The building is under c ont r act, pending zone d istrict change s and b r ewery/liquor ,.t!rmits f rom the St a te and t he Ci t y of Eng lewood. It was not poss .ble to determin"? the r eason ing beh ind the ordin ance which prohibited the \.\Se originally. The Breckenridge Brewery at the Englewood l oc ati on would have an initi al capacity of 21,000 barrels per year or 65,000 gallons. The total capacity could be increased by approximately 10,000 b arrels in that b u ilding . i-i'hile t he principa l use of the bu i lding would be as a brewery, the si ze o f the b rewery would bo con ■idei:-ed very ■mall in comparie""" to ma jor brewe rie s such as Coors o r I Budwei se r in Colden and Fo rt Colline. DATE OF PUBLIC HEARi HG: Hay 21 , 1991 PROPOSED AHEHDHEHT Sec tion l6 .4-13c(3) is proposed to be amended by deleting the use "Brewery" from the list of uses prohibited in the 1-1 Di strict . PROCEDURE: At the Public Hearing , the Commission will hear testimony relative t o the pro- posed amendment to the Comprehensive Zon i ng Ordinance (CZO), and receive any evidence which might be presented . After cons idering the evidence and testimony, the Commission may either ap- prove, approve with amendments, disapprove , or tab 1 e considerat ion of th e amendment. After a decision is reached, the Commission will refer the pro- posed amendme nt or amendments t o the City Council with the Co11111i ss ion's recom- mend at ion s . Council will then consider the matter at a Public Hearing . ANALYSIS : While we cannot determine when breweries were included on the list of pro- hibited uses in Section 16 .4-13c(3) of the CZO, it is likely that this l i st appeared when the ordinance was adopted in 1955 . Many cities in the Denver metro area adopted co des at about the same time, and apparently used the same standard format. The most likely explanat i on for prohibiting br eweries, as well as other uses conta in ed in the prohib ited 11 st, is that the breweries would become a nuisance t o the surround in g area . In partic ular, brewe ries could poss ibly e,nit unp 1 ea sant od ors. A survey of five Col or ado c i t ie s , includi ng ArvaJa, Aurora, Denver, Fort Collins , and Puebl o indic ates that breweries are allcwed in general ind ustrial districts as a conditional use in two cities, and as a use-by-right in tw o citi es in industri al zo nes. Bre w-pubs, generally defined as an eatfr,g pla ce which includes brew i ng and no mor e than 30% of the brewed pro duct s old off premises and no more t han 20% of the bus i ne s s occupied by the brewing facili- ty , are ge ner ally al iowed i n business zones. Our zor,i ng ordin ance woul d allow a brew-pub, a s defined above, i n e i ther the busine s s or in dust rial distr ic ts. Brew-pub s and micro- br eweries would generally req ui re le s s than an acre, but a11." la r y,;, bn "lc ry would require more and therefore, be subject to review and pub 1 le hH t '.ng by t he Commission and Council . The standards for r evi ew ir.c l ude : a . Consistency with Comprehensive Pl an . b. Avoidance of adverse impacts on surrounding area. c . Appropriate internal and external site design and arc hi tee tural compatibility . These standards, along with the review process, will insure that any brew- ery developed will be compatible with the are a. 2) Secti on 16.4-13k Limitati ons on External Effects of Uses sets standards in the followin g ar eas: a. Sound . b . Vibration. c. Emission of heat, glare, radiation, dust anci fum·es . d . Outdoor storage and waste disposal . This section al so prohibits uses that create co1111ton nui sanr ~.1. These two provisions protect the surrounding area sufficient· t l o warrant con- sideration of allowing br eweries in the 1-1 Zone District.
