STAF F ANALYSIS
Section 1-4 -l(A) EHC 1985 is the General Penalty provis ion of the Mu n icipa l Code
providing i n ge:\era l for maximum punishment of S500 and 180 days i n jail o r toth
(Juven iles ca-.not be j~iled). However, somo ordinance provisions contain provi sions
for punishment either less tha n or more than the general provis ion . For i nstance
section 7 -68-ll(E) police and fire alarm system reports EMC 85 sets the pu ni shmen t
at S25.00 with no jail authoriz.ld. Wh ereas Section 12-2-6(K) EMC 85 the Wastewater
Treatment ordinance sets the punishment at Sl ,000 fine and 80 days in jai l . This is
requ:-red to conform t o Federa l EPA gu i delines. The pur pose of this proposed
a mendment i s to prev ent l it igat ion because of a conflict between the present gene r al
prov ision s and these indiv id ual o rd i nances with specific sepa rat e pun ishm ent
p rovi sions.
BACKGROUND

avoid present ly e x ist ing a mbigu ities t hat are seen as resulti ng i n unnecessary
litigation.
Immediate di r ect financial impact is none but ind. rectly will save cot.ts o f
expe:,s1.ve litigation .
