WHEREI\S, interests located outside the City of Englewood should n..it te allowed to influence the vote of Engle-.axl citizens for the Office of City Council; an d WHEREI\S, the erlstence of a "revolving door" type relationship has ooen deronstrat ed between candidates who, after having accepted PM: cMl)aign contributions and upon hav.iJ'lg won election, have voted to use City funds to fund the interest of organi~ations closely associated with such PACs; and WHERJ::I\S , the City Council feels that Engle-.axl' s elections are properly influenced solely by Englewood residents and dizeetly by its bus inesses; NCM, THEREFCIIE, BE IT CR)AlNll) BY THE CITY CXXJNCIL CF THE CITY CF ~' CXlI.CRl\00' AS FC.lLLO'iS: Section 1. '!be Englewood Municipal Code 1985 §1-5--2 i s amended to add the follo,,ing provisions under Subsection 12 : 1-5-2-12 CI\MPI\IGI CXNI'RIBUI'ICNS I\. No candidate or elected official shall accept a m:metary contribution of any kind fran a person or political cx:mnittee not residing in Englewood. B. No candidate or elected offici1U shall accept PAC (Political l\ction Ccmnittee) rroney fran businesses or any other type of organization, association or cham:ier of cx:mrerce which does not maintllin an office or place of business within the City of Englewo'Xl. notwithstanding the existence of its custarer base, irerrber51hip or affiliation wi th Engl01,00C) citizen(s) and/or business (es) . C. /\cceptance of any type of resource, financial or otherwis e , fran any citizen group whose rrerbership includes c itizens who do not reside o r who do not have a physical presence within the City of Englewood shall constitute a violation of this ordinance. D. Acceptance of an~• type of resource, f ran any business , association or chamber o f cx:mrerce which does not maintain an o ffice or place of business within the City of Eng lewood shall constiti:te a viol a tion o f this ordinance . 9 89 E:. Vi o l a t ion o f this ordinance shall constitute a penalty assessrrent equal to the ,rrount of the unlawful contribution up t o j urisdictional limits of the rrunicipal courts lawful ability t o inpose, F . Any citizen shall have standing to reque st the City Attorney to bring a cmplaint on behalf o f the City f or violations of the foregoing in Municipal Court as provided in §1-7.>.-l, Englewood Municipal Code 1985. G. Nothing in this Code provision shall prevent any organization, association, citizen, business or group fran enoorsing ar supporting any candidate as long as ro ll'Oney or other . contribution is given directly to the candidate or his canpaign organization except by individual residents and businesses located within the City limits of Englewood.
