Section l. This Agresrent between the City of Englewood and the
llra;,ahoe Library District, titles "Agreernent for Library Services," is
hereby appr011ed. Said Agreerent generally provides for the follawing:

AGREEMENT~~ SERVICES
THIS AGREEMENT, made and entered into on this ____ day of
________ , 1990, by and between the ARAPAHOE LIBRARY
DISTRICT, hereinafter sometimes referred to as "District•, and the
CITY OF ENGLEWOOD, a municipal corporation of the State of
Colorado, hereinafter sometimes referred to as "City•.
WITNESSETH:
WHEREAS, the Arapahoe Library District, being a statutory
library district organized and existing pursuant to Title 24,
Article 90, Colorado Revised Statutes, was for~ed for the purpose
of providing library service to the residents of the unincorporated
areas of Arapahoe County and those municipalities within !e.iG
county not operating their own public libraries, and
WBEREAS, the City of Englewood operates a public library
within its corporate boundaries and desires to cooperate with the
District in providing library service to District residents
a ccording to the terms and conditions as set forth below, and in
accordance with applicable statutes of the State of Colrrado1 and
WBEREAS, the parties ha v ~ contracted previously for a
cooperative approach to pr,,vision of said library services and
desire to cont i nue provi:lin9 saij ~ervices between the City and
the District 1
NOW THEREFORE, for and in conside r ation of the mutual promises
herein, it is agreed by and between thP. parties hereto as follows :
l. The District shall circulate to library cardholder1 of
the City of Englewood any item available for circulation from the
District's library facil.ities, and the City shall circulate to
library ~ardholders of the District any item available for
circulation from the City's library facilities. Both the District
and the City shall maintain circulation records for 1aid
transactions and shall submit such records to each other on a
quarterly basis. Within 30 clays after receipt of said reports,
the number of transactions reported by each party shall be
compared, and payment for the net difference between trar,sac:tions
shall be mad e at the rate of fifty-five cents ($,55) per
transaction 'by the library with the lesser circulat i on figure to
the library with the greater circulation figure, subjec t to the
provisions of paragraph 7,
2. The term of chis Agreement shall be from January 1, 1991
through ,December 31, 1991. During said term, all qualified
cardholders for both the District and the City libraries may use
reciprocal borrowing at both the City and the District faci:ities;
and said cardholders shall be subject to all applicable rules and
regu:ations associated with the use of s,•ch facili t ies.
3. It is understood between the parties hereto that the
District shall not receive any ~quity i 1o book stock or in any of
the City's librar;· facilities by virtue of the terii s of this
Agreement; and the City s h all not receive any equ:ty in the book
stock or i n any of the District's library facilities by virtue of
this Agreement.
4. The District shall have access to City llbruy records
during normal business hours for the purpose of verifying all
figures supplied ~o the District by the City and the City shall
have access to District library records for the same purpose.
s. During the term of this llgreement, the City shall, at its
option, provide once-a-week Bookmobile service at the 1.llce B.
Terry School. Circulation service provided at this stop to
llrapahoe Library District students enrolled at the school will be
reported to the District for reimbursement to the C t y at the rate
o f 27.5 cer.ts per loan. Circ1.lation service provided at the
Sheridan Library to Englewood students enrolled at Sheridan High
School wi~l · be reportec.l to the City for reimbursemept to the
District at the rate of 27.5 cents per loan.
6. The four public libraries in Arapahoe County, llurora
Library, Edw in 11. Bemis Library (iittleton), Englewood Library and
Arapahoe .Library District are participa t ing in a project called
APAL --Arapahoe Public l\ccess to · Libraries. In order to
administer county-wide projects such as joint programming,
collect ion development and training, each library wil i deposit a
mutually agreed upon amount not to exceed $500 in a restricted fund
held and administered by the Arapahoe Library District. The
Englewood Public Librar y contribution will be deducted from the
Arapahoe Library District's first quarter reciprocal borrowing
payment and placed i n the restricted IIPAL fund.
7. Because of a change in the reciprocal borrowing program
of the Central Colorado Library System, no payment for recip,~cal
borrowing is being made by the cities of Littleton, Englewood and
Aurora for the reciprocal use of each other's libraries. It is
reasonable to offer a certain amount of service wi~hout charge in
the name of library cooperation, and the 1 :'!IL directors have
estimated this amount to be somewhere between 9 and 101.
Therefore, in order to include the District in the benefits of this
base level of service being given without charge among the other
APAL libraries, the District shall receive a credit against any
payment du e th e City for the final quarter of this Agreement in the
amount of 9 ,51 of the payment otherwise paid or owed to the City
during •.h e entire term hereof, including the fourth quarter.
Notwith.standing anything contained in th i s Agreement, the
other party hereto acknowledges and agrees that no covenant,
agreement or obligation of Arapahoe Libr a ry Di s trict ("ALO") under
t his Agreement shall bd deemed to be a covenant, agreement or
obligation of any present or future trustee, director, officer,
employ e e or agent of ALO in h is or her i~dividual capacity and
neither the members of the governing body of ALO nor any trustee,
director or officer wh r, has executed this Agreement or any
amendment or addendum thereto, shall be liable personally thereon
or be subj ect to any personal l i ability by reason thereof.

The Council haa approved the Agreement for Library Sec:ices with the Arapahoe
Library District annually aince 1965.
STAFF ANALYSIS
The Agreement for Library Services between the Library and Ara pahoe Library Di ■trict
(ALO) secures the provis ion fo r reciprocal borrowing services from 1\LD for Englewood
re sidents and vice versa . It recognizes the importance of cooperation among
l ibraries in order to meet the needs of area residents for library services. In
addition, the Agreement currently provides income for the City and funds the
Library's participation in the Arapahoe Public Access to Libraries (APAL) Project.
The District desires to enter into this Agreement with the City. Its Board adopted
and signed this Agreement at its October 16 , 1990 meeting.
The Library Board, at its November 14 , 1990 meeting, accepted the 1991 Agreement for
Library services with the Arapahoe Library District and asked that it be forwarded
to City Council for approval.
The Agreement for Library Services with the Arapahoe Library District is presented
to Council annually . It eatabli1hea reciprocal borrowing service ■ (circulation) for
res i dents of the two library jurisdiction ■• It outlines the means for reimbur ■ement
of the "net lender" undor the Agreement and eetabUahea the payment per net
tranaaction.
Thia Agreement also addresses continuation of the Arapahoe Public Access to
Libraries (APAL) fund. This jointly-admi nieterl?d fund ia used to im plement
cooperative projects designed to serve resident ■ of the four APA L member librar ie1:
En9lewood Public Library, Littleton (Samii) Public Library, Aurora Public Library,
and Arapahoe Library District. For example: the APAL fund i1 u1ed to produce the

net loan ■ provided by ALO'• Sheridan Library to Englewood student• at Sheridan High

During the first three quarters of the 1990 Agreement, District resident ■ borrowe d
16,368 item, from EPL (17,988 items i , 1989). Of these, 1,409 l o ans occurred at the
Alica B. Terry School via the Bookmob iie. Englewood residents borrowed 1,865 item ■
from District locations (1,331 items in 1989). Of these, 98 loans occurred at the
Alica B. Terry School via the District's school/public library facility .
Income from ALO to the City via the 1990 Agreement through 3rd Quarter 1990 i ■
$7,062 .23 ($7,901.21 in 1989), Englewood P1 ·,blic Library continues to be a net
lender under the Agreement although use of EPL by District residents has declined in
recant years . Thia trend will most likely continue over the long term as Oiltrict
facilities and ■ervices improve . Convel·sely, use of District facilities by
Englewood re ■idents will likely increase (District circulation to Englewood
re ■iden ts increased by 24\ in 1989 over 1988 and lncreaaed another 40\ in 1990
compared to 1989).
It is conceiva ble that over the next few years, the status of EPl , as a net lender to
ALO may level out and may even reverse itself to the point that the City begins to
owe money to the District. Before this occurs, the Ci ty should c u:111 .:.der negotiating
with the District to eliminate the payment for reciprocal borrowing, a situation
that now exists between the cities of Littleton, Aur ora, and Englewood.
