englewood Volunteer Fire Division shall recruit, appoint and maintain a merrl:lership as established herein and shall hereafter consist of a minimum nenbership of twenty-five (25) volunteer firefighters . Additional volunteer appointn-ents may be made by the City Council oo the recanrendations of the Englewood Fire Division and the City Mana~er as needed. -8 - l-6G-8 : O'.JMIIICATI<JiS DMSICII: 'ttlere is hereby created the Division of camunications. 'nlis Division shall be responsible for radio and related catmlllications within and for the Police and Fire Divisions, and such other cam,unication duties as assigned by the City Manager . If necessary, the Cit y Manager shall appoint a di visioo head; otherwise, the Director of Safety services shall have direct operation responsibility for the division. ARl'ICLE B DEPAA™l!Nr CP UTILlTil!S 1-611-1: General Responsibilities: nie l)epartment of Utilities shall be responsible for all matter,, relating to the managerrent, maintenance, and q,eration of the water and sewer utilities, including stonn drainage, and shall be responsible for all matters relating to the managerrent, maintenance, and operation of the Bi-City Wastewater Treatirent Plant. Section 3. Title 3, Englewood Municipal Code 1985, is hereby anended by a~ Chapter 8 relating to Firefightars • Pension and Benefit Funds, to read ao follCMS: 3-8-1: FIREFIGHMRS' PmSICII J\lll Bl!HEFlT FIHlS: 3-8-1-1: FIREM91'S Pl!NSICII F!Hl: CCF.mancing on January 1, 1977, there shall bt, deducted fran the m:mthly salary of each and every paid marrber of the Englewood Fire Division a sum equal to five perct·nt (5'1,) of said mamber' s monthly salary pursuant to Part 4, Article 30, Titl•• 31 Colorado Revised Statutes, 1973 , which sum shall be deposited in the City's Firen'en's Pension Fund, 3-8-1-2: FIRE.'FIGHMRS' BmEFlT F!H>: A, There hereby is created a special fund to be kno,,n as the "Firefighters' Benefit Fund" for the purpose of refunding accumulated contributions to those firefighters caning within the provisions of this section, and to provide those funds necessary co pay the benefits accruing to firefighters, pursuant to the tenns of this section. B, The City shall make contribution to said Firefight ers' Benefit Fund at a rate to be determined annually in the following manner: At least e:,ery three (3) years, the City shall have an actuarial study prepared relating to the Fireman's Pension Fund and Firefighters' Benefit Fund. The normal cost of the benefits afforded under the statutory Fireman's Pension Fund and the normal cost, plus any unfunded cost prorated on a thirty-( 30) -9 - year funding basis of the benefits afforded under the Firefighters' Benefit Fund will be distributed annually into the two (2) pension funds. The City's contribution into the Firefighters' Benefit Fund will be a figure derived by taking the total dis tributioo to be made each year, as described above, and subtracting contributions made by the enployee, City and State of Cc ,. rodo to the Firemen's Pension Fund. J n addition to the powers and obligations i:tposed upon .:he Board of Trustees of the Englewood Firemen's Pc.,sion Board, by Article JO, Title 31, C.R.S. 1973, said Board shall have al. l powers necessary to supervise anu a ai\l.nister the t "-'rns of this Section. In addition thereto, said Board shall have the power fran tine to time, as the need may arise, to transfer any surplus rronies resulting in said Firefighters' Benefit Fund to the Firemen's Pension Fund of the City. 3-8-1-3 PEltlilNl!Nr DISABILITY mil!FlTS: A. In order to supplement the incare of any firefighter, .ho, as a result of injury or illness, is rendered pernianently disabled , there shall be paid to such c officer, out of the Firefighters' Benefit Fund, a ' rronthly benefit equal to bienty percent (20'Y,) of his base salary plus longevity , which he was making at the time that he incurred such disability. Such pay,rent shall be in addition .;o any benefits payable to the firefighter fran the statutory Firer.en 's Pension Fund. B. In order to be eligible to receive such payment, the firefighter rrust, at t.he time of his application therefor, be permanently iisabled £ran performing the duties of any occupation for which the firefighter, by reason of his education , training and experience , would be c apable of performing but for the injury or illness involved. In det=ining whether any firefighter is so permanently disabled, any dis ability, and any knc,,,n injury or illnes s, .tiich pre-existed the firefighter' s enployirent with the City, shall be disregarded. C. Payment to the firefighter of such benefits shall continue on a nonthly basis, subject to the following conditions: -10 - 1. Paynent e:,f auch benefits shall cease upon the date that the firefighter would have been, b.Jt for his disability, eliqible to receive oormal, nondisability ret:irerent bene •1t~ fran the Firefighters' Pension Fund; 2. Paynent of such benefits shall cease should it be subsequently <le tennined that, by reason or retraining, inproven-ent in oondi tion, or for any other reason, the firefighter is oot longer permanently disabled fran perfmming the duties of any occupation for which he is qualified; and 3. There shall be deducted fran the arrounts payable hereunder an a;ir,mt equal to any incane earned by the firefighter as a result of personal services (either as an enployee of another or en his cwn behalf) . D. The Firefighter Pension Board is hereby granted the authority and jurisdiction to issue regul1,tions, not inconsistent with the terms hereof, designed to carry oot the purpose of this Section, and to hold hearings, take evidence, ruceive information and to make final and binding decisions, awards and resolutions respecting the eligibility of firefighters for initial and continued payirent of benefits hereunlier. 3-8-1-4: RE'l'IRIM!Nl' BmEFITS: /Vly nerber of the Fire Division who has attained the age of fifty (SO) years and has twenty ( 20) or nnre years of credited service shall be eligible to receive a service retirerrent pension based on the enployee' s final base pay, allowing t,,,:, and one-half percent (2 1/21,) for each of the first twen1.y (20) years of credited service, plus cne percent (l'X,) for each additional year of credited service, to a maximum of sixty five percent (65'X,). Calculating the base pay rreans the amount of his nonthly salary as of the date of his retirerrent. Pension paynents shall be rrade in equal rron.:hly installrrents to the n-ember. 3-8-1-5: LF.Avn«i SfllVICE PRICR TO ELIGIBILnY: Should any rrenber of the Fire Division leave the service of the City prior to becaning eligible to receive a pension payable fran the Firerren' s Pension Fund, for any reason other than death, and said rnenoor has less than five (5) years of credited service at tennination, · said firefighter shall be entitled to a refund of his accumulated contribution of the Engle.,xxi Fireiren' s Pension Fund. The term accumulated contributions shall r,ean the S\ln of said firerren' s contribution to the City to the Fireiren' s Pension Fund together with interest, if any, thereon, as may be /'I detennined by the Board of Trustees of said Fund. l , If Ba.id firefighter has five ( 5) or nore years of credited service at termination, the fire fighter may elect either: A. Deferred nonthly benefit payabl'-' beginning at age fifty (50) based upon the 11'1!riler's final base pay, allowing two and one-half percent ( 2 1/2'1,) for each of the first ~nty ( 20) years of credited service plus aie percent ( 11,) for each additional year to a maximJrr. of sixty five percent (651,) of base pay, or B. Receive a refund of his accunul.ated oontributioos as set oot above. 3-8-1-6: 1/!Ulffl!l!R FIRl!FIGffl'm!S' Pl!liSIC!I FUil: A, There is hereby created a special fund to be knCMn as the Volunteer Firefighters' Pension Fund for the purpose of paying statutory benefits to volunteer firefighters under conditions as provided by Title 31, Article 30 , Part 4, Colorado Revised Statutes, 1973. B. Benefits for all volunteer firemen retired before Decenber 31, 1974 shall be expended fran funds received I",-....· fran the State of Colorado in the annual alloorent \_. provided in Title 31, Article 30, Part 4, Colorado Revised Statutes, 1973. An annual detennination shall be made of the necessary allocation of the alloorent between the Volunteer Firefighters' Pension Fund and the regular Firefighters' Pension fund. C. Beginning January 1, 1975, the City shall make contributions to the Volunteer Firefighters• Pensioo Fund as detennined necessary to annually fund the pension benefit accwnul.ations of the volunteers, The contribution shall be based on an ,,ctuarial studY to be dor.e at least every three ( 3) years. Pension benefits to volunteers retiring after January 1 , 1975, will be paid fran these contributions. -12 - Section 4. Section 5. Title 7, Chapter 6A, Englewood Municipal Code 1985, is hereby amended by adding new subsections C and D to read as follC>olS: 7-6A-5 : c. Fire lanes shall be established on private prq:,erty devoted to p.,blic use where the parking of m:itor vehicles or other obstructions may interfere with the ingress and egress of Fire Division \'ehicles for the protection of persons and prq:,erty, such as , but oot liroi ~ed to, shopping centers, bo,/ling establishments, thedters, hospitals, schools, churches and other similar locations where firefighting awaratus and equiprrent cannot be used effectively fran public accessways. The Director of Safety Services shall establish said fire lanes on premises heretofore set rut by filing a plat of said private premises with the DepartJrent of Public Works and with the Police Division of the City, specifically designating thereon the width and route of such fire lanes as shall be essential for the ne<:essary ingress, egress and m:ivement of fire equiµrent and apparatus within and upon said private premises. said plat shall bear the date of approval of the Director of Safety Services. c. Upon filing the approval plat designating the necessary fire lanes and widths thereon with the Depart11'el\t of Public Wo:cks and the Police Division, as provided herein, the Director of Safety Services or his designee shall forthwith deliver a copy of the sarre to the a.,ner, operator, tenant oi-lessee in possession of said private property with written not ice, and order to pro~eed to make and post said fire lanes in confonnance with the Manual and Specifications of th!! State Departrrent of Highways. Within forty-five (45) days after notice, or s uch additional tine as oot to exceed forty-five (45) additional days, the a.,ner, operator, tenant or lessee in possession shall ca,plete the necessary ma.rking and signing as required herein . -15 - D.
