STAP'F SOURC~ Rick DeW i tt, Ci ty Attorney ISSUE/ACTION PROPOSED The Cl ty Attorney recommend• the adoption of SubSect!.on G, to Title 1-7 -2 E.M.c . 1985, The base ■ for thi ■ i ■ authority granted wi th Senate Bill 91-69. The ba ■ic n eed for thi ■ legislation la that there has in the p as t been some question concerning the legal authority of a municipal court judge to issue no c ont a ct orders. No contact orders are essentially equitable relief which require ■ "equit y" t.o act. Municipal court ■ generally do not have equity autho ri t y in the legal sense, this 1 9 an authority that i ■ generally hel d by other courts such &9 district court ■ i n the state court ayatem. The Leg islature may grant the aut hority to muni c ipal cou rt ■ and did 10 in Senate Bill 91-69.
