the ad op t io n of Ordinance No. 51 , Series of 1985 ; and
WH EREAS , Englewood has applied for wells lo pump groundwa te r from th e prop erty below
the Mc Lella n Rese rvoir site, such site li es within Littl eton City bou ndari es; nnd
WHEREAS, the City of Littleton is claim ing the righ t to use th e snme groun dwnt er by right
of n Li ttl eton City Ordinance; and
WHEREAS, Littl eton nee ds waler lo be in the South Platte River lo augm ent th e fl ow of th e
river to comp ensate for certain grave) pit lakes evaporation ; and
NHEREAS , En~iewood could provide replacement waler from the grounuwa te r or other
,urces in return for a favor able settlement of Littleton 's claim of the balance oftha
R 'lundwa ter; and
WHEREAS , upon app'1lval of thia Stipulation by the Court Englewood will deliv er to
Liltleto ,, 35 acre feet of wet.e r per calendar year in perpetui ty for repla ce ment water for
eva p.,ration of water in the Littleton Gravel Lake ■; and
WHEREAS , upon approval ofthia Stipulation Littleton lil'ffS that the groundwattr und er
